H, Sec. 30 -33, of the Code of Ordinances of the Village of Tequesta. • Address: 764 N U.S. HIGHWAY ONE Tequesta, Florida 33469 Legal Description: 30- 40 -43, SLY 189.26 FT OF NLY229.26 FT OF ELY 221.68 FT OF GOV LT 1 LYG W OF & ADJ TO SR 5 The Special Magistrate appointed by the Village of Tequesta to hear code enforcement cases for the Village of Tequesta, in accordance with Chapter 162, Florida Statutes, has heard testimony at the Code Enforcement Hearing held on the 28 day of June, 2007, and based on the evidence and testimony presented, the following FINDINGS OF FACT, CONCLUSIONS OF LAW, and ORDER are hereby entered: FINDINGS OF FACT 1. The Respondent, MOBIL OIL CORPORATION, was represented at the hearing, by Ken Sampson, Territory Manager and Neal Maligno, Store Manager and there was a finding of proper notice. 2. The Tequesta Code Enforcement Officer testified to and produced photos of the ongoing violation. 3. The Respondent has made substantial progress on bringing the property into compliance, even though compliance has not yet been achieved. CONCLUSIONS OF LAW Respondent remains in violation of Chap. 30, Art. II, Sec. 30 -33, of the Code of Ordinances of the Village of Tequesta. ORDER It is the Order of the Code Enforcement Special Magistrate that Respondent, MOBIL OIL CORPORATION, shall immediately comply with Chap. 30, Art. II, Sec. 30 -33, of the Code of Ordinances of the Village of Tequesta. A fine of two - hundred - dollars ($200.00) per day is hereby assessed for the violation that has existed. The fine is imposed beginning June 28, 2007, and will continue to accrue at two- hundred- dollars ($200.00) per day for each day the violation continues to exist. The Respondent shall be assessed two- hundred - forty- five - dollars and thirteen -cents ($245.13) for administrative costs to be paid by the 8 th day of July, 2007. A certified copy of this Order may be recorded in the Public Records of Palm Beach County, Florida, and, once recorded, shall constitute a lien against the property of the original amount upon which the violation existed and upon any other real or personal property owned by the Respondent, i pursuant to Chapter 162, Florida Statutes for the original amount. Upon complying, it is the responsibility of the Respondent to notify the Village of Tequesta Code Enforcement Clerk at (561) 575 -3826 to request a reinspection of the property.
