HomeMy WebLinkAboutResolution_05-90/91_12/13/1990 RESOLUTION NO. 5 -90/91 A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, PROVIDING FOR A SPECIAL ELECTION TO BE HELD ON TUESDAY, JANUARY 15, 1991, AT THE VILLAGE HALL, 357 TEQUESTA DRIVE, TEQUESTA, FLORIDA, FOR THE PURPOSE OF CONDUCTING A "STRAW BALLOT QUESTION" RELATING TO PUBLIC SAFETY SERVICES, AS SPECIFIED IN RESOLUTION NO. 4- 90/91, ADOPTED NOVEMBER 8, 1990, BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, AND PROVIDING FOR THE APPOINTMENT OF ELECTION OFFICIALS AND OFFICERS, AND PROVISIONS NECESSARY FOR CONDUCTING THE SPECIAL ELECTION IN ACCORDANCE WITH FLORIDA ELECTION LAWS. WHEREAS, the Village Council of the Village of Tequesta, Florida, adopted Resolution No. 4 -90/91 on November 8, 1990, authorizing and directing the Village Manager to cause to be called a Special Election to be held January 15, 1991, for the purpose of proposing to the registered voters of the Village of Tequesta a "straw ballot question" relating to public safety services for the Village; NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS: Section 1. Notice is hereby given that a Special Election will be held on Tuesday, January 15, 1991, at the Village Hall, 357 Tequesta Drive, Tequesta, Palm Beach County, Florida, for the purpose of conducting a "STRAW BALLOT QUESTION" relating to whether the manner of providing for public safety in the Village, by and through the Village Police Department and through contracted services with Palm Beach County for fire /rescue, be changed so as to phase in the establishment of a Public Safety Department within the Village to provide for and manage the combined services of police and fire /rescue. The polls will be open from 7:00 A.M. to 7:00 P.M., to enable registered voters of the Village to vote on this issue. Section 2. In accordance with the provisions of Section 8 -2(B) of the Village of Tequesta Code of Ordinances, the Village Clerk shall be the Clerk of Elections and shall supervise the conduct of the Special Election, in accordance with the provisions of the Florida Election Laws, specifically Chapters 100, 101 and 102 Florida Statutes, and Section 8.3 of the Village of Tequesta Code of Ordinances. The Village Clerk shall also provide for the publication of all legal notices required to be published for the Special Election in accordance with the Florida Election Laws. Section 3. In the process of conducting the Special Election, Jackie Winchester, Palm Beach County Supervisor of Elections, and Bill C. Kascavelis, Village of Tequesta Village Clerk, are appointed as members of the Village of Tequesta. Canvassing Board for this Special Election. Section 4. The following named Tequesta residents, who are qualified Palm Beach County Election Officials, are appointed as Election Officials to conduct the Village of Tequesta Special Election, under the supervision of the Village Clerk. The Election Officials shall be remunerated for their services in accordance with the current pay schedule of the Supervisor of Elections' Office for poll workers. A lunch shall also be provided all poll workers by the Village. Section 5. The Palm Beach County Supervisor of Elections is designated to tabulate the ballots cast at the Village of Tequesta Special Election. The Village Clerk is directed to transfer the ballots cast at the Special Election to the Office of the Palm Beach County Supervisor of Elections, in locked transfer cases, in the presence of a uniformed Police Officer of the Village, utilizing a marked police cruiser for the transfer. Section 6. The provisions of the Florida Elections Code relating to absentee ballots shall apply to this Special Election, and absentee balloting shall be administered by the Palm Beach County Supervisor of Elections' Office. Section 7. The Village Clerk or his appointed designee, shall provide a copy of this Resolution to the Palm Beach County Supervisor of Elections. Section 8. This Resolution shall take effect immediately l upon its passage. THE FOREGOING RESOLUTION was offered by Councilmember Ron T. 'Aackai who moved its adoption. The motion was seconded by Councilmember Earl L. Collings and upon being put to a vote, the vote was as follows: FOR ADOPTION AGAINST ADOPTION William E. Burckart Joseph N. Capretta Earl L.
