HomeMy WebLinkAboutResolution_10-83/84_08/15/1984 RESOLUTION NO. 10 -8 3/84 A RESOLUTION OF THE VILLAGE OF TEQUESTA, FLORIDA, DIRECTED TO THE PALM BEACH COUNTY LEGISLATIVE DELEGATION AND TO THE BOARD OF COUNTY COMMISSIONERS OF PALM BEACH COUNTY EXPRESSING OPPOSITION TO THE METHOD OF FUNDING FOR FIRE PROTECTION, FIRE RESCUE AND ADVANCED LIFE SUPPORT SERVICES BY THE NEWLY CREATED MUNICIPAL SERVICE TAXING UNITS; OBJECTING TO THE TRANSFER OF THE MILLAGE LEVY FROM THE PALM BEACH COUNTY TAX ASSESSMENT ROLL; TO THE VILLAGE OF TEQUESTA'S TAX ASSESSMENT ROLL; AND REQUESTING A RETURN TO THE ORIGINAL FUNDING PROCEDURE WHICH WAS IN EFFECT PRIOR TO THE CONSOLIDATION OF THE FIRE CONTROL DISTRICTS. WHEREAS, the Palm Beach County Legislative Delegation has heretofore sponsored Laws of Florida Chapter 83 -495, providing for the creation of municipal service taxing units to provide fire protection and rescue service in Palm Beach County, which was adopted by the Legis- lature and filed in the Office of the Secretary of State on July 1, 1983; and, WHEREAS, the Board of County Commissioners of Palm Beach County pursuant thereto enacted County Ordinance No. 83 -23 on December 20, 198 thereby creating said municipal service taxing units to provide such services; and, WHEREAS, the new system of organization, by supplanting the former Fire Control Districts, has caused a change in the method of funding the budget for said services which adversely impacts the budgetary system of the several municipalities receiving said fire protection services including the Village of Tequesta; and, WHEREA, under the new system the mileage levy to fund fire protection and rescue service provided by the municipal service taxing units has been transfered to and must be included in the municipality's total millage rate, thereby reducing the available millage under the 10 mill municipal tax cap and also creating the public's misconception of a municipal tax increase. NOW, THEREFORE, be it resolved by the Village Council of the Village of Tequesta, Florida: SECTION 1 . The Village of Tequesta hereby expresses its opposition to the method of funding for fire protection, fire rescue and advanced life support services rendered by the newly created municipal service taxing units within the municipal limits of the Village of Tequesta. S 2. The Village of Tequesta hereby objects to the transfer of the millage levy from the Palm Beach County Tax Assessment Roll to the Village of Tequesta's Tax Assessment Roll which is now required to fund the budget for fire protection and rescue service rendered by the said service taxing units. SE CTION 3. The Village of Tequesta hereby requests the Palm Beach County Legislative Delegation and the Board of County Commissioners of Palm Beach County to restudy the problems and methods involved to obtain a fair and equitable budgetary financing, system for said services and to return to the original funding procedure which was in effect prior to the consoli- dation of the Fire Control Districts. SECTION 4. The Village Manager is hereby directed to meet and confer with the representatives of the Palm Beach County Legislative Delegation and the representatives of the Board of County Commissioners of Palm Beach County, and the representatives of the Palm Beach County Municipal League and the member municipalities similarly affected and to do all further things which may be necessary to carry out the purposes and intent of this Resolution. SEC 5 . The Village Clerk is hereby directed to serve a certified copy of this RESOLUTION to each of the aforesaid organizations and governmental agencies and to all interested parties affected thereby. SECTION 6 . This RESOLUTION shall take effect immediately upon adoption. THE FOREGOING RESOLUTION was offered by Councilmember Lee M. Brown , who moved its adoption. The Resolution was seconded by Councilmember Arthur Mu rphy and upon being put to a vote, the vote was as follows: 2 - FOR ADOPTION AGAINST ADOPTION Lee M. Brown Arthur Murphy Carlton D.
