Weinand, Dir. of Community Dev./Fire Ch' Date: November 23, 2010 Subject: Discussion on application of parking regulatio Recently there has been great deal of discussion on the application of parking regulations when a new tenant moves into a shopping center. Our current Code, specifically Section 78-705, states that ' required parking spaces are calculated: l. At the time of the erection of any main building or structure. 2. When the main building or structure is enlarged by more , than 25 percent of the square footage of the existing I� building or structure, or 3. At the time that any building is increased in capacity by adding dwelling units, guestrooms, floor area or seats. Shopping centers are calculated under Section 78-705 (29) �� requiring one space per 250 square feet of gross leasable area. Regardless of what type of business, Mercantile, Medical Office, Restaurant, etc., moves into the shopping center the parking requirements are the same. ' i If the Council wants to calculate parking based upon occupancy � use, the parking Code needs to be revised. In addition, provisions for shared parking would need to be incorporated into the Code or else occupancy usage may not be able to change.
