RESOLUTION DECLARING ACQUISITION OF LAND AND
TEMPORARY CONSTRUCTION EASEMENTS FOR IMPROVE-
MENT OF BEACON STREET WITHIN THE CITY LIMITS
OF THE VILLAGE OF TEQUESTA, FLORIDA, TO BE A
PUBLIC NECESSITY; AUTHORIZING THE EMPLOYMENT
OF APPRAISER; AND AUTHORIZING THE FILING OF
EMINENT DOMAIN PROCEEDINGS.
WHEREAS, the Village engineer has recommended the acquisition
of right -of -way needed for the improvement of Beacon Street within the Village
limits of the Village of Tequesta, Florida in the form of temporary construction
easements; and
WHEREAS, funds are available for the acquisition of this
right -of -way; and
WHEREAS, the specific right -of -way needed and required for
the public improvement of Beacon Street is described on Exhibit A attached
hereto and made a part hereof; and
WHEREAS, this council finds that the construction and im-
provement of Beacon Street and the corporate limits of the Village of Tequesta,
the specific details of which construction have previously been made known to
this council in public meeting, and the acquisition of the specific property
described in Exhibit A attached hereto to be a public necessity and the same
are necessary and essential to the best interest of the Village of Tequesta;
and
WHEREAS, in order to accomplish the acquisition of this needed
right -of -way described in Exhibit A, it is necessary for the Village engineer
and the Village attorney to take legal action and to employ real estate ap-
praisers;
• NOW, THEREFORE, be it resolved by the council of the Village
of Tequesta, Florida;
Section 1 . This council adopts and ratifies those matters
set forth in the foregoing recitals.
Section 2 . The Village attorney is authorized and directed
to employ expert real estate appraisers for the purpose of securing appraisals
of the value of the property described in Exhibit A attached hereto and made
a part hereof for the purpose of acquiring said needed right -of -way.
Section 3 . The Village attorney is hereby authorized and
directed to proceed to take the necessary steps for the Village of Tequesta
to acquire its own name by donation, purchase, or Eminent Domain proceedings,
the right -of -way described in Exhibit A, attached hereto and made a part hereof,
and have prepared in the name of the Village of Tequesta all papers, pleadings
and other instruments required for that purpose, and to see that all Eminent
Domain proceedings are prosecuted a judgment.
Section 4 . The Village engineer and the Village attorney are
hereby authorized and directed to take such further action that is reasonably
required to fully accomplish the purposes hereinabove directed.
BE IT FURTHER RESOLVED that the property described in Exhibit
A attached hereto is to be used for the purpose of requiring temporary con-
struction easement for the construction of road rights -of -way, to wit, Beacon
Street within the Village limits.
