HomeMy WebLinkAboutResolution_1957_11/13/1957 • RESOLUTION WHEREAS, as part of the Plat of Tequesta recorded in Plat Book 25, page 7, public records of Palm Beach County, Florida, TEQUESTA, INC., the development corporation, dedicated to the perpetual use of the public, as public highways, all streets shown on said plat; and WHEREAS, at the time of the approval and filing of subject plat, the area encompassed thereby was located entirely in Palm Beach County, Florida, and no part thereof was located within the limits of any established municipality; and WHEREAS, the area covered by subject plat was, by Special Act of r. the 1957 Florida Legislature, incorporated into the municipality of the Village of Tequesta, thereby relieving Palm Beach County of the responsi- bility for the maintenance of the streets located within said municipality and placing the burden of said maintenance upon the Village of Tequesta; NOW, THEREFORE, BE IT RESOLVED: That the Village of Tequesta does hereby expressly accept the dedication of the streets located within its municipal limits as set out on the Plat of Tequesta recorded in Plat Book 25, page 7, public records of Palm Beach County, Florida, and shall maintain same in accordance with the provisions of its charter relative thereto. Mayor c� ATTEST: -' Vi a e Clerk V y Nor enb er 12, 1957 Village Council Village of Tequeata Jupiter, Florida Gentlemen: As you know, at the tine of the filing of the Plat of Tequesta, namely, December 20, 1956 we entered into an agreement with Pala Beach County in and by which we were obligated to complete the streets and highways shorn an said plat together with all drainage in connection therewith in accordance with the plans of Brockway, Weber & Brockway, PlAineers, under their file No. TF 1695—P. Accompany— ing this agree-milt was a bond in the amount of $260,316.54 assuring our performance under this agreement. As you may also know, under the Darr, upon the incorporation of the Village of Tequesta, our obligations and duties under said contract became academic with regard to all of the streets and highways with the exception of that portion of ToWesta Drive from the center line of F,1 Portal to the Martin Cowty lime for the reason that the County could no longer exercise control over same. It is our intention, nevertheless, to complete all of the streets and highways in the Village and the drainage in connection therewith in accordance with Brockwayes plans, except as modified by the Village Councilmen and Tequesta, Inc. by mutual agreement. The purpose of this letter is to assure you of this completion and to induce � you on the basis thereof to formally accept the responsibility of the maintenance of said streets and highways after the name have been completed, it being under — stood that until then, the responsibility will be ours.
