HomeMy WebLinkAboutResolution_15-76/77_08/09/1977 w RESOLUTION NO. 15 -76/77 A RESOLUTION OF THE VILLAGE OF TEQUESTA REQUESTING THAT THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF PALM BEACH ADOPT A BUDGET FOR THE PALM BEACH SHERIFF'S DEPARTMENT WHICH DOES NOT SPREAD THE COST OF THE SHERIFF'S ROAD PATROL TO PROPERTIES LYING WITHIN PALM BEACH COUNTY MUNICIPALITIES MAINTAINING THEIR OWN POLICE DEPARTMENTS WHEREAS, the proposed budget for the Palm Beach County Sheriff's Department for the fiscal year 1977/78 includes Three Million Three Hundred and Fifty -six Thousand Five Hundred and Twenty -four Dollars ($3,356,524.00) for the Sheriff's Road Patrol; and WHEREAS, the Sheriff's Road Patrol provides police protection and police patrols for the unincorporated areas of Palm Beach County and certain municipalities within Palm Beach County which do not maintain their own police departments; and WHEREAS, for fiscal years commencing with the 1974/75 fiscal year and thereafter the cost of the Sheriff's Road Patrol has not been charged to any property lying within a Palm Beach County municipality maintaining its own police department; and WHEREAS, Florida Constitution, Article VIII, Section 1, (H), provides that no property situated within a municipality shall be subject to taxation for services rendered by the County exclusively for the benefit of property or residents in the unincorporated areas; 10 and WHEREAS, it is the opinion of the Village Council of the Village of Tequesta that the Palm Beach County Sheriff's Road Patrol is exclusively for the benefit of the property and residents in the unincorporated areas; and WHEREAS, the budget for the Palm Beach County Sheriff's Department for the fiscal year 1977/78 must be adopted by the Board of County Commissioners of the County of Palm Beach; NOW THEREFORE BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA: Section 1 . That the Board of County Commissioners of Palm Beach County is hereby requested to adopt a budget for the Palm Beach County Sheriff's Department which budget will not subject property lying within Palm Beach County municipalities maintaining police departments to a levy for ad valorem taxes to pay for or to support the Palm Beach County Sheriff's Road Patrol. Section 2 . That the Village Clerk is hereby authorized to mail a certified copy of this Resolution to the Board of County Commissioners of Palm Beach County. THE FOREGOING RESOLUTION was offered by Councilmember Joseph D. Yoder , who moved its adoption. The Resolution was seconded by Councilmember W Harvey Mapes and upon being put to a vote, the vote was as follows: FOR ADOPTION AGAINST ADOPTION Howard F. Brown Stephen Huggins W.
