A RESOLUTION OF THE VILLAGE COUNCIL OF THE
VILLAGE OF TEQUESTA, PALM BEACH COUNTY,
FLORIDA, APPROVING AN EMERGENCY SERVICES
MUTUAL AID AGREEMENT BETWEEN THE NORTHERN
AREA MUTUAL AID CONSORTIUM (NAMAC) AND THE
VILLAGE OF TEQUESTA, PROVIDING FIRE AND
EMERGENCY MUTUAL AID SERVICE AND AUTHORIZING
THE MAYOR TO EXECUTE THE SAME ON BEHALF OF
THE VILLAGE.
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE
VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS:
Section 1. The Emergency Services Mutual Aid Agreement
Between the Northern Area Mutual Aid Consortium and the
Village of Tequesta, Providing Fire and Emergency Mutual Aid
Service, attached hereto as Exhibit "A" and incorporated by
reference as a part of this Resolution, is hereby approved
and the Mayor of the Village is authorized to execute the
same on behalf of the Village of Tequesta.
THE FOREGOING RESOLUTION WAS OFFERED by Councilmember
Burckart , who moved its adoption. The
motion was seconded by Councilmember C olljnZs ,
and upon being put to a vote, the vote was as follows:

NORTHERN AREA MUTUAL AID CONSORTIUM
N A M A C
'urpose: To provide an organized method of providing
Fire and Emergency Mutual Aid Service to
member jurisdictions.
Scope: To invite interested providers of Fire and
Emergency Services to meet and plan for the
times when the resources of one jurisdiction
can not control an emergency situation.
Definition: Mutual Aid: Assistance given to a neighboring
member jurisdiction at those times when fires
and emergencies exceed the resources of one
jurisdiction. This can relate to one large
incident or multiple incidents occuring at one
time.
Coordina C o uncil :Member jurisdictions shall appoint one repre-
sentative and one alternate representative to
the Coordi Council These representatives
shall be elected officials or management
officers of the member jurisdiction.
The Co gsdinating_Council shall oversee and
facilitate the operation of this consortium and.
from time to time inspect facilities and equip-
ment to be used in this plan.
The coordina Council shall elect a Chairman,
ViceChairman and Secretary. The Coordinating
Council shall meet no less than four time
during the first twelve mo of this agre
ment, an no less than once every six month
thereafter, at a time and place designated by
the Chairman. Sp ecial meetings may be called by
a r =member wi th majority consent.
Council of Chiefs: The Chief Officer of each member jurisdiction
shall sit as a member of the Council of Chiefs.
A member jurisdiction may also appoint an
alternate to the Council of Chiefs. The Council
of Chiefs shall operate NAMAC and conduct drills
of the system, institute an Incident Command
System, establish a universal numbering system
of command personnel and equipment and stations.
The members of the Council of Chiefs shall elect
a Chairman ViceChairman and Secretary. The
Council of Chiefs shall meet no less than six
times during each year at a time and place
designated by the Chairman.
EMERGENCY SERVICES MUTUAL AID AGREEMENT
WHEREAS, the parties to this Agreement p4bsently maintain
a Fire- Rescue Department with fire rescue equipment, fire fighting
personnel, emergency medical equipment, emergency medical personnel,
hazardous materials response equipment and trained technical
personnel, and other emergency capabilities; and
WHEREAS,' it is deemed mutually advantageous to enter into this
Agreement providing for mutual aid in times of emergency where the
need created may be too great for any one party to deal with
unassisted.
NOW, THEREFORE, it is agreed by and between the parties that
each will render mutual assistance and service to the other under
the following stipulations, provisions and conditions:
1. Mutual aid and assistance, including, but not limited to ,
f ire response, medical response and stand -by coverage, will be given
when properly requested so long as rendering the aid and assistance
requested will not place the assisting party in undue jeopardy.
2. The person requesting the mutual aid and assistance shall
•ive the following information at the time his request is made:
a) The general nature, type and location of the emergency.
b) The type of equipment and /or personnel needed.
3. Only the following officials of the participating parties
are authorized to request aid and assistance under this Agreement:'
The respective Fire Chiefs, Deputy Fire Chief, Assistant Fire Chiefs,
Incident Commanders or City Managers.
4. In the event of an emergency occurance which requires
additional assistance, the Fire Chief of the jurisdiction in which
the incident is located, or in his absence, the Deputy Fire Chief,
the Assistant Chiefs or the Incident Commander, will direct the
activities at the scene where the emergency exists, but personnel
on the mutual aid call will remain under the command of their own
officers at all times. The rendition of services, standards of
performance, discipline of officers and employees, and other matters
incidental to performance of services and control of personnel shall
remain within the respective control of their own departments.
5. Each participating party reserves the right to refuse a
Otual aid call in the event it does not have the required equipment
available or if, in its judgement, compliance with the request would
jeopardize the protection of its own jurisdiction.
6. No employee of any party to this Agreement shall perform
any function or service which is not within the scope of the duties
of that person within his /her own department
7. Persons employed by any party shall not,. connection with
this Agreement or in the performance of services and functions
pursuant hereto, claim any right to pension, worker's compensation,
unemployment compensation, civil service, or other employee rights
or privileges granted by� operation of law or otherwise except
through and against the entity by which they are employed at the
t ime of the call and /or response.
8. The parties to this Agreement and their respective officers
and employees shall not be deemed to assume any liability for the
act, ommission, and negligence of the other party. Further, nothing
herein shall be construed as a waiver of sovereign imidunity, pursuant
Florida Statutes, Section 768.28.

• 9. All the privileges and immunities from liability, exemptions
from law, ordinance and rules and all pensions and relief, disability
worker's compensation and other benefits which apply to the activity
of the officers or employees of either party, when performing their
respective functions within the territorial l -imits for their resp-
ective agencies shall apply to the same degree and extent to the
performance of such functions and duties extraterritorially pursuant
to this Agreement. Liability for injury -to personnel, and for loss
or damage of equipment, shall be borne by the party employing such
personnel and - owning such equipment.
10. The cost of gasoline and other normal supplies used for
mutual aid purposes shall be the responsibility of the party suppling
such items, except that certain expendable supplies, such as oam
ar o er specialty products, will be replaced by the agency requesting
assistance. In ad dition, costs incurred for rescue and /or medical
supplies used shy be Billed to the respective ene iciarips (i.e
patients) of such supplies. Emplo yees working under the auspices of
this agreement shall be exempted fro the de ination of beneficiaries
an /or patient and therefore, would not be billed for rescue and/or
medical su
11. All compensation, excep as otherwise stated in the agree
ment, for personnel shall be bourne by the entity by which they are
-employed at the time of call and/or response.
12. Any party to this Agreement may, upon giving ninety (90)
days written notice to the governing body of the other parties,
terminate this Agreement and after the effective date of such notice
the parties will be relieved of any further obligations under this.
Agreement.
13. This Agreement shall continue in full force and effect
for like terms as that set up in the original term of this contract,
subject to the termination provisions of Paragraph 12.
14. All parties to the Agreement, on an annual basis, shall
exchange Capital Improvement Plans indicating projected location
and anticipated time frames for construction of future fire stations
within their respective jurisdictions. It is understood that these
plans may be modified subsequent to submission and said plans are
subject to subsequent funding allocations and approvals.

nothing herein shall be construed as a waiver of sovereign
immunity, pursuant to Florida Statutes, Section 768.28.

10. The cost of gasoline and other normal supplies used for
mutual aid purposes shall be the responsibility of the party
supplying such items except that certain expendable supplies, such
as foam or other specialty products, will be replaced by the agency
requesting assistance. In addition, costs incurred for rescue
andZor medical supplies used shall be billed to the respective
beneficiaries (i.e. patients) of such supplies. Employees working
under the auspices of this Agreement shall be exempted from the
definition of beneficiaries and /or patient and therefore, would not
be billed for rescue and - Zor medical supplies
11. All compensation, except as otherwise stated in the
Agreement for personnel shall be borne by the entity by which they
are employed at the time of call and /or response
12. Any party to this Agreement may, upon giving ninety (90)
days written notice to the governing body of the other parties,
terminate this Agreement and after the effective date of such
