My good ol' friend Hoyle Miller called. He inquired about whether or not we had permits for the following:
1. Elevator repair: Elevator floor/ceiling/walls were removed, lighting was reworked. Elevators were out of
commission for two weeks.
2. New irrigation system put in 2-3 years ago
3. Planted 68 new Plum Trees 2-3 years ago
4. Propane Tank
I told him we have no permits on any of the above. He requests this be added to Joe's report.

It has come to my attention that gas work may have been performed by Siegel Gas & Oil Corp.
at the above referenced address without a Building Permit. This work would require a Permit
from both the Building Department and the Fire Department. This came to my attention
through a proposal provided to me that was presented to the Tequesta Towers Condo.
�ssociation Board Members back on September 13, 2007. The proposal indicates that Siegel
Gas & Oil Corp. was responsible for obtaining all necessary permits. Upon a site visit we have
verified that gas work had been performed. We have no record of the proposed work ever
being permitted.
I have enclosed a copy of the proposal I am referring to for your convenience. Please contact
me to get this matter resolved.

While I was perForming a mechanical inspection in September 09 at 400 Beach Rd. I observed work going on without a
permit in the north and south lower lobby corridors. I spoke with the maintenance supervisor and Hassan Ghalam in
regards to the issue on site. I explained to them that they needed licensed building and electrical contractors to pull
permits for the work which I observed going on. They were building four bulkheads at the ceiling and wall intersects and
relocating the existing ceiling lights into the new bulkheads. These areas also have heat sensors, smoke detectors and
sprinkler heads in between the new bulk heads.
I received a permit application on September 24 09 and sent out a critique sheet on October 9 After no reply 1 resent
the critique on November 2" with notification that the matter would be turned over to code enforcement if there were
no progress in addressing my comments.

The Special Magistrate appointed by the Village Council to hear code compliance cases
for the Village of Tequesta, in accardance with Chapter 162, Florida Statutes, has heard
testimony at the Code Compliance Special Magistrate Hearing held on the 9th day of December,
2010 and based on the evidence and testimony presented, entered an Order Assessing Fine. The
following Findings of Fact, Conclusions of Law and Order are hereby entered:
FINDINGS OF FACT
1. The Respondent Tequesta Towers Condorninium Association, Inc. is the owner of
the common elements in Tequesta. Towers Condominium Apartments located at
the above-mentioned address.
2. The Respondent was represented by Hassan Ghalam, the property manager for
Tequesta Towers Condominium Aparirnents, at the hearing. There was a finding
that proper notice was given to the property owner of the violation and of the
hearing.
3. By the "Order Finding Violation" dated June 24, 2010, the Special Magistrate
ordered the Respondent to comply with Section 14-152 of the Code of Ordinances
of the Village of Tequesta on or before July 21, 2010, or be subject to a fine.
4. Based upon the evidence and testimony presented at the hearing on December 9,
2010, the Special Magistrate found that the property was not brought into
compliance with Section 14-152 of the Code of Ordinances of the Village of
Tequesta. on or before July 21, 2010. The property was brought into compliance
on September 27, 2010.

CONCLUSIONS OF LAW
The above-stated facts constitute a violation of Section 14-152 of the Code of Ordinances
. of the Village of Tequesta.
ORDER
, It is the Order of the Special Magistrate that a Fine of Three Thousand Three Hundred
and Fifty Dollars ($3,350.00) is hereby assessed, at Fifty Dollars ($50.00) per day, for the
violations which existed on the property beginning from July 22, 2010 through September 27,
' 2010, a period of sixty-seven (67) days.
The Respondent also is assessed $714.70 for administrative costs incurred by the Village
prior to December 9, 2010.
Should you violate the same Section of the Code again, you may be subject to a fine of
up to five hundred dollars ($500.00) per day for such repeat violation. Additionally, the Code
Inspector is not required to give a reasonable time to correct the repeat violation and the case
may be presented to the Special Magistrate even if the repeat violation has been corrected prior
to the Special Magistrate hearing.
Should a dispute arise concerning compliance, either party may request a hearing before
the Code Enforcement Special Magistrate on the issue of compliance only.
Upon complying in any code compliance matter, it is always the responsibility of the
Respondents to contact the Code Compliance Division at (561) 768-0506 to request a
reinspection of the property.
A certified copy of this Order may be recorded in the Public Records of Palm Beach
County, Florida, and, once recorded, shall constitute a lien against the property upon which the
violation exits and upon any other real or personal property owned by the Respondent, pursuant
to Chapter 162, Florida Statutes.

The Special Magistrate appointed by the Village Council to hear code compliance cases
for the Village of Tequesta, in accordance with Chapter 162, Florida Statutes, has heard
testimony at the Code Compliance Hearing held on the 22 day of July, 2010, and based on the
evidence and testunony presented, entered an Order Granting Continuance. The following
Findings of Fact and Order are hereby entered:
FINDINGS OF FACT
1. The Respondent, Astrol Hospitality Inc., was not present at the hearing; however
there was a fmding of proper notice.
2. The Respondent has obtained the necessary permits, but requires additional time to
complete the work. As such, the parties have agreed to continue this matter to the August 26,
2010 agenda.

It is the Order of the Code Compliance Special Magistrate that this matter is continued to
the August 26, 2010 agenda, to be heard at 10:00 am at the Village Hall Council Chambers, 345

To follow up on our previous conversation. The building Department has not issued a permit for the two 25'x6' sections
of drop ceiling at 400 Beach Rd. The work was being done without a permit back in September. I was doing another
inspection @ 400 Beach Rd. and saw the work going on. I spoke with Hassan and told him to stop work and get licensed
contractors to pull permits. Hassan got a permit from the Fire Dept. on 9-24-09. I reviewed his plans on 10-9-09 and
sent him a critique sheet on the same date. I later sent him the same critique sheet on 11-18-09 with a added note.
I will follow up with a call.
