HomeMy WebLinkAboutResolution_09-91/92_02/20/1992 i RESOLUTION NO. 9 -91/92 A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, OPPOSING THE EFFORT TO EMPOWER THE PALM BEACH COUNTY BOARD OF COUNTY COMMISSIONERS WITH THE AUTHORITY TO MAKE LAND USE DECISIONS WHICH WOULD BE BINDING WITHIN MUNICIPAL BOUNDARIES; OPPOSING THE EFFORT TO EMPOWER THE BOARD OF COUNTY COMMISSIONERS TO ADOPT A COUNTY -WIDE ENVIRONMENTALLY SENSITIVE LANDS ORDINANCE PREVAILING OVER MUNICIPAL ORDINANCES WHICH ARE LESS STRINGENT, AND URGING ALL VILLAGE VOTERS TO VOTE AGAINST SUCH EMPOWERMENTS IN THE MARCH 10, 1992, COUNTYWIDE REFERENDUM ON THESE MATTERS. WHEREAS, the Palm Beach County Board of County Commissioners has called a Referendum to be held on March 10, 1992, regarding a "Countywide Growth Management and Land Use Authority Charter Amendment "; and WHEREAS, the Palm Beach County Board of County Commissioners I i has also called a Referendum to be held on March 10, 1992, I providing for the Board of County Commissioners to adopt a County -Wide Environmentally Sensitive Lands Ordinance that would prevail over less stringent municipal ordinances dealing with this same subject matter; and WHEREAS, the Village Council views the provisions of these proposed Charter Amendments to constitute an improper and unnecessary encroachment by the County upon municipal home rule; and WHEREAS, the Village Council does not believe that any aspect of municipal handling of land use, growth management decision making and protection of environmentally sensitive lands in Palm Beach County has provided reasonable grounds for the Board of County Commissioners effort to encroach on municipal home rule authority in these areas; and WHEREAS, the Village Council believes that it would be counter to the best interests of the residents of the Village of Tequesta for the Palm Beach County Board of County Commissioners to be empowered with the authority to make land use decisions which would be binding within the corporate limits of the Village of Tequesta or for the Board to have jurisdiction over environmentally sensitive lands and related issues within the Village of Tequesta. NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, as follows: Sect 1. The Village Council officially and unequivocally opposes any effort by the Palm Beach County Board of County Commissioners to empower said Board of County Commissioners with the authority to make land use decisions which would be binding within municipal boundaries. Section 2. The Village Council officially and unequivocally opposes any effort by the Palm Beach County Board of County Commissioners to empower said Board of County Commissioners to have jurisdiction over environmentally sensitive lands within municipal boundaries. Section 3. The Village Council encourages all registered voters in the Village of Tequesta to vote "NO" on these Countywide Referendum issues on March 10, 1992, which propose to so empower the Board of County Commissioners. Section 4. The Village Clerk is hereby directed to immediately transit copies of this Resolution to the Palm Beach County Board of County Commissioners and the Palm Beach County Municipal League. i THE FOREGOING RESOLUTION WAS OFFERED by Councilmember R nn T_ Markail who moved its adoption.
