Subject: Modification of Section 78-295, concerning outside
I.P. Fuel sales.
Attached is Ordinance 2-11, that modifies Sec. 78-284. Walls and
fences. The intent of this code change is to clarify the
language to reflect the objective of the Village Council
relative to placement of fence and walls in association of
structures and by requiring entry features to provide adequate
width for emergency vehicles.
I'm also requesting modification to Section 78-295 (1) of the
Village of Tequesta Code of Ordinances to allow for outside L.P.
Fuel Sales.
Section 78-295, (1) states "Enclosure of uses. All commercial
uses shall be operated entirely within enclosed buildings except
for the following uses: off-street loading, automobile parking,
and the fuel sales and dispensing facilities of full-service
fuel stations or gas stations, sidewalk cafes, and drive-in,
drive-through, or walk-up service window facilities, i.e.,
laundry, dry cleaning, and banking facilities."
Strict interpretation of this code does not allow the exterior
display of portable L.P. gas cylinders for sale or exchange.
