NOW THEREFORE, BE IT ORDAINED BY THE VII.,LAGE COUNCIL OF THE VII,LAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS: Section 1. The Village Council of the Village of Tequesta, Florida, does hereby amend the Comprehensive Plan of the Village in accordance with the Local Government Comprehensive Planning and Land Development Regulation Act, as amended, adopting a small scale amendment to the Future Land Use Map in the area designated on the attached exhibit, applying a commercial land use classification to a portion of real property located at 801 U. S. Highway One, containing approximately 0.66 acres. Section 2. Severability. If any provision of this Ordinance or the application thereof is held invalid, such invalidity shall not affect the other provisions or applications of this Ordinance, which can be given effect without the invalid provisions or applications, and to this end, the provisions of this Ordinance, are hereby declared severable. Section 3. Repeal of Ordinances in Conflict. All other ordinances of the Village of Tequesta, Florida, or parts thereof which conflict with this or any part of this Ordinance are hereby repealed. Section 4. Codification. This Ordinance shall be codified and made a part of the official Code of Ordinances of the Village of Tequesta. Section 5 Effective Date. This Ordinance shall take effect immediately upon its passage and approval, as provided by law. THE FOREGOING ORDINANCE was offered by Councilmember , who moved its adoption. The discussions with the Village leading up to the annexation, the Petition for Annexation and the Annexation Staff Report all contemplated a Commercial Land Use Designation as well as a Community Commercial (C-2) Zoning District for the property. The commercial use is consistent with the property's frontage on U.S. Highway One, the adjacent commercial uses and the historical commercial use of the property for a restaurant. Unfortunately, after the property's annexation into the Village, no action was taken to assign a Commercial Land Use or commercial zoning to the property. At this time the Applicant requests a Commercial Land Use and rezoning to C-2 as was contemplated at the time of the annexation and in order to be consistent with surrounding properties. Palm Beach County has assigned a CH/5-Commercial High with underlying Medium Residential 5 land use and CG-General Commercial zoning District to Lots 1 through 7 and a Medium Residential 5 land use and RS- Single Family Residential zoning district to the parcels historically used for parking for the commercial use. S. HIGHWAY ONE, CONTAINING APPROXIlVIATELY 0.66 ACRES; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL OF ALL ORDINANCES IN CONFLICT; PROVIDING FOR CODIFICATION; PROVIDING AN EFFECTIVE DATE.
