AN ORDINANCE OF THE VILLAGE OF THQUESTA, PALM BEACH COUNTY,
FLORIDA, ADOPTING AND INCORPORATING BY REFERENCE AS ITS
ELECTRIC CODE THE OFFICIAL CODE OF THE TOWN OF PALM BEACH,
FLORIDA, PROVIDING A PENALTY FOR A VIOLATION THEREOF AND
REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT
THEREWITH.
WHEREAS, the Village of Tequesta has authority pursuant to Section
165.191, Florida Statutes, 1955, to adopt or incorporate by reference any
published code of rules and regulations and to make the same the laws of
the Village of Tequesta; and
WHEREAS, three copies of the electric code of the Town of Palm
Beach, Florida, are filed in the office of the Town Clerk and are there to
be kept available for public use, inspection and examination; and
WHEREAS, said three copies of said electric code have been on file
with the Town Clerk for a period of more than ten days prior to the date of
the passage of this ordinance; and
WHEREAS, the Village Council deems it expedient and to the best
interest of the Village of Tequesta that said electric code of the Town of
Palm Beach, Florida, be adopted and incorporated in accordance with the
provisions of Section 165.191, Florida Statutes, 1955;
NOW, THEREFORE, BE IT OM)AINED BY THE VILLAGE COUNCIL OF THE
VILLAGE OF TEQUESTA, PALM BEACH, COUNTY, FLORIDA, AS FOLLOWS:
Section 1 . That the electric code of the Town of Palm Beach,
Florida, entitled
"AN ORDINANCE OF THE TOWN OF PALM BEACH, IN PALM BEACH
COUNTY, FLORIDA, PROVIDING FOR SAFEGUARDING LIFE AND
PROPERTY BY REGULATING AND PROVIDING FOR INSPECTION AND
INSTALLATION AND THE MAINTENANCE IN BUILDINGS AND STRUCTURES
OF ELECTRIC WIRING, ELECTRIC DEVICES, AND ELECTRIC MATERIAL.;
PROVIDING FOR THE CREATION OF THE OFFICE OF ELECTRICAL
INSPECTOR, ELECTRICAL EXAMINING BOARD, AND DEFINING THEIR
RESPECTIVE DUTIES AND POWERS; FIXING A PENALTY FOR THE
VIOLATION THEREOF."
be and the same is hereby adopted and incorporated by reference as the
electric code of the Village of Tequesta, Florida, and may be cited hereafter
as such.
Section 2 . If any section, sub - section, sentence, clause or phrase
of said electric code is for any reason held to be unconstitutional, such
shall not affect the validity of the remaining portions of said electric code.
Section 3 . Any person, firm or corporation found guilty of violat-
ing any of the provisions of the electric code shall be deemed guilty of a
misdemeanor, and each such person, firm or corporation shall be deemed guilty
of a separate offense for each and every day or portion thereof during which
any violation of the provisions of said electric code and this ordinance is
continued and permitted; and upon conviction of any such violation, such
person, firm or corporation shall be punished by a fine of not more than
$500 or by imprisonment in the Village jail for not more than thirty (30)
days, or by both such fine and imprisonment.
Section 4. That all ordinances or parts of ordinances in conflict
herewith be, and the same are, hereby repealed.
Section 5 . This ordinance shall take effect immediately upon its
passage and approval as provided by law.
PASSED AND ADOPTED on first reading this 9th day of October, 1957.
