HomeMy WebLinkAboutOrdinance_08-10_12/09/2010 ORDINANCE 8 -10 AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, AMENDING CHAPTER 2. ADMINISTRATION. AT ARTICLE II. VILLAGE COUNCIL. BY ADOPTING A NEW SEC. 2- 34. TO BE ENTITLED VILLAGE LOGOS PROVIDING FOR THE OFFICIAL ADOPTION OF TWO VILLAGE LOGOS; DESCRIBING THE VILLAGE LOGOS; PROVIDING THAT THE SAID VILLAGE LOGOS MAY ONLY BE UTILIZED FOR OFFICIAL VILLAGE OF TEQUESTA BUSINESS OR UPON THE WRITTEN APPROVAL BY THE VILLAGE COUNCIL, FLORIDA; PROVIDING THAT THE VILLAGE COUNCIL MAY GRANT APPROVAL FOR THE USE OF THE LOGOS FOR A PROPER PURPOSE; PROVIDING THAT THE VILLAGE COUNCIL MAY ADOPT REASONABLE RULES FOR THE MANUFACTURE, USE, FACSIMILE OR REPRODUCTION OF THESE LOGOS; PROVIDING FOR PENALTIES; PROVIDING FOR REGISTRATION WITH THE SECRETARY OF THE STATE OF FLORIDA AND THE UNITED STATES PATENT AND TRADEMARK OFFICE; PROVIDING THAT EACH AND EVERY OTHER PROVISION, SECTION, AND ARTICLE OF CHAPTER 2. ADMINISTRATION. SHALL REMAIN IN FULL FORCE AND EFFECT AS PREVIOUSLY ENACTED; PROVIDING A CONFLICTS CLAUSE, A SEVERABILITY CLAUSE AND AUTHORITY TO CODIFY; PROVIDING AN EFFECTIVE DATE; AND FOR OTHER PURPOSES. WHEREAS, the Village Council of the Village of Tequesta, Florida desires to officially adopt two Village logos which would identify officially sanctioned items, including documents, correspondence, awards, commendations, as well as miscellaneous articles utilized to publicize Village events; and WHEREAS, the Village Council of the Village of Tequesta desires to publicize the Village's logos such that the citizens of Tequesta may rely on these emblems to signify an item that has official Village approval and support; and WHEREAS, the Village Council believes that the official adoption of Village logos will create civic spirit and serve to unify the Village in working toward the goals and objectives desired by the citizens who reside within the Village of Tequesta. NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTQA, FLORIDA, THAT: -1- Section 1 : Chapter 2. Administration. of the Code of Ordinances of the Village of Tequesta, Florida is hereby amended at Article 11. Village Council. by adopting an entirely new Sec. 2 -34. to be entitled AVillage Logos@ which shall hereafter read as follows: Sec. 2 -34. Vollaae Logos as Description of village logo. The village logo of the Village of Teauesta is in he shape of an oval. Around the top edge of the oval are the words "Village of Teauesta" in capital letters. Around the bottom edge of the oval are the words "Palm Beach County Florida" in capital letters. The entire edge of the oval, for the width of the above words, is shaded royal blue and the words are printed in white Arial font. The royal blue edge is bordered with a black line on both the interior and exterior sides. Inside the oval is the bust of a male South Florida tribal Indian He is wearing a sheath of arrows on his back and a small piece of woven straw on his chest. He is looking slightly to his left. His hair is rolled under all the way around his head and a thick bunch of hair is pulled up tightly, divided into two sections, and tied into a knot. He is wearing arse round earrinas. In front of his riaht arm is depicted a sack that is tied closed at the op with a cord. Starting at the top of the oval and moving down toward the bottom. the shading behind the Indian grades from orange to yellow to green to blue. A reasonable facsimile of the said logo is attached as Exhibit A bW Description of feather script logo. The feather script logo is the word "Teauesta" in royal blue Edwardian Script ITC font. The capital letter T has two multi colored feathers dangling from the top left side. A reasonable facsimile of the said Joao is attached as Exhibit B. (c) Adoption of logos. The loaos described and depicted in paragraphs(a) and (b) are hereby adopted as the official logos of the Village of Teauesta. Florida. a municipal corporation organized and existing in accordance with the laws of the State of Flori (d) Unlawful Practices and Penalties. Any facsimile or reproduction of these logos shall only be manufactured, used, displayed, orotherwise employed for official Village of Teauesta business or upon the written approval of the Village Council of the -2- Village of Teauesta Florida The Village Council may grant approval for the use of the logos upon application by any person showing good cause for the use of the logos for proper civic purpose. The Village Council may adopt reasonable rules for the manufacture or use of these logos or any facsimile or reproduction thereof. These logos shall be registered with the Secretary of State in accordance with the laws of the State of Florida. and with the United States Patent and Trademark Office and shall be the sole property of the Village of Teauesta. Any person violating the provision of this ordinance shall be guilty of a misdemeanor of the second dearee and punished as provided by law. Section 2 : Each and every other section and subsection of Chapter 2. Administration. of the Code of Ordinances of the Village of Tequesta shall remain in full force and effect as previously enacted. Section 3 : All ordinances or parts of ordinances in conflict be and the same are hereby repealed. Section 4 : Should any section or provision of this Ordinance or any portion thereof, any paragraph, sentence or word be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder of this Ordinance. Section 5 : Specific authority is hereby granted to codify this Ordinance. Section 6 : This Ordinance shall take effect immediately upon passage. -3- Ex. A w Ex. B Upon Second Reading this 9 day of December 2010, the foregoing Ordinance was offered by Council Member Humpage who moved its adoption.
