RESOLUTION 4 -88/89
A RESOLUTION OF THE VILLAGE OF TEQUESTA,
PALM BEACH COUNTY, FLORIDA, REQUESTING THE
PALM BEACH COUNTY BOARD OF COUNTY
COMMISSIONERS TO MAKE APPLICATION TO THE
DEPARTMENT OF NATURAL RESOURCES, DIVISION OF
STATE LANDS TO CONDUCT A FRINGE MANGROVE
TRIMMING PROGRAM IN THE AQUATIC PRESERVE
AREAS LOCATED IN PALM BEACH COUNTY, AND IN
CONJUNCTION THEREWITH, URGING THE ADOPTION
OF A RESOLUTION FORMALLY REQUESTING
AUTHORIZATION FROM THE BOARD OF TRUSTEES OF
THE INTERNAL IMPROVEMENT TRUST FUND TO
CONDUCT THE SAME.
WHEREAS, one of the many attractions of the Florida
lifestyle is the availability of waterfront property for
aesthetic and recreational benefits; and
WHEREAS, owners of residential waterfront properties have
paid premium prices to secure the recreational and aesthetic
benefits associated therewith and as such pay a commensurate
level of property taxes associated with these values; and
WHEREAS, mangroves grow naturally along the shorelines of
these various properties and without proper control can deprive
the waterfront property owner of the benefits associated with
said ownership; and
WHEREAS, in recognition of this potential problem, the
Board of Trustees of the Internal Improvement Trust Fund have
seen fit to adopt a Mangrove Trimming Policy which allows for
the same within aquatic preserve areas; and
WHEREAS, the purpose of this Policy is to provide a '.
treasonable view for the landowner and at the same time create an
incentive for the landowner to allow mangrove seedlings to
i mature and to plant new seedlings, thus encouraging the
i propagation of mangrove species; and
WHEREAS, all inland shorelines within the Village of 1
Tequesta lie within the Loxahatchee River Aquatic Preserve or
the Jensen Beach to Jupiter Inlet Aquatic Preserve; and
WHEREAS, many residents of the Village of Tequesta have
expressed a desire to be able to avail themselves of the Fringe
Mangrove Trimming Policy as authorized by the Board of Trustees
of the Internal Improvement Trust Fund.
NOW, THEREFORE, BE IT RESOLVED by the Village Council of j
the Village of Tequesta, Florida:
Section 1. The Village Council of the Village of Tequesta
hereby endorses the Fringe Mangrove Trimming Policy as i
authorized by the Board of Trustees of the Internal Improvement 1
Trust Fund.
Section 2. The Village Council of the Village of Tequesta I
strongly urges and recommends that the Board of County
Commissioners for Palm Beach County take the necessary steps to
meet the application requirements of the Division of State Lands
!including the adoption of a resolution formally requesting
authorization from the Board of Trustees of the Internal
Improvement Trust Fund to conduct a fringe mangrove trimming
program in the aquatic preserve areas of Palm Beach County in
accordance with all fringe mangrove trimming standards,
criteria, and conditions.
Section 3. The Village Clerk is hereby directed to
provide the Palm Beach County Board of County Commissioners, the
Town Council of the Town of Jupiter and the Town Commissioners
of the Town of Jupiter Inlet Colony with certified copies of
this Resolution for formal acceptance by each body. j

THE FOREGOING RESOLUTION was offered by Councilmember
Ron T. Mackail who moved its adoption. The Resolution
as seconded by Earl L. Collings and upon being put to
vote, the vote was follows:

The Mayor thereupon declared the Resolution duly passed and
adopted this 14th day of December A. D. 1989.
