HomeMy WebLinkAboutOrdinance_623_01/10/2008ORDINANCE NO. 623 AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AMENDING CHAPTER 78, ZONING, ARTICLE I, IN GENERAL, SECTION 78-4, DEFINITIONS, IN ORDER TO CORRECT A SCRIVENER'S ERROR IN THE DEFINITION OF YARD; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL OF ORDINANCES IN CONFLICT; PROVIDING FOR CODIFICATION; PROVIDING AN EFFECTIVE DATE. WHEREAS, the Village Council of the Village of Tequesta desires to correct a scrivener's error discovered within the definition of "yard" in Section 78-4 of the Village Code of Ordinances; NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS: Section 1. The Village Code of Ordinances is hereby amended at Chapter 78, Zoning, Article I, In General, Section 78-4, Definitions to read as follows: "ARTICLE I. IN GENERAL Sec. 78-4. Definitions. Yard means the unoccupied and unobstructed open spaces on the same lot with the main building which extend from the ground upward. (1) Front yard means the open space extending the full width of the lot, the depth of which is the minimum horizontal distance between the front lot line and the nearest line of the main building. (2) Rear yard means the open space extending the full width of the lot, the depth of which is the minimum horizontal distance between the rear lot line and the nearest line of the main building. (3) Side yard means the open space between the main building and the side lot 1 line, extending from the front yard to the rear yard, the width of which is the horizontal distance from the nearest point of the side lot line to the nearest point of the main building." Section 2. Severability. If any court of competent jurisdiction holds any word, part, section, paragraph or provision hereof to be unlawful or unconstitutional, such ruling or finding shall not affect the remaining portions of this Ordinance, which shall remain in full force and effect. Section 3. Repeal of Ordinances in Conflict. All ordinances or parts of ordinances in conflict herewith are hereby repealed. Section 4. Codification. This Ordinance shall be codified and made a part of the official Code of Ordinances of the Village of Tequesta. Section 5. Effective Date. This Ordinance shall become effective immediately upon passage. Upon First Reading this 13th day of December 2007, the foregoing Ordinance was offered by Council Member Paterno who moved its adoption. The motion was seconded by Vice-Mayor Watkins and upon being put to a vote, the vote was as follows: For Adoption Mayor Jim Humpage X Vice-Mayor Pat Watkins X Council Member Dan Amero X Council Member Tom Paterno X Council Member Calvin Turnquest X Against Adoption 2 Upon Second Reading this 10th day of January 2008, the foregoing Ordinance was offered by Council Member Amero who moved its adoption. The motion was seconded by Council Member Paterno and upon being put to a vote, the vote was as follows: For Adoption Against Adoption Mayor Jim Humpage X Vice-Mayor Pat Watkins X Council Member Dan Amero X Council Member Tom Paterno X Council Member Calvin Turnquest ABSENT The Mayor thereupon declared the Ordinance duly passed and adopted this 10th day of January, 2008.
