RESOLUTION NO. 7- 76,/77
A RESOLUTION OF THE VILLAGE COUNCIL OF THE
VILLAGE OF TEQUESTA DECLARING ACQUISITION OF
UTILITY EASEMENTS FOR WATER TRANSMISSION AND
DISTRIBUTION FACILITIES TO PROVIDE A SOURCE
OF POTABLE WATER TO THE VILLAGE OF TEQUESTA
AND SURROUNDING ENVIRONS TO BE A PUBLIC
NECESSITY; AUTHORIZING THE EMPLOYMENT OF
REAL ESTATE APPRAISERS AND AUTHORIZING THE
FILING OF EMINENT DOMAIN PROCEEDINGS.
WHEREAS, the Village of Tequesta consulting engineers
have recommended the acquisition of right -of -way for water trans-
mission and distribution facilities in order to install a water
pipe -line in Palm Beach County, Florida, and
WHEREAS, funds are available for the acquisition of
• the needed right -of -way from the validation and sale of water
revenue certificates; and
WHEREAS, the specific right -of -way needed for said
public improvement of water transmission and distribution facilities
is described in Exhibit A attached hereto and made a part hereof; an
WHEREAS, this Council finds that the construction and
improvement of water transmission and distribution facilities to
provide a source of potable water as depicted on the construction
plans previously made known to this Council in public meeting and
the acquisition of the specific right -of -way described in Exhibit A
in the form of utility easements to be a public necessity and the
same are necessary and essential to the best interest of the Village
of Tequesta and those other municipalities and unincorporated areas
which receive water service from the Village of Tequesta; and
WHEREAS, in order to accomplish the acquisition of the
needed right -of -way, it is necessary for the Village engineers and
the Village attorney to take legal action and employreal estate
appraisers;
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL
OF THE VILLAGE OF TEQUESTA:
Section 1 . This Council adopts and ratifies those matters
set forth in the foregoing recitals.

• Section 2 . The Village Attorney in conjunction with
the Village engineer is authorized and directed to employ real
estate appraisers for the purpose of securing an appraisal of the
value of the property described in Exhibit A for the purpose of
acquiring the necessary easements.
Section 3 . The Village Attorney is authorized and
directed to proceed to take the necessary steps for the Village of
Tequesta to acquire in its own name by donation, purchase or
eminent domain proceedings the right -of -way described in Exhibit
A in the form of utility easements and to have prepared inthe name
of the Village of Tequesta all papers, pleadings and other instru-
ments required for that purpose and to see that all eminent domain
proceedings are prosecuted to judgment.
. Section 4 . The Village Attorney is hereby authorized
and directed to take such further action as is reasonably required
to fully accomplish the purpose hereinabove directed.
THE FOREGOING RESOLUTION was offered by Council Member
Joseph D. Yoder , who moved its adoption. The
Resolution was seconded by Council Member Howard Brown
and upon being put to a vote, the vote was as follows:

• A utility easement for water transmission and distribution facili-
ties ten feet in width lying in the Southwest quarter of Section 30,
Township 40 South, Range 43 East, Palm Beach County, Florida, more
particularly described as follows:
Begiruiing at the intersection of the South line of said
Section 30 with the Easterly right-of-way line of Old
Dixie Highway, run Easterly along said Section line
a distance of 177.72 feet, thence Northerly at right
angles to said Section line a distance of 1.0 feet,
thence Westerly and parallel to said Section line to
the Easterly right -of -way line of Old Dixie Highway;
thence Southeasterly along the Easterly right -of -way
of Old Dixie Highway to the Point of Beginning.
