HomeMy WebLinkAboutResolution_11-77/78_06/13/1978 r RESOLUTION NO. 2a.77/78 A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, AUTHORIZING AND DIRECTING THE MAYOR AND VILLAGE CLERK TO SIGN AN INTER -LOCAL AGREEMENT FOR POLICE MUTUAL AID BETWEEN THE VILLAGE OF TEQUESTA, TOWN OF JUPITER AND JUPITER INLET COLONY, PALM BEACH COUNTY, FLORIDA WHEREAS, it is the opinion of the Village Council of the Village of Tequesta that they are desirous of entering into an agreement providing for extending mutual police aid and protection in time of emergency between the Village of Tequesta, Town of Jupiter and Jupiter Inlet Colony; and WHEREAS, the Village Council of the Village of Tequesta is desirous of obtaining this protection without any undue increase in cost and expense to any of the parties and without unnecessarily increasing the possibility of loss of life and property or subjecting the parties to an increased expense or liability; NOW THEREFORE BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA: Section 1 . That the Mayor and Village Clerk be and they are hereby authorized and directed to sign and seal an Inter -Local Agreement for Mutual Police Aid, a copy of which is attached hereto and made a part hereof, said agreement providing for extending mutual police aid and protection in time of emergency between the Village of Tequesta, Town of Jupiter and Jupiter Inlet Colony. Section 2 . That the Village Clerk is hereby authorized and directed to furnish a certified copy of this Resolution to the Town of Jupiter and Jupiter Inlet Colony. THE FOREGOING RESOLUTION was offered by Councilmember MAPES , who moved its adoption. The Resolution was seconded by Councilmember YODER and upon being put to a vote, the vote was as follows: FOR ADOPTION AGAINST ADOPTION MALPE.S YODER BROWN GOOK The Mayor thereupon declared this Resolution duly passed and adopted this 13th day of June A.D., 1978. Brown ATTEST: Ass'" taut Village Clerk INTER -LOCAL AGREEMENT MUTAL POLICE AID This Agreement, made and entered into this day of 1978, by and between the Village of Tequesta, Town of Jupiter and Jupiter Inlet Colony, each municipal corporations of, the State of Florida, jointly and severally, WITNESSETH: WHEREAS, it' is the concurring opinion of the Village Council of the Village of Tequesta; the Town Commission of the Town of Jupiter .and the Commission of Jupiter Inlet Colony that they are desirous of extending mutual police aid and protection to each other in time of emergency need so long as the same shall not jeopardize the interests of each governmental unit; and WHEREAS, the parties to this Agreement are desirous of obtaining this protection without any undue increase in cost and expense to any of the parties and without unnecessarily increasing the possibil- ity of loss of life and property, or subjecting the parties to an increased expense or liability; M4, THEREFORE, the parties 'to this Agreement, for :and in consideration of the mutual covenants and promises hereinafter set forth, do hereby agree as follows: 1. That each of the parties hereto.shall render emergency police assistance to any point within the territorial limits. of the municipalities of the parties .,hereto. 2. That each of the parties hereto shall provide compen- sation For their own employees and - there shall be no charges from one party to another for assistance. 3. Each of the par shall arrange their liability and workmen's compensation insurance coverage so that their personnel and equipment will be covered although acting beyond the territorial limits of their respective municipalities. 4. The police equipment and personnel shall be dispatched to a police emergency as follows: a) In the event of any police emergency within the municipality of any of the parties hereto, the municipal Police Chief or police officer in charge at the time of the emergency shall decide whether it will be.helpful to obtain the assistance of the police of the other parties hereto. If so, he shall telephone or radio the Police Department of the other municipality (s) and request equipment and then. The direction and control of all police facilities at all police emergencies within the municipalities of the parties hereto shall be under the supervision of the Police Chief or other police officer in charge of the municipality requesting assistance at the time of the emergency. If police of either of the municipalities other than the one requesting assistance arrive at the scene of the emergency prior to the arrival of the police of the municipality requesting assistance, the ranking officer of the assisting Police Department(s) shall have control until the arrival on the scene of the policemen and equipment of the municipality requesting the assistance. Upon receiving the above request for police emergency assistance, the Police Chief or the person in charge of the municipality receiving the request for police emergency assistance shall have full discretion to decide whether granting the request for assistance will jeopardize the police protection of the municipality, and, if in his opinion it will, the request shall be denied. b) In the event that the first notice of a police emergency within the municipality of any of the parties hereto is received by other than the municipality in which the emergency occurs, the municipality receiving the notice of the police emergency shall immediately notify the Police Department of the affected municipality of the police emergency, and if it is deemed expedient, may dispatch its men and equipment to the emergency without being requested by the municipality in which the emergency occurs, and notice of the dispatching of policemen and equipment shall be given to the Police Department of the municipality receiving the police emergency assistance as soon as possible. 5. This Agreement shall not give rise to any liability or responsibility for failure to respond to any request for assistance made under the terms of this Agreement. 6. It is hereby expressly understood that any emergency equipment furnished by any of the parties hereto shall be operated exclusively by the personnel of the municipality providing such equipment, but under the direction of the police officer in charge of the municipality receiving the assistance. 7. None of the parties to this Agreement shall withdraw from same without first giving thirty (30) days prior written.notice to each of the other parties. 8. Amendments or modifications to this Agreement can only be made upon the written concurrence of each of the parties hereto. 9. The parties to this Agreement agree to indemnify and hold harmless each other Jointly and severally from all suits, any causes of actions or claims brought because of any injuries or damages whether to persons or property arising out this Agreement. .10. This Agreement shall not take effect until executed by all of the parties hereto. l IN FITNESS WHEREOF, the parties to this Agreement have caused their names to be affixed hereto by the proper officers thereof.
