HomeMy WebLinkAboutResolution_19-95/96_03/07/1996 i • RESOLUTION NO. 19 — 95/96 A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, PERTAINING TO MANGROVE TRIMMING AND ALTERATION; REQUESTING THE STATE OF FLORIDA DEPARTMENT OF ENVIRNOMENTAL PROTECTION TO DELEGATE TO THE VILLAGE OF TEQUESTA THE DEPARTMENT'S AUTHORITY TO ADMINISTER AND ENFORCE THE REGULATION OF MANGROVES; AUTHORIZING AND DIRECTING THE VILLAGE MANAGER TO FILE A WRITTEN REQUEST FOR DELEGATION AND PROVIDE SUPPORTING INFORMATION; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Florida Legislature, through CS /HB 1507, has enacted a Law which, among other things, abolishes local regulation of mangroves but provides for delegation of the administration and enforcement of the State's Regulatory Program; and • WHEREAS, the Village Council finds that the Village of Tequesta has sufficient resources and procedures for the adequate administration and enforcement of a delegated mangrove regulatory program. NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS: Section 1. The Village Council of the Village of Tequesta hereby adopts this written request that the Florida Department of Environmental Protection delegate the Department's authority to administer and enforce the ` regulation of mangroves as provided in CS /HB 1507, specifically Section 4, which creates Section 403.9324, Florida Statutes, to administer in accordance with the Act and Rules promulgated thereunder. Section 2. The Village Manager is authorized and directed to file this request with the State of Florida Department of Environmental Protection and to provide supporting documentation demonstrating that the Village has sufficient resources and procedures for the adequate administration and enforcement of a delegated mangrove regulatory program. Section 3. Effective Date. This Resolution shall take effect immediately upon its adoption. I THE FOREGOING RESOLUTION WAS OFFERED by Councilmember • William E. Burckart , who moved its adoption. The motion was seconded by Councilmember Carl Hansen , and upon being put to a vote, the vote was as follows: FOR ADOPTION AGAINST ADOPTION William E. Burckart Joseph N. Capretta Carl Hansen Ron T.
