HomeMy WebLinkAboutResolution_19-76/77_09/27/1977 5 J RESOLUTION NO. 19 -76/77 A RESOLUTION OF THE VILLAGE OF TEQUESTA, FLORIDA TO THE FLORIDA STATE 1977 --78 CONSTITUTION REVISION COMMISSION RESPECTFULLY REQUESTING A PROPOSED REVISION TO FLORIDA STATE CONSTITUTION ARTICLE VIII, SECTION 1. (h). WHEREAS, Florida State Constitution Article VIII, Section 1. It (h) needs clarification in order to provide equity; and WHEREAS, the Florida State Legislature expressed its intent in its REVENUE SHAPING ACT OF 1972 (129.01FS) providing for a division of county budgets between incorporated and incorporated county areas, and again in 1975 in SB749 (125.01FS) which eliminated a referendum for ad valorem taxes for county municipal service taxing units; NOW THEREFORE BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA: Section 1 . That the Village of Tequesta respectfully requests the Florida State 1977 -78 Constitution Revision Commission to propose a revision to the Florida State Constitution Article VIII, Section 1. (h) as follows: (h) TAXES; LIMITATION. Property situate within municipalities shall not be subject to taxation for services rendered by the county exelttslvely for the benefit of the property or residents in unincorporated areas where such services are only of incidental benefit to property and residents within the municipalities Section 2. That the Village Clerk of the Village of Tequesta is hereby authorized to deliver copies of this RESOLUTION to all of the Members, Alternates and the Executive Director of the Florida State 1977 -78 Constitution Revision Commission. THE FOREGOING RESOLUTION was offered by Councilmember Harvey Mapes , who moved its adoption. The Resolution was seconded by Councilmember Stephen Huggin and upon being put to a vote, the vote was as follows: FOR ADOPTION AGAINST ADOPTION Howard Brown Stephen Huggins James Ryan Harvey Mapes • The Mayor thereupon declared the Resolution duly passed and adopted this 27 day of September A.D. , 1977.
