HomeMy WebLinkAboutResolution_06-94/95_12/15/1994 RESOLUTION NO. 6 -94/95 A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, APPROVING THE VILLAGE OF TEQUESTA URBAN SERVICES REPORT REFERENCED HEREIN, WHICH REPORT SETS FORTH PLANS TO PROVIDE URBAN SERVICES TO AREAS PROPOSED TO BE ANNEXED TO THE VILLAGE OF TEQUESTA, AND AUTHORIZING THE TRANSMITTAL OF A COPY OF THE REPORT TO THE BOARD OF COUNTY COMMISSIONERS OF PALM BEACH COUNTY, FLORIDA WHEREAS, the Village of Tequesta desires to annex certain properties to the corporate limits of the Village of Tequesta; and WHEREAS, Section 171.042, Florida Statutes, sets forth certain prerequisites to annexation; and WHEREAS, one of those prerequisites is that the governing body of the municipality shall prepare a report setting forth the plans • to provide urban services to any area to be annexed; and WHEREAS, said urban services report has been prepared and is attached hereto as Exhibit " A " ; and WHEREAS, it is the desire of the Village Council of the Village of Tequesta to approve said report and to file a copy of same with the Board of County Commissioners of Palm Beach County, Florida. NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, as follows: Section 1. The Urban Services Report attached hereto as Exhibit "A ", prepared pursuant to Section 171.042, Florida Statutes, and containing all of the information required by said statute, is hereby approved. • Section 2. Pursuant to Section 171.042, a copy of the Urban Services Report herein approved shall be submitted to the Board of County Commissioners of Palm Beach County, Florida. THE FOREGOING RESOLUTION was offered by Councilmember Earl L. Collings , who moved its adoption. The Resolution was seconded by Councilmember Elizabeth A. Mackail A'T'TEST Village Clerli JCR \13153- 01 \RESOLUTI.2 • 2 EXHIBIT "A" VILLAGE OF TEQUESTA URBAN SERVICES REPORT 1995 PROPOSED ANNEXATION This Urban Services Report has been prepared in compliance with Florida Statutes, Chapter 171, by Village of Tequesta Staff in preparation for five separate Annexation Referendum Questions scheduled for: March 14. 1995. A set of maps is attached as exhibit "A ", showing the present and proposed municipal boundaries, the present major water mains, sewer interceptors and outfalls, the proposed extension of such mains and outfalls, and the general land use pattern of the areas proposed to be annexed. There are Five proposed annexation areas identified as: Areas "A ", "B ", "C", "D ", and "E ". This is to certify that the areas to be annexed meet the criteria in Section 171.043 of the Statutes. Each area proposed for annexation is contiguous to the existing Village boundaries and is reasonably compact. Each area is almost entirely developed for urban purposes, having a total population of more than two persons per acre: Area "A" contains a total population of 1101, and averages 8.53 persons per acre. Area "B" has a population of 191, and averages 4.24 persons per acre. Area "C" has a population of 44, and averages 2.06 persons per acre. Area "D" has a population of 773, and averages 2.95 persons per acre. Area "E" has a population of 431, and averages 9.58 persons per acre. Undeveloped portions comprise less than 70% of the land area in each area to be annexed. The Village of Tequesta is a full service municipality providing a complete range of urban services. The current residential population of Tequesta is 4,573, with an average of 3.22 persons per acre. The services provided to current Village residents will be extended to residents and properties in areas to be annexed. Police Services - The Village of Tequesta currently operates a full service Police Department. The average response time to an emergency call by Tequesta Police is 1.5 minutes. The Village is presently divided into two patrol zones. Upon the effective date of annexation, Police Services will be extended in the same manner and to the same level of service as provided within current corporate limits. This can be achieved by creating a third patrol zone, if necessary, and by the addition of as many as five (5) Certified Officers, along with appropriate equipment. Fire - Rescue Services - The Village of Tequesta currently operates a full service Fire - Rescue Department. The average response time to an emergency call by Tequesta Fire - Rescue is 3.5 minutes. Upon • the effective date of annexation, Fire - Rescue Services will be extended in the same manner and to the same level of service as provided within current corporate limits. One additional combat • personnel along with appropriate equipment may be necessary by virtue of the proposed annexation. Water Service - The Village currently operates a water utility with service area inclusive of the Village, certain unincorporated Palm Beach County, part of the Town of Jupiter, south Martin County unincorporated, and all of the Jupiter Inlet Colony. All of the areas within current Village boundaries are provided with water utility service. The areas to be annexed are within the existing water service boundaries of the Village. There are two system improvements necessary to provide the same level of service to annexed residents as provided to current Village residents which consist of the following: 1) Part of the Jupiter Heights Subdivision within Area "A" would require Capital Expenditure expenses estimated at $41,500 to provide service mains to an estimated thirty (30) single - family homes. 2) Along Pine Tree Drive within Area "D ", Capital Expenditure expenses estimated at $19,350 would be required to extend service mains to an estimated sixteen (16) single - family homes. Potential sources of these funds are various: • 1. Village of Tequesta Water System Fiscal Year 95/96 Capital Improvement Budget. These improvements are currently unbudgeted expenditures in FY 96 or beyond. 2. Residents could pay capital improvement fees sufficient to provide the service. 3. The Village, Palm Beach County, and the Residents could enter into separate agreements for each Area pursuant to the "Annexation Incentive Program" as administered by the County Engineering Department, which agreement would provide for cost sharing by the parties of all expenses. Construction of each system improvement is contemplated to commence during the Fiscal Year 1995/1996. Sewer Service - Sanitary sewer service is provided by the Loxahatchee River Environmental Control District (ENCON) throughout the Village and surrounding areas. Since there is currently no Village -wide requirement that existing septic systems be disallowed and property owners forced to hook up to sewer, there would be no requirement by the Village of Tequesta in newly annexed areas that the use of septic systems be discontinued. 2 • The Village's development codes require that all new subdivisions be served by sanitary sewer. This requirement would apply only to new development of platted subdivisions in the annexed areas. i Streets and Drainage - The Village of Tequesta currently maintains all Village -owned streets within the corporate boundaries, which includes all public roadways with the exception of U.S. Highway One, County Road 707 (Beach Road), portions of County Line Road, and Old Dixie Highway. Streets in all areas other than the Waterway Village Subdivision within Area "B ", are currently owned and maintained by Palm Beach County. These streets are anticipated to be maintained by the Village with minimal additional operating expenditures estimated at less than $200 per year. An initial improvement expense would be incurred for provision of stop signs, stop bars, and street signs, the cost of which is estimated to be $600. Adding street lights to the same level of service as provided in the remainder of the Village is estimated to cost an additional $75 per year in electricity costs. Area "B" includes an estimated 2.4 lane miles of streets owned and maintained by the Waterway Village Property Owners' Association. If, upon annexation, these streets were dedicated to the Village, approximately 10 to 15 man -hours per month would be required in general maintenance. An initial outlay of $800 would be required to improve and /or add stop bars, stop signs, and street signs. Additional street lights are estimated to cost $100 annually in operating expenditures. Resurfacing of Waterway Village roads is • anticipated to cost $50,000 in the next 5 to 7 years. Drainage improvements may be required in Area "B" primarily in Waterway Village. The Public Works Department estimates the repairing of cracked structures at $10,000. Other drainage system improvements could cost up to $175,000 in the next 5 to 7 years. This estimate includes $100,000 in drainage improvements to Waterway Road and $75,000 in repairs to existing drainage infrastructure. Area "D" includes an estimated 0.8 lane miles of essentially unimproved roadway owned and maintained by Palm Beach County. Upon annexation, this substandard street may require improvements estimated at $200,000 in order to construct a new roadway and install drainage. Potential sources of these funds are various: 1. Village of Tequesta Capital Improvement Program Fiscal Year 95/96 Capital Improvement Budget. This is currently an unbudgeted expenditure in FY 96 or beyond. 2. Residents could pay capital improvement fees sufficient to 3 • provide the improvements. 3. The Village, Palm Beach County, and the Residents could enter • into separate agreements for each Area pursuant to the "Annexation Incentive Program" as administered by the County Engineering Department, which agreement would provide for cost sharing by the parties of all expenses. Recreation - The Village currently operates Tequesta Park, a 42 acre, active park located in Martin County on County Line Road; Constitution Park, currently a passive park located on North Dover Road; and Village Green, a passive park on Tequesta Drive. Local recreational needs are also provided through Coral Cove Park, a 6.25 acre ocean -front park operated by Palm Beach County and located within the corporate limits of the Village. Annexation of all Areas anticipated will require no additional expense as all of these facilities are currently used by Village and Palm Beach County residents alike. Community Development - The Village currently provides community development services through the Department of Community Development which issues building permits, reviews site plans, issues certificates of occupancy, ensures that development complies with the Village's Comprehensive Development Plan and handles other issues relating to the development of the Village. The Department of Community Development is currently experiencing an increase in local development activity, and anticipates this trend to escalate upon annexation creating a significant demand on current staff. Building and permitting services to the annexed area, however, • would be provided by the Department at costs equivalent to or less than the estimated permit and license revenues the areas will generate. The Department of Community Development also provides for zoning regulation and rezoning of Village land areas. It is probable that the zoning of the areas proposed for annexation would be redesignated within one year of the date of annexation. Preliminary indications are that particular care will have to be exercised in redesignation, primarily for existing residential properties, in order to assure that full development rights will be preserved for new Village residents.
