HomeMy WebLinkAboutResolution_01-91/92_11/21/1991 RESOLUTION NO. 1 -91/92 A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA,j PALM BEACH COUNTY, FLORIDA, AUTHORIZING THE ACQUISITION OF CERTAIN EASEMENT RIGHTS FOR LOCATION OF UNDERGROUND UTILITIES ON LANDS LOCATED IN MARTIN COUNTY, FLORIDA. WHEREAS, the Village Council of the Village of Tequesta deems it necessary to secure certain utility easement rights for the location of a water main for the provision of potable water for users of the Village of Tequesta Water System; NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL of the Village of Tequesta, Florida, as follows: Section 1. The Village Council of the Village of Tequesta hereby determines that it is necessary to acquire easement rights to certain lands in Martin County, Florida, for the purpose of providing potable water to users of the Village of Tequesta Water Utility System. The land necessary to be acquired is more particularly described in the attached ! Exhibit "A ". Section 2. The Village Council of the Village of Tequesta Hereby adopts the description of the easement to be acquired on Exhibit "A" attached. Section 3. The Village Council of the Village of Tequesta hereby authorizes and instructs the Village Attorney and such other Village Officials and employees to take such actions as are needed, including the engagement of appraisers, to acquire by donation or purchase, easement rights to the above - described land for public purpose as set forth above. Section 4. This resolution shall take effect immediately upon its adoption. THE FOREGOING RESOLUTION WAS OFFERED by Councilmember Burckart _ who moved its adoption. The Resolution was seconded by Councilmember Collings and upon being put to a vote, the vote was as follows: FOR ADOPTION AGAINST ADOPTION Ro T. Mackail Joseph N. Capretta Earl L. Collings William E. Capre a ATTEST: s i J06fin Manganie. o Village Clerk I EXHIBIT "A" DESCRIPTION: UTILITY EASEMENT NO. 1 A strip of !a,-,d lying w;thin Section 15, Township 40 South, Range 42 East, Martin County, Florida and being an easement 12 feet wide lying 6 feet each side of the following described centerline: Commence at the Southeast corner of said Section 15; thence North 89 °55'33" West along the South line of said Section 15, a distance of 1328.01 feet to the Point of Beginning; thence North 00 West, a distance of 12.59 feet; thence North 89 0 15'00" East, a distance of 230.93 feet; thence South 89 0 59'24" East, a distance of 677.55 feet; thence South 81 °19'06" East, a distance of 11.15 feet to a point on a line 15 feet North of (as measured at right angles) and parallel with said South line of Section 15; thence South 89 °55'33" East along said parallel line, a distance of 408.59 feet to a point on the East line of said Section 15 and the Point of Termination. Bearings based on the South line of the Southeast one - quarter of Section 15- 40 -42, said line is assumed to bear North 89 °55'33" West. Subject to easements and restrictions of record. The sidelines of the above described strip shall be lengthened or shortened as necessary to meet the parameters as described. Reference attached sketch for a graphic depiction of this description. 90 -191 11/06/91 DESCRIPTION: UTILITY EASEMENT NO. 2 A strip of land lying within Section 14, Township 40 South, Range 42 East, Martin County, Florida, and being an easement 12 feet wide, lying 6 feet each side of the following described centerline: Commence at the Southwest corner of said Section 14; thence North 00'06'13" East along the West line of said Section 14, a distance of 15.00 feet to the Point of Beginning; thence South 89 °51'51" East along a line 15 feet North of (as measured at right angles) and parallel with the South line of said Section 14, a distance of 1162.90 feet; thence South 86 °17' 16" East, a distance of 80.16 feet; thence South 89 °51'51" East along a line 10 feet North of (as measured at right angles) and parallel with said South line, a distance of 60.00 feet; thence South 00 °08'09" West, a distance of 4.00 feet; thence South 89 °51'51 " East along a line 6 feet North of (as measured at right angles) and parallel with said South line, a distance of 55.00 feet to the Point of Termination. Bearings based on the South line of the Southwest one - quarter of Section 14- 40 -42, said line is assumed to bear North 89 °51'51 " West. Subject to easements and restrictions of record.
