A RESOLUTION OF THE VILLAGE COUNCIL OF THE
VILLAGE OF TEQUESTA, PALM BEACH COUNTY,
FLORIDA, PROVIDING FOR THE BILLING FOR
RESIDENTIAL CURBSIDE SOLID WASTE AND RECYCLING
COLLECTION SERVICES.
WHEREAS, the Village has executed a Franchise Agreement
with Nichols Sanitation, Inc., of Jupiter, Florida, for
curbside solid waste and recycling collection services for a
five (5) year period commencing October, 1989, granting the
franchisee the exclusive rights to collect solid waste within
the municipality's service area; and
WHEREAS, the Village currently provides payment for the
contractual residential solid waste collection services from
the proceeds of Ad Valorem Property taxes; and
WHEREAS, the Village has proposed to revise the method
of paying for the residential solid waste collection and
recycling services by removing the millage required to fund
such payment from the Ad Valorem Millage Rate for Fiscal Year
90/91, and charge residential customers directly for the
service by placing the monthly solid waste and recycling
service charges on Village water bills.
NOW, THEREFORE, BE IT RESOLVED, by the Village Council
of the Village of Tequesta, Florida:
Section 1. That effective October 1, 1990, the Village
Manager or his appointed designee is hereby directed to
commence billing Village of Tequesta residential customers,
on the monthly water bills, for solid waste and recycling
curbside collection service at the rates specified in the
franchise agreement with Nichols Sanitation, Inc.
Section 2. That, the charges for the services billed
be designated separately and distinctly on the monthly water
bills rendered customers of the Village.
Section 3. That the initial billing for Residential
M Curbside solid waste and recycling collection service shall
be billed on the second billing of September 1990 - for Cycle
1, Customers for October 1990 collection service, and on the
first billing of October 1990 for Cycle 2, Customers to
provide the cash flows necessary for the payment to the
franchisee per the terms of the solid waste recycling
service Franchise Agreement.
THE FOREGOING RESOLUTION was offered by
Councilmember F-.,q T,_ Col l i naG I who moved its
adoption. The motion was seconded by
Councilmember Ron T. Mac and upon being put to
a vote, the vote was as follows:
