RESOLUTION NO. 13 - 94/95
A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE
OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, APPROVING
A NON -AD VALOREM ASSESSMENT AGREEMENT WITH THE TAX
COLLECTOR OF PALM BEACH COUNTY FOR IMPLEMENTATION
OF THE NON -AD VALOREM BILLING AND COLLECTION
ASSOCIATED WITH COLLECTION SERVICES FOR GARBAGE,
TRASH AND RECYCLABLES WITHIN THE VILLAGE OF
TEQUESTA.
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE
VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS:
Section 1. The Non -Ad Valorem Assessment Agreement with the
Tax Collector of Palm Beach County for Implementation of the
Non -Ad Valorem Billing and Collection Associated with
Collection Services for Garbage, Trash and Recyclables within
the Village of Tequesta, attached hereto as Exhibit "A ", and
incorporated by reference as a part of this Resolution, is
• hereby approved and the Mayor of the Village is authorized to
execute the same on behalf of the Village of Tequesta.
THE FOREGOING RESOLUTION was offered by Councilmember
Burckart , who moved its adoption. The motion
was seconded by Councilmember Scha„Pr , and
upon being put to a vote, the vote was as follows:

The Mayor thereupon declared the Resolution duly passed and
adopted this 23rd day of February, A.D., 1995.

NON -AD VALOREM ASSESSMENT AGREEMENT
•
The Tax Collector of Palm Beach County and the Village of Tequesta hereby agree as
follows:
1. The Village of Tequesta shall meet all the requirements of Florida Statutes
197.363 and 197.3632 for the implementation of the Village's non -ad valorem
assessment billing.
2. Upon the performance by the Village of Tequesta of the requirements of the
above statutes and this Agreement, the Tax collector agrees to implement the
Village of Tequesta's non -ad valorem assessment billing and collection.
3. The Village of Tequesta further agrees that it shall provide to the Tax Collector
compensation for the actual cost of collecting this non -ad valorem assessment
as provided in Florida Statutes. (F.S. Section 197.3632 (8) (C). Since the
actual costs of collection cannot be precisely determined, the parties agree that
one percent (1 %) of total collections will be considered the costs.
4. This Agreement shall be in effect for the tax year 1995 and subsequent years
thereafter unless cancelled by either the Village or the Tax Collector by giving
notice in writing to the other by January 10th.
• 5. This Agreement may be modified by both parties in writing provided such
modifications are agreed upon prior to any notice of termination.
6. This Agreement shall be changed, modified or amended in writing as necessary
to conform with any new statutory requirements when and if enacted into law.
