HomeMy WebLinkAboutResolution_01-72/73_01/23/1973 • RESOLUTION NO. 1 - 72/7 A RESOLUTION OF THE VILLAGE OF TEQUESTA, FLORIDA, PROVIDING FOR. THE CONDEMNATION OF CERTAIN LANDS FOR ROAD PURPOSES. WHEREAS, the Village Council of the Village of Tequesta, Florida, received numerous complaints as to Beacon Street, a Village right -of -way, because it was not wide enough to handle existing traffic, and after investigation found that a dangerous condition exists because of the existing width of Beacon Street, and WHEREAS, the Village Council of the Village of Tequesta, Florida, authorized the Village Manager to approach the adjoining property owners to 0 obtain an additional right -of -way so that the Village could correct the above situation, and he approached the six property owners abutting the North side of Beacon Street in order to acquire the additional right -of -way necessary to widen the road, and WHEREAS, only four of the parties approached were willing to grant the Village the additional ten foot (10 easement, and the Village Council feels that it is necessary to obtain the additional right -of -way from the remaining two property owners in order to correct a dangerous situation; NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, as follows: 1. That the general welfare of the Village of Tequesta, Florida requires that the Village acquire the additional right -of -way necessary so that they may proceed with the widening of Beacon Street in order to correct a dangerous situation now existing within the Village. 2. The Village has surveyed and located the line and area of construction necessary in order to widen Beacon Street. All property owners on the line and within the area of construction were contacted in order to acquire easements by non legal means, and such easements were obtained from four of the six persons • contacted. As to the other two, it appears that the Village must proceed with the condemnation of the required right -of -way. 3. The legal descriptions of the two parcels to be acquired are as follows: The South ten (10) feet of the East 100 feet of the West 400 feet of the North 145.45 feet of the South 814. 75 feet of that part of the East half of the Southeast Quarter of Section 25, Town- ship 40 South, Range 42 East, Palm Beach County, Florida, lying West of the West right of way line of the County Road, as described in County Commissioners Minute Book 11, page 113, dated June 20, 1927, as recorded in Official Record Book 114, page 191, public records of Palm Beach County, Florida. The South ten (10) feet of the East 100 feet of the West 500 feet of the North 145. 45 feet of the South 814. 75 feet of that part of the East half of the Southeast Quarter of Section 25, Town- ship 40 South, Range 42 East, Palm Beach County, Florida, lying West of the West right of way line of the County Road, as described in County Commissioners Minute Book 11, page 113, dated June 20, 1927, as recorded in Official Record Book 838, page 797, public records of Palm Beach County, Florida. 4. It is necessary for the Village of Tequesta, Florida to acquire the above described property in fee simple. 5. In order to widen Beacon Street as required by the general welfare of the Village of Tequesta, Florida, it is necessary that the Village Manager and Village Attorney be authorized to take whatever action is necessary to acquire the property described herein. 6. Except as 'herein otherwise specifically indicated all provisions of this Resolution shall be and become effective immediately upon its adoption hereof.
