HomeMy WebLinkAboutResolution_10-81/82_01/12/1982 RESOLUTION NO. 10 -81/82 A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, AMENDING RESOLUTION NO. 5 -81/82 RELATING TO THE PROMULGATION AND ADOPTION OF RULES FOR THE GRANTING OR DENIAL OF SPECIAL PERMITS FOR THE OPERATION OF TRUCKS ON TEQUESTA DRIVE AND COUNTRY CLUB DRIVE WITHIN THE VILLAGE. WHEREAS, on October 27, 1981, the Village Council of the Village of Tequesta, Florida, adopted Resolution No. 5 -81/82 which resolution promulgated and adopted certain rules relating to the granting or denial of special permits for the operation of trucks on Tequesta Drive and Country Club Drive within the Village; and WHEREAS, it has been made apparent to the Village Council that said Resolution is in need of amendment in certain respects for the benefit of the public welfare and the residents of the Village of Tequesta, Florida; NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, as follows: Section 1 . Section 2 of Resolution No. 5 -81/82 is amended at Subparagraph C thereof_ to read as follows: "C. Trucks engaged in delivering goods or services to destination points within the Village of Tequesta may be permitted to make concurrent deliveries of goods or services to destination points outside the corporate limits of the Village which deliveries are part of the same trip. Such trucks engaged in making concurrent deliveries to the area known as Turtle Creek shall not be subject to the provisions of Subparagraph B in this Section. Section 2 . Section 2 of Resolution No. 5 -81/82 is hereby amended at Subparagraph D thereof to read as follows: "D. The permit shall be valid only between the hours of 7 :00 a.m. and 6:00 p.m. on weekdays and between the hours of 8:00 a.m. to 12 :00 noon on Saturdays and Sundays." Section 3 . Section 3 of Resolution No. 5 -81/82 is amended at Subparagraph A thereof to read as follows: "A. The permit shall be carried in the vehicle or vehicles to which it refers and shall be open to inspection by any police officer or authorized agent of the Village of Tequesta. Section 4 . All other provisions set forth in Resolu- tion No. 5 -81/82 shall remain intact. Section 5 . In the event that any section, subsection, clause, sentence or provision of this Resolution is held invalid, the remainder of this Resolution and Ordinance to which it pertain shall not be affected by such invalidity. THE FOREGOING RESOLUTION was offered by Councilmember Thomas J. Little , who moved its adoption. The Resolution was seconded by Councilmember Carlton D. Stoddard and upon being put to a vote, the vote was as follows: FOR ADOPTION AGAINST ADOPTION Lee M. Brown Leslie A. Cook Thomas J. Little W.H. Mapes, Jr. Carlton D.
