HomeMy WebLinkAboutResolution_16-85/86_08/12/1986 i IF; • • RESOLUTION NO. 16 -85/86 A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, OPPOSING THE PROPOSED AMENDMENT TO THE PALM BEACH COUNTY CHARTER CREATING A COUNTYWIDE PLANNING COUNCIL; REQUESTING OTHER MUNICIPALITIES IN PALM BEACH COUNTY, FLORIDA, TO ADOPT SIMILAR RESOLUTIONS; AUTHORIZING THE VILLAGE CLERK TO FURNISH COPIES OF THIS RESOLUTION TO THE BOARD OF COUNTY COMMISSIONERS OF PALM BEACH COUNTY, TO THE PALM BEACH COUNTY MUNICIPAL LEAGUE, AND TO ALL OTHER MUNICIPALITIES IN PALM BEACH COUNTY; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Palm Beach County has proposed an amendment to its Charter which would create a Countywide Planning Council for land use planning; and WHEREAS, under the current proposal, the Countywide Planning Council has the power and authority to make changes in the municipalities' Comprehensive Land Use Plans mandated by Chapter 163, et seq., Florida Statutes; and WHEREAS, although the municipalities recognize the need for consistency in land use planning throughout the County, they strongly oppose a County Charter amendment which would deprive them of certain of their Home Rule Powers granted to them by the State of Florida Constitution and applicable State statutes. NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, as follows: Section 1 . The Village Council of the Village of Tequesta, Florida hereby declares its opposition to the current proposed amendment to the Palm Beach County Charter which would j create a Countywide Planning Council in that said amendment, in effect, creates a "super agency" with final and absolute control over municipal Comprehensive Land Use Plans, thus depriving municipalities of certain of their Home Rule Powers and of their ability to implement land use plans suited to individual j needs of the particular municipality. i Section 2 . The Village Council of the Village of Tequesta, Florida hereby requests and urges all other municipalities of Palm Beach County to adopt similar resolutions to oppose the County Charter amendment in its present form and request revision of said proposed amendment. Section 3 . The Village Clerk of the Village of Tequesta, Florida is hereby authorized and directed to furnish copies of this Resolution to the Board of County Commissioners of Palm Beach County, to the Palm Beach County Municipal League, and to all other municipalities in Palm Beach County. Section 4 . This Resolution shall take effect upon adoption by the Village Council. THE FOREGOING RESOLUTION was offered by Councilmember Ron Mackail , who moved its adoption, the motion was seconded by Councilmember Edward C. Howell , and upon being put to a vote, the vote was as follows: FOR ADOPTION AGAINST ADOPTION Edward C. Howell Jill K. Gemino Ron Mackail Carlton D.
