HomeMy WebLinkAboutResolution_27-92/93_09/07/1993 RESOLUTION NO. 27 — 92193 A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, URGING ADELPHIA CABLE COMMUNICATIONS AND ALL LOCAL BROADCASTERS INVOKING RETRANSMISSION CONSENT UNDER THE CABLE ACT OF 1992 TO NEGOTIATE IN GOOD FAITH FOR THE CONTINUED RECEPTION OF LOCAL BROADCAST PROGRAMMING BY ADELPHIA CABLE COMMUNICATIONS IN ORDER TO SERVE THE PUBLIC INTEREST. WHEREAS, the United States Congress, on October 5, 1992, enacted into law, the Cable Television Consumer Protection Act of 1992 (the Cable Act of 1992); and WHEREAS, as part of the Cable Act of 1992, rules were established relative to "Retransmission Consent" and "Must Carry" status, in order to allow local broadcasters the ability to make key decisions relative to their business within their Area of Dominate Influence; and WHEREAS, certain local broadcasters have sought Retransmission Consent consideration from the cable companies in their Area of Dominate Influence necessitating negotiation of appropriate renumeration for signal transmission of local broadcasts over cable television networks; and WHEREAS, negotiations between local broadcasters and franchised cable companies may have come to an impasse, creating the possibility that certain local broadcast programming will no longer be available to the residents of the Village of Tequesta subscribing to cable television services provided by Adelphia Cable Communications, the franchised operator within the Village of Tequesta; and WHEREAS, continued reception of local broadcast service by cable subscribers is in the public interest. NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS: Section 1. Adelphia Cable Communications, the local Franchised cable operator within the Village of Tequesta, is requested to negotiate in good faith with all local broadcast stations invoking "Retransmission Consent" so that local broadcast programming will continue to be made available to cable television subscribers within the Village of Tequesta, receipt of which is in the public interest. Section 2. All local television broadcasters who include the Village of Tequesta within their Area of Dominant Influence and have invoked the Retransmission Consent provisions of the 1992 Cable Act are likewise requested to negotiate in good faith with the local cable operators so as to reach agreement and allow for the continued receipt of local broadcast signals by cable subscribers within the Village of Tequesta, receipt of which is in the public interest. Section 3. The Village Manager is hereby directed to distribute copies of this Resolution to the appropriate officials at Adelphia Cable Communications, all local television broadcasters and the Administrator of the Loxahatchee Council of Governments. THE FOREGOING RESOLUTION WAS OFFERED by Councilmember Collings , who moved its adoption. The motion was seconded by Councilmember Burckart , and upon being put to a. vote, tre vote was as follows: FOR ADOPTIO AGAINST ADOPTION Elizabeth A. Schauer Ron T. Mackail William E.
