HomeMy WebLinkAboutResolution_03-83/84_12/13/1983 RESOLUTION NO. 3_83/84 A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, ENACTED PURSUANT TO THE PROVISIONS OF CHAPTER 10 OF THE CODE OF ORDINANCES OF THE VILLAGE, FINDING AND DETERMINING THAT CERTAIN PROPERTY DESCRIBED HEREIN IS IN VIOLATION OF THE REQUIREMENTS OF SAID ORDINANCE: SETTING FORTH THE ESTIMATED COST OF CLEARING SUCH PROPERTY AND REMOVING OR REMEDYING THE CONDITION IN VIOLATION! OF SAID ORDINANCE; DIRECTING THE VILLAGE MANAGER TO SERVE NOTICE UPON THE OWNER OF SAID PROPERTY TO COMPLY WITH THE REQUIREMENTS OF SAID ORDINANCE. WHEREAS, Chapter 10 of the Code of Ordinances of the Village of Tequesta prohibits and declares to be a public nuisance the excessive accumulations of growth of weeds, undergrowth or other dead or living plant life on properties within the Village of Tequesta to the extent and in such manner that the lot, tract, or parcel of land becomes or may reasonably become infested with rodents, vermin, wild animals, or may become a breeding place for such or in a manner which threatens the public health, safety and welfare or which may reasonably cause disease or adversely affect and impair the economic welfare of adjacent property; and WHEREAS, the Village Council has determined that excessive accumulations of weeds, undergrowth, and dead or living plant life have accumulated on the property described in Exhibit "A" attached hereto so as to threaten the public health, safety and impair the economic welfare of adjacent property; and 1 EREAS, the Village Council has determined that said violations are a public nuisance and shall be corrected and that the estimated cost of correcting the violation is in the amount indicated on the Exhibit attached hereto; NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA: S ection 1. The Village Council of the Village of Tequesta hereby declares that a public nuisance exists on the property described in Exhibit "A" attached hereto as a result of the excessive accumulation of untended growth of weeds, undergrowth or other dead or living plant life and that such property within the Village is in such condition as to be in violation of the requirements set forth in Chapter 10 of the Code of Ordinances of the Village. Section 2 . The Village Counc ?l hereby requires that the property owner listed in Exhibit "A" attached hereto correct the condition specified in Section 1 hereof on the property described in said Exhibit, which Exhibit also sets forth the estimated cost of clearing such land or removing or remedying the condition creating the public nuisance. Section 3 . The Village Manager is hereby directed to serve notice upon the owner of the property described in this Resolution in accordance with the terms of Chapter 10 of the Code of Ordinances of the Village and to require that the violation noted herein be corrected within fifteen days after the serving of such notice. Section 4 . Upon failure of the owner of such lot, parcel or tract of land to remedy the condition found to be in violation of the requirements of Chapter 10 of the Code of Ordinances of the Village within fifteen days after being given notice of same, then the Village Manager is hereby directed to have the condition remedied, the cost thereof being chargeable to the owner of the property, but not to exceed the amount of cost estimated for such work as set forth in this Resolution. TH FOREGOING RESOLUTION was offered by Councilmember Thomas J. Little , who moved its adoption. The motion was seconded by Councilmember Thomas J. Beddow and upon being put to a vote, the vote was as follows: FOR ADOPTIO AGAINST ADOPTION Thomas J. Beddow Lee M. Brown Thomas J. Little Carlton D. Stoddard William E.
