HomeMy WebLinkAboutResolution_04-87/88_01/12/1988 RESOLUTION NO. 4 -87/88 • A RESOLUTION OF THE VILLAGE OF TEQUESTA, FLORIDA, RESCINDING VILLAGE OF TEQUESTA RESOLUTION NO. 16 -86/87 AND REQUESTING THE BOARD OF COUNTY COMMISSIONERS OF PALM BEACH COUNTY, FLORIDA, TO RESCIND PALM BEACH COUNTY RESOLUTION NO. R -87 -1493. WHEREAS, the Village of Tequesta Village Council adopted Resolution No. 16 -86/87 on September 22, 1987; and WHEREAS, the Board of County Commissioners of Palm Beach County, Florida, adopted Resolution No. R -87 -1493 on September 22, 1987 and WHEREAS, the State of Florida is currently conducting a functional classification to determine the appropriate jurisdiction for various classes of roadways within Palm Beach County as mandated by Section 335.04 of the Florida Statutes; and WHEREAS, the Village of Tequesta is desirous of continuing to have jurisdiction and maintenance responsibilty for Tequesta Drive, including Tequesta Drive Bridge, from U.S. 1 to Country Club Drive and of Country Club Drive from Tequesta Drive to the north County Line; and WHEREAS, it is the desire of the Village of Tequesta to continue to cooperate with Palm Beach County in providing the roadway transportation system to serve the residents of the Village of Tequesta; and WHEREAS, a companion resolution is being presented to the Board of County Commissioners of Palm Beach County, Florida, on January 12, 1988, expressing the Board's concurrence in having Tequesta continue to have jurisdiction and maintenance responsibility for the aforementioned municipal facilities. NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, THAT: Section 1. The above citations are true and correct and are hereby confirmed. Section 2. The Village Council of the Village of Tequesta hereby rescinds Resolution No. 16 -86/87 thereby continuing Village of Tequesta maintenance and jurisdictional responsibility for Tequesta Drive, including Tequesta Drive Bridge and Country Club Drive as municipal collector roads under the functional classification currently being conducted by the State of Florida. Section 3. All previous reference to transfer of jurisdiction of the aforementioned roadways and infrastructure to Palm Beach County is null and void without effect. Section 4. The Board of County Commissioners of Palm Beach County, Florida are requested to rescind Resolution No. R -87 -1493 advising the Village of Tequesta and the Florida Department of Transportation of their action in this regard. Section 5. The Village Clerk is hereby directed to provide the Board of County Commissioners and the Florida Department of Transportation with certified copies of this resolution.
