Call to Order and Roll Call The Tequesta Village Council held a Village Council Workshop Meeting at the Tequesta Recreation Center, 399 Seabrook Road, Tequesta, Florida, on Tuesday, May 24, 2005. The meeting was called to order at 8:07 A.M. A roll call was taken by Gwen Carlisle, Village Clerk. Council Members present were: Mayor Jim Humpage, Vice Mayor Pat Watkins, Council Member Geraldine A. Genco, Council Member Edward D. Resnik, and Council Member Tom Paterno. Also in attendance were: Village Manager Michael R. Couzzo, Jr., and Village Clerk Gwen Carlisle. Village Attorney Scott Hawkins was not in attendance. Mayor Humpage mentioned Village Manager Couzzo was on his way; he was stuck in traffic on the Turnpike due to a traffic accident. II. APPROVAL OF AGENDA MOTION: Council Member Resnik moved for approval of agenda, as submitted; seconded by Vice Mayor Watkins; motion passed S-0. 1) Community Response and Feedback- Code Compliance/I,ega1 Issues Mayor Humpage commented he asked Assistant Village Manager, Mr. Robert Gazlo, to give a brief overview of the responses from the Mayor's survey. He noted there would be amore detailed report at the June 9, 2005 Regular Village Council Meeting. Assistant Manager Gazlo indicated the Village got a good response from the survey. He noted the Parks and Recreation Department had the most comments with 42 responses, and 33 were favorable on the programs being offered. He noted the 9 azeas of concern were mostly the physical structures, and the limited space in the Recreation building. He mentioned the second area that got the highest response was Code Enforcement with 90% of the responses mentioning areas of concern. He mentioned out of the 34 responses, 29 were concerns, and 5 positive. Council Member Genco asked how many responses has been received so far. Assistant Manager Gazlo commented over 100 responses were received. He mentioned there were 31 responses for Public Safety, 21 were areas of concern, and 10 positive. He commented the negative comments could be due to traffic enforcement. Mayor Humpage pointed out the Thank you signs were the first attempt to slow down speeders, and they seem to be a hit. Council Member Genco asked Assistant Manager Gario if he knew the policy regazding ls` time speeders, whether they received a warning or ticket. Assistant Manager Gazlo mentioned there was no policy and it depended on the conditions, time of day, and volume of traffic. Chief Steve Allison, Police Chief explained there are 2 warnings for every one ticket. He commented they would never create a policy because it was based on discretion. He felt the Police Department has had more compliance through education and waznings. Minutes -May 24, 2005 Village Council Workshop Meeting Page 2 Assistant Manager Gazlo reviewed the next highest response, Development Matters, with 23 responses, 9 positive and 14 areas of concern. He noted the following areas of concern: 1) Street Lighting, 22 responses, 6 positive and 16 concerns for more street lights; 2) Sidewalks, 16 responses, 5 positive and 11 azeas of concern; and 3) School Bus stops, 4 comments, 3 positive and 1 concern for Tequesta Drive and Cypress Drive intersection. Vice Mayor Watkins questioned whether the traffic should be stopping at that location. Chief Allison explained it was a painted safety zone, so they have to stop. He indicated if it was a raised median they would not have to stop. Assistant Village Manager felt they should be stopping. Vice Mayor Watkins suggested that should be something for the newsletter. Council Member Paterno suggested moving the location up to where there was double traffic, on Tequesta Drive by Willow Drive. Chief Allison indicated the School Board picks the locations, and Tequesta has only been successful in moving one location. Council Member Resnik felt that in most of the responses the residents indicated they were very happy with the Village of Tequesta. Assistant Manager Gazlo agreed, that seemed to be the overwhelming response. He felt the residents were offering constructive criticism on the concerns. Mr. Gazlo noted he would have a more complete presentation at the June 9, 2005 Council Regular Meeting. Mayor Humpage noted the surveys were still coming in, and that 172 responses had been reviewed to date. Assistant Manager Gazlo mentioned if the intent was to utilize these responses, and to prioritize them, he felt there were enough responses to do that. • Village Manager Couzzo arrived at 8:1 S a. m. Mayor Humpage asked where Staff was at in the process regarding the new Code Enforcement Officer. Assistant Manager Gazlo indicated the ad was placed, and the Village received 11 applications. He mentioned Mr. Jeff Newell, Community Development Director, and Police Lt. Rick Ricciardi, short-listed the applications, and four people were interviewed. He noted the oral interviews included Police Chief Steve Allison, Mr. Newell, and Lt. Ricciazdi. He indicated the person has been selected, and a background check was being performed, and if everything goes well the person should start in about a week. He noted the new person would work with Officer Jason Fleming, of the Police Department. Council Member Genco asked if the new person was going to report to the Community Development Director. Assistant Manager Gazlo noted currently since Officer Fleming was doing the Code Enforcement, the new person would work with Officer Fleming to learn the process. He mentioned there were two aspects of Code Enforcement: 1) Field Code Compliance, and 2) Zoning Compliance. Village Manager Couzzo mentioned he and the Community Development Director were reviewing the transition of the job between the two departments. Council Member Genco stressed the police department have their hands full with Police work. She pointed out the Police Department personnel have a special training in the delivery of enforcement, but when it comes to the building codes and knowing the code of ordinances that would be Community Development. Village Manager Couzzo noted the initial training would be with Code Enforcement, and then it would transition to Community Development. Council Member Resnik mentioned he did not necessarily agree the Community Development Department should have the Code Enforcement agency. 2 Minutes -May 24, 2005 Village Council Workshop Meeting Page 3 Council Member Resnik felt the Community Development department should have participation, but explained looking back on the history of the Village a civilian did not work. Council Member Genco suggested keeping the issues with the department that had the most control and understanding so that they could train the people properly; and if the Village kept the position in the Community Development area they could also deal with the Special Master, because that was where a lot of these issues ended up. Assistant Manager Garlo mentioned what works well was the police officers identify the violations while on patrol, or enforces it immediately, but if needed to go through the Code Enforcement process the civilian would administer the paperwork, and bring to the Special Master to hear the case. He felt it made sense to have a civilian do the paperwork and expand upon the code. Mayor Humpage felt it should be a combined effort, and that it was irrelevant where this person was physically located. He suggested leaving the decision to the department heads. Council Member Paterno asked if there was a computerized process in place to streamline the system, or whether a program was needed to make the process smoother. Assistant Manager Garlo explained it was a very straightforward process. Mayor Humpage noted it was a standard form that gets filled out. Assistant Manager Garlo commented there were due process steps that needed to be followed. Village Manager Couzzo indicated the forms could be converted to a computer form. Assistant Manager Garlo pointed out it was all computerized. Chief Allison indicated it was like a police report and every narrative was different. He felt the current system was very good and streamlined the process, but there was a lot of paperwork. Council Member Paterno asked • what could be done to make sure the violations were being taken care by Code Enforcement before being reported by the citizens or Council. Assistant Manager Garlo commented it was a difficult question because the code was very specific, and what some people view as a violation may not be able to be legally enforced. He felt the Village adding another Code Enforcement person was an attempt to address the issue. Council Member Genco summarized the process. Vice Mayor Watkins noted back when the issue came up about the bus that was when the whole issue of the code having some weak areas was brought to everyone's attention. She felt it was sort of coming to a head, and Council now knows that they need to address that may not have been addressed or let slide. She commented the Village was now forced into addressing these issues, and she felt it was everybody's responsibility if they see something. She noted she did not have concerns of where this person was going to be assigned, and that it should be a cooperative effort. She felt the Mayor's survey clearly brought the issue to light, and that it needed to be addressed. Chief Allison mentioned he made it very clear to the police officers what he expected regarding Code Enforcement. He indicated there would be further changes, and everyone would be personally accountable. Council Member Resnik felt the Village ought to let the process work, and that jointly the collaboration effort should provide amore comprehensive effort on the part of the Village. He commented he felt the police officer needed some civilian help to do the administration functions. Council Member Paterno asked what philosophy or how was the Village going to approach or handle the policy in dealing with the new Code Enforcement. Village Manager Couzzo noted the best way to enforce the code was through educating the people and to get voluntary compliance. He suggested the Village could be more effective by putting information in the Newsletter. 3 Minutes -May 24, 2005 Village Council Workshop Meeting Page 4 Council Member Genco suggested listing the 10 most common issues in the newsletter. • She mentioned then the Village could tell them when there would be a sweep, etc., so as to give people a chance. Village Manager Couzzo agreed, and felt it was really important to get out there and do that. He mentioned in the last few issues of Smoke Signals Staff had tried to get out information to the community about what their government does. He agreed one inset could be done on Code Enforcement. Vice Mayor Watkins felt the Village has two big issues: 1) Trucks, What is a truck and what is an SUV; and 2) the monument mailboxes. Council Member Genco noted part of the code would need to be changed on some of the truck issues. Village Manager Couzzo mentioned there was a draft ordinance for Council to consider regarding the trucks. He noted the monument issue was totally different because those were in the public right-of--ways. Vice Mayor Watkins felt there was a safety issue involved in the mailboxes being in the public right- of-way. Council Member Paterno questioned how the Village was going to handle the mailboxes. Village Manager Couzzo stated this had come to Council about 3 years ago, and he would be glad to bring it back to Council for direction. He stated anything in the public right-of--way that was not approved by the public entity was prohibited. He noted this would be a very sensitive and difficult issue. Council Member Genco questioned the definition of a mailbox. Vice Mayor Watkins asked if the mailbox had to be approved on new construction plans. Village Manager Couzzo indicated the mailbox has to be in certain proximity to the road, but does not have to be on the house plans. He noted when you take a brick and mortar structure and place it in the right-of--way there would be some safety issues. . Mayor Humpage commented the civilian code enforcement officer has only been funded through September 30, 2005. He indicated when Staff does their budgets they would need to consider whether this position will remain. Village Manager Couzzo commented it would be included in next year's budget. He stated the person would be contractual through September 30~', using existing funds within the current budget. Mayor Humpage asked if it would be put in next year's budget as a full time position. Village Manager Couzzo responded in the affirmative. Council Member Paterno questioned what vehicle would be used. Village Manager Couzzo noted the existing code enforcement truck would be converted to Code Enforcement and the blue light would be changed to amber. Mayor Humpage mentioned the key here was compliance. Council Member Paterno noted word gets out into the neighborhood which were nice houses, and which were not as nice. He felt it would start to catch on, neighbor to neighbor. Council Member Genco commented another issue that Community Development had was occupational licenses. She asked how that was going to be handled. Village Manager Couzzo explained it has been a Community Development function for yeazs, and it will remain with them. He mentioned that was a computerized function, and annually Staff reissues occupational licenses. He felt that was another issue that was semi-volunteer. He indicated the Village was not actually going into homes and inspecting the business. Council Member Genco noted that depended on the type of business. He noted when fire inspections aze done on commercial businesses they help code enforcement by checking for their occupational licenses. n LJ 4 Minutes -May 24, 2005 Village Council Workshop Meeting Page 5 Council Member Genco asked how far along was Staff on the boat ordinance. Village . Manager Couzzo indicated the ordinance would be coming to Council for consideration in the near future. Assistant Manager Garlo mentioned the draft would be going to Planning and Zoning Board first for their comments. Village Manager Couzzo commented when it was ready for Planning and Zoning Board review, he planned to send it to Council for their input. He noted the draft ordinance was very comprehensive, and very specific, and felt it would generate two types of responses: 1) good, we want this; and 2) bad, how come the Village has to change this. He mentioned the ordinance was designed azound height, weight, axle criteria, etc. Vice Mayor Watkins commented Ms. Pert Town brought up the issue who would be liable after a humcane if your neighbors boat comes into your yard. Village Manager Couzzo believed the liability would be on behalf of the individual who owned the boat. He felt the core issue was does Council want to permit those types of vehicles, and recreational units in a residential azea that exceed a certain height, weight, and size. He indicated if they do not want that permitted Staff has designed an ordinance that was extremely specific to address the issue, so the Code Enforcement officer has specific codes to follow. Council Member Resnik asked when this ordinance would come to Council. Village Manager Couzzo indicated it has to go to Planning and Zoning Boazd first, and then to Council. He mentioned it would be very different then our current code, and could take getting used to. Council Member Resnik asked if it would apply to all residential azeas. Mr. Jeff Newell, Director of Community Development felt the ordinance primary addressed Rl-A. Council Member Genco suggested it should apply to all residential areas in the Village. Village Manager Couzzo felt it addressed all residential areas. • Council Member Genco questioned on a priority basis which ordinance would come first. Village Manager Couzzo felt both ordinances were ready to be reviewed by Planning and Zoning Board. Mr. Newell indicated he was currently reviewing the parking ordinance, and probably could have it ready for the Planning and Zoning Board Meeting in June. Council Member Genco questioned when the Adult Arcade ordinance was coming to Council. Mr. Newell indicated that would come to Council discussion at June Council Meeting. Village Manager Couzzo mentioned there was also a commercial pazking ordinance that Staff was currently working on, for pazking in commercial zones. Council Member Paterno questioned the commercial parking ordinance and what it would entail. Mr. Newell responded it would be any truck greater than 3/4 ton with the advertising of a business. He reviewed in Rl if it was less than a 3/4 ton it was permitted, but was not permitted in Rl-A. Council Member Paterno questioned what if the truck was less than 3/4 ton but had a trailer behind it. Village Manager Couzzo noted those were the issues that would need to be looked at, and incorporated into the ordinance. He indicated the ordinance would address the axles, and a combination of axles, etc. He mentioned it could be designed to do it by axles and not necessarily weight. He mentioned anything less than 3/4 ton that had lettering or signage in the Rl would be considered a commercial vehicle. Mr. Newell commented landscaping trailer's, etc. could not be parked out front they have to be hidden from view by code. Council Member Paterno asked if the trailers needed to be hidden from the front. Village Manager Couzzo indicated that was also being reviewed. Mr. Newell explained in Rl they have to be screened from 3 sides, and • the house could be one side. He commented Rl-A was different; it had to be screened from 4 sides. 5 Minutes -May 24, 2005 Village Council Workshop Meeting Page 6 Village Manager Couzzo noted when the draft ordinance comes to Council Staff will . provide the current code, and the proposed changes. He suggested Council might want to do it at a public workshop. Council Member Paterno felt that the Village had perpetuated it's own problem by allowing over the limit, and unfortunately the Village will get the most flack from the people who have the bigger boats, because they are going to be the most vocal. Village Manager Couzzo agreed, and commented that the demographics were changing, and there were changes in affluence, and the desire for more affluent recreational type activities. He mentioned if someone did not have to store it at a marina, it would allow for easier accessibility and use. Assistant Manager Gazlo pointed out he spoke with Officer Fleming, who he felt had a pulse on this issue, and the concern was the boat ramp had a lot to do with it, because people will say they moved here because of the boat ramp. Council Member Paterno felt the boat ramp could not handle any boat larger than 20 feet, unless it was extremely low tide. He indicated what it comes down to is economics. He commented there was limited space right now, and asked the Manager if there was any land available in the commercial azea to help these people move their boats. Village Manager Couzzo noted the Village does riot own any of the commercial land. He heazd that the marina at U.S. One and County Line Road was going to triple in size. Mr. Russell von Frank resident of Dover Road and former Council Member asked if anyone had approached Ms. Dottie Campbell to donate some land to the Village. Mayor Humpage felt the Village did not need the liability for a storage type of facility, and felt Ms. Campbell had plans for her property. Council Member Paterno suggested having a • place for one year, and then they would have to fmd a place for them after that. Village Manager Couzzo noted that a grandfather provision maybe included as part of the ordinance approval. Mayor Humpage felt a workshop on the issue was a good idea. Mayor Humpage noted he would like to move on, and address other issues. He asked the Manager if he had received a call from Mr. Jeffries. Village Manager Couzzo mentioned he sent a letter to Council last week regazding the intent of the building representatives regarding the mold issue. He commented he received a call this morning from Village Attorney Scott Hawkins and the letter appazently garnered the type of response the Village was looking for. He noted Staff has been contacted by the building owner and the manager to set up a meeting this week, and they asked that the Village Manager, the Mayor and Attorney Hawkins be present to meet with Mr. Jeffries, Mr. Bible and Mr. Islip (building manager) to discuss some resolution. He mentioned the meeting was scheduled for 9:00 am on Thursday, May 26, 2005. Council Member Genco asked what the Village's high points would be regazding the negotiations. Village Manager Couzzo indicated he made it very clear in the letter, that Council would like 40% retroactive for 18 months. He commented he would like to hear what they have to say. Council Member Genco felt the Village needed to give them 30 days to begin the repairs, and then escrow the rent. Village Manager Couzzo noted the rent escrow was in the letter. Council Member Genco felt the letter was very well written, and there needed to be a deadline in mind for completion of the work. Village Manager Couzzo felt the problem might be with the contractor or the manufacturer of the materials. He agreed a timeframe needed • to be put in place, or they negotiate a settlement that Council would be happy with, or the Village goes to the next step in how to deal with the situation. 6 Minutes -May 24, 2005 Village Council Workshop Meeting Page 7 Mayor Humpage indicated he would like to touch on one more matter regarding the • Request for Qualifications (RFQ) for Professional Engineering Services. He mentioned concerns on the time sensitive Water Use Permit. He asked if this was moving forward. Council Member Genco mentioned she had spoke with the Village Manager regarding this issue. She explained F.S. 287 basically says that any project over 1 million dollars has to be done under a separate bid. She commented the Village Manager had indicated the engineering services could be divided into three different components. She mentioned three firms had been short-listed. Village Manager Couzzo mentioned he spoke with Attorney Hawkins and after the Selection Committee deliberated, there were three options to consider: 1) select no one; 2) select one firm for all three components; or 3) break the three components up and select one firm for each component. He noted it would go to the Selection Committee, then the Negotiating Committee; and then to Council for approval. Council Member Genco reiterated the statute required any contract over one million dollars to be handled in a separate contract. Village Manager Couzzo indicated the Village Attorney was reviewing the requirements. Mayor Humpage questioned whether the Village's Finance Director would be involved in the process. Village Manager Couzzo indicated she would be involved with the Negotiation Committee. He pointed out the Selection Committee and the Negotiation Committee had different members, and different functions. Mayor Humpage asked whether the Selection Committee could apply each applicant to one of the components. Village Manager Couzzo stated he would send out a letter to the firms stating the three options that the Village could consider. . Council Member Genco mentioned the Village did not have to have a consulting contract, but must have a consulting contract for anything that falls into the threshold accumulatively between $25,000.00- $250,000.00, provided any one of the projects that falls within that criteria was not over $50,000.00. She felt it was very complex. Village Manager Couzzo agreed it was complex, but explained it was the law. Mayor Humpage indicated he wanted to see this keep moving through the process. Council Member Genco cautioned Council that some firms could chazge less by the hour for the work, and other firms could chazge more per hour, but because they have the boiler plate and more experience they could do the work faster, and the end result could be cheaper. Village Manager Couzzo noted the Selection Committee must finish their work and rank the firms. Council Member Genco commented she would like someone who specialized in NPDES and Water Resource Permitting, who knows and has the specialty, that may be able to walk through the process faster than an engineering fum. She felt general engineering was all across the Boazd, but Civil engineering was a specialty. Village Manager Couzzo commented all Selection Committee meetings would be open to the public. Council Member Resnik left the meeting at 9: OS am. Council Member Genco asked whether the Village was going to have Mr. Ori do the financial forecast. She mentioned Mr. Ori's contract does not fall under the statute. Village Manager Couzzo commented the fmancial forecast was completed this yeaz, and • would not have to be done again for 3-5 years. He mentioned the reason he requested the financial forecast be done this yeaz was because there were so many dramatic changes. He felt it was a good idea to show Council every five years the state of the Utility. 7 Minutes -May 24, 2005 Village Council Workshop Meeting Page 8 Mayor Humpage suggested it would be nice to have one done after the RO comes on line • to see how the Village was doing. Council Member Genco agreed, and suggested it be completed after the Village leaves Jupiter water. Village Manager Couzzo agreed, and suggested it should be limited to showing what the operating costs were, and be more specific to the RO, so the forecast would be done at a more reasonable cost. Village Manager mentioned the Village was going to try and secure a 20-year permit for the Consumptive Use permit. He commented if that was achievable the permitting would not need to be done for a very long time. Council Member Genco noted she was very familiar with the permitting process. Council Member Paterno asked what percentage of consumption would be used after disconnecting with Jupiter. He cautioned the Village could be at a point where they could run into water problems and be locked out to attain water. Council Member Genco pointed out the Village already hd additional wells approved. Village Manager Couzzo indicated these were permits that would need to be renewed. Council Member Genco explained the Village has conceptual approval for three additional wells. Village Manager Couzzo noted there would be backup plans to have an emergency interconnect with Jupiter. He noted also in the Jupiter Hills agreement if water could not be provided the Village could shut them off. He noted the Village also has interconnection with Jupiter Island. He mentioned everything would need to be reviewed. Mayor Humpage commented the new Village Hall was going to be paid by cash, and maybe the Village should start looking at ways to put money away for future Utility • needs. Council Member Genco felt the third train and well could cost approximately $3.5 million - $4.0 million. Village Manager Couzzo agreed. Council Member Genco mentioned she received a phone call regarding the 10-year plan for burying of powerlines in Tequesta. She asked that it be placed on the next Council Meeting agenda for discussion and direction. She felt it was time to start thinking about this concept, since she had a lot of inquiries about the subject, and had talked to Florida League of Cities about financing. Village Manager Couzzo suggested he could ask Mr. Macon from Florida Power and Light (FPL) to be present if Council desired. Council Member Genco indicated she would prefer to have someone from the Florida League of Cities. Village Manager Couzzo indicated one of the things Council would have to take into consideration that when the powerlines were buried, it not only was the cost, but they were also not exempt from being interrupted. Council Member Genco noted that was the whole issue that Florida League of Cities had evaluated, and they know how to help identify the major powerlines, and how to do some of the financing. She suggested start with Florida League of Cities and contact FPL. Mayor Humpage explained he had been working off Prosperity Farms Road with FPL on undergrounding power for 6 lots, and he would provide their numbers. He noted one of the biggest issues was when they went into the easement and tore up the fences, and even cracked one person's pool. Village Manager Couzzo felt it was an issue to review so everyone would have the information. Mayor Humpage felt it would be one of the biggest issues if the Village started going into their backyards. Council Member Genco suggested having something in the Code that • required the powerlines be buried when an easement was being torn up. Vice Mayor Watkins indicated after the lines were buried there would still be a box that sits in the yard; and that people would need to buy into that. 8 Minutes -May 24, 2005 Village Council Workshop Meeting Page 9 Council Member Genco suggested it might be something to start thinking about, and • make changes that could slowly start to be implemented. Village Manager Couzzo noted Palm Beach has a referendum out for $54 million dollars; he indicated he would try to provide their study and entire file. Public Comment Mr. Russell von Frank resident of Dover Road and former Council Member noted on his street he has various code enforcement issues: 1) Ms. Siegel, 2) now a fence that has been extended beyond the front of the house, and 3) a rack that has been left out front since the yard sale over a month ago. He suggested the key was not looking at a specific ordinance, but look at it as abandoned construction materials, etc. He mentioned the ENCON lift station has not been maintained, and the house next door to that has an abandoned automobile. He felt Dover Road had it all. Council Member Paterno noted in the Tequesta Country Club the residents now pay a contractor to cut the ENCON facility. He felt this should be taken care of if it was going on everywhere. Village Manager Couzzo agreed Staff needed to talk to ENCON. He indicated one of the things he wanted to bring up was ENCON had asked the Village for the ability to hook emergency power to the Plant for the lift station during a hurricane. He felt it might be a wise and sound idea. He mentioned if their power were down it would run off the Village's generator. He explained they have agreed to make all the necessary connections, and pay for all the costs, and that it would be a benefit to the Village. Mayor • Humpage pointed out the Village has the ability to move the new generator during a hurricane. He noted it could power up any of the Village's buildings. Village Manager Couz~o commented the generator was dedicated to the new Village Hall. Mayor Humpage explained it could be used for this hurricane season before the new Village Hall was completed. Council Member Genco noted in the newspaper it noted Council would be having a meet and greet session monthly. She asked for significant advance notice on items regarding any budget. Village Manager Couzzo suggested the 3`d Tuesday of the month at 8:00 am far the Council meet and greet workshops. Council Member Genco explained she does nat have a normal schedule. Mayor Humpage suggested at the June Regular Council Meeting that Council pick the subject or topic for the next workshop. Consensus of Council agreed.
