A. Code Enforcement Special Master Torcivia approved the minutes of the May 23, 2002 Special Master Hearing B. Fine Imposition Hearings: Case No. 02-66992 Raymond R. Beaumont 94 Fairview East Tequesta, FL 33469 Legal : 60-42-40-26-01-000-5220 Repeat Violation of Code of Ordinances 464, X-L (3), Restricted Parking R-1-A Zone The respondent, Raymond R. Beaumont, was present at the hearing. The Tequesta Code Enforcement Officer testified to the repeat violation. Conclusion of law was that Respondent is in repeat violation of Section 464, X-L(3) of the Code of Ordinances of the Village of Tequesta. • Special Master Paulette Torcivia ordered that a fine shall not be assessed; however, if the respondent is again found in violation of Section 355, X-L(2) of • Special Master Hearing June 27, 2002 Page 2 the Code of Ordinances of the Village of Tequesta, a fine of seventy five dollars ($75.00) per day shall be assessed for each day the violation continues to exist. Case No. 02-67914 Steven J. Wille 36 Yacht Club Piace, Tequesta, FL 33469 Leg a I : 60-42-40-26-02-000-5990 Repeat Violation of Code of Ordinances 464, X-L (3), Restricted Parking R-1-A Zone The respondent, Steven J. Wilfe, was not present at the hearing, however, there was a finding of proper noticee The Tequesta Code Enforcement Officer testified to the repeat violation. • Conclusion of law was that Respondent is in repeat violation of Section 464, X-L(3) of the Code of Ordinances of the Village of Tequesta. Special Master Paulette Torcivia ordered that a fine of fifty dollars ($50.00) is hereby assessed for the violation that has existed. Said fine shall be paid by the 24 day of July, 2002. If the Respondent, Steven J. Wille, is again found in violation in accordance with Section 464, X-L (3} of the Code of Ordinances of the Village of Tequesta, a fine of one hundred dollars ($100.00} per day shall be assessed for each day the violation continues to exist. A copy of this order shall be recorded in the Public Records of Palm Beach County, Florida, and, once recorded, shall constitute a lien against the property of the original amount upon which the violation existed and upon any other real or personal property owned by the Respondents, pursuant to Chapter 162, Florida Statutes, for the original amount. Case No. 02-65899 Earnest D. Carrere 88 River Drive Tequesta, FL 33469 Legal: 60-42-40-26-01-000-4310 • • Special Master Hearing June 27, 2002 Page 3 Repeat Violation of Code of Ordinances 464, X-L (3), Restricted Parking R-1-A Zone The respondent, Earnest D. Carrere, was not present at the hearing, however, there was a finding of proper notice. The Tequesta Code Enforcement Officer testified to the repeat violation. Conclusion of law was that Respondent is in repeat violation of Section 464, X-L(3) of the Code of Ordinances of the Village of Tequesta. Neill and George Dakis i 54 Chapel Lane Tequesta, FL 33469 Legal : 60-42-40-25-36-000-0140 Repeat Violation of Code of Ordinances 355, X-L (2), Restricted Parking -- Trailer The respondent, George Dakis, was present at the hearing. The Tequesta Code Enforcement Officer testified to the repeat violation. Violation Hearings: Case No. 02-67859 Tom Herr/ Airstar Inc. 612 Orange Ave�ue, Suite A-7 Jupiter, FL 33458 Tequesta, FL 33469 Violation of Code of Ordinances 517, 6-21 Work Without a Permit Tom Herr and Richard Helton, owners of Air Star, Inc., were present at the hearing. The Tequesta Code Enforcement Officer testified to the violation. • Conclusion of taw was that Respondents are in violation of Section 517, 6-21 of the Code of Ordinances of the Viliage of Tequesta. Special Master Paulette Torcivia ordered that Respondent, Tom Herr, Air Star, fnc., shall continue to comply with 517, 6-21 of the Code of Ordnances of the Village of Tequesta. There shall not be a fine assessed. D. Status Hearings: Case No. 01-11-008 Gordon Ripma & Robert J. ICraft 48 Coconut Lane Tequesta, Florida 33469 Legal: Coconut Cove Lot 12 & 13 A/K/A 48 & 52 Coconut Lane 60-43-40-30-40-000-0120 & 60-43-40-30-40-000-0130 Nature of Violation: Vioiation of Code of Ordinances of • the Village of Tequesta, Florida, Section X— Appendix A—(K) 1, a,b,c • Special Master Hearing June 27, 2002 Page 5 The Respondent, Gordon Ripma was present at the hearing. The Tequesta Code Enforcement Officer testified to the violations. Conclusion of law was that Respondents are in violation of Section X— Appendix A—(K) 1, a, b, c of the Code of Ordinances of the Village of Tequesta. Special Master Paulette Torcivia ordered that Respondents Gordon Ripma and Robert J. Kraft shall comply with Section X— Appendix A—(K)) 1, a,b,c, of the Code of Ordinances of the Viflage of Tequesta in the following manner: 1. Mr. Ripma shall produce the necessary Florida Contractor's License by June 28, 2002. If Mr. Ripma fails to comply within the required time, a fine of one hundred dollars ($100.00) per day shall be assessed until there is full compliance. If the Respondents have provided the Village with all necessary documents, and Respondent is in compliance, Mr. Kraft may apply for a fine reduction. The Special Master agrees to reduce the fine to zero if: 1) there is a valid contract between Mr. Ripma and Mr. Kraft, and • 2) Mr. Ripma has obtained the proper and necessary Florida Contractor's License by July 28, 2002. 2. If Respondents meet the requirements set forth above, they will be allowed to keep the trailer on the property until August 28, 2002. 3 Should Respondents enter into a valid contract to construct Mr. Kraft's home, they shall request a status hearing for August 2002. A certified copy of this order may be recorded in the Public Records of Palm Beach County, Florida, and, once recorded, shall constitute a lien against the property of the original amount upon which the violation existed and upon any other real or personal property owned by the Respondents, pursuant to Chapter 162, Florida Statutes, for the original amount. Case No. 02-0428 Josephine & Steven A. Gumina 428 B North Cypress Drive Tequesta, Florida 33469 Legal : 60-43-40-30-34-004-0012 • Nature of Violation: • Special Master Hearing June 27, 2002 Page 6 Violation of Code of Ordinances of the Village of Tequesta, Florida Chapter 11-24, No Occupational License The Respondent wa� not present at the hearing. The Tequesta Code Enforcement Officer testified that Mr. Gumbia did not work in the Village; that his truck had been seen near his re�idence, and that he did not need a license.
