MEETING MINUTES
JULY 21, 2004
I. Call to Order and Roll Call
The Tequesta Village Council held a Regularly Scheduled Village Council Meeting
at the Tequesta Recreation Center, 399 Seabrook Road, Tequesta, Florida, on
Wednesday, July 21, 2004. The meeting was called to order at 5:00 p.m. A roll
call was taken by Mary Miles, Village Clerk Council Members present were:
Mayor Pat Watkins, Vice Mayor Geraldine A. Genco, Council Member Edward D.
Resnik, Council Member Russell J. von Frank, and Council Member Jim Humpage.
Also in attendance were: Village Manager Michael R. Couzzo, Jr., Village Attorney
Scott Hawkins, Village Clerk Mary Miles, and Department Heads.
• H. Invocation and Pledge of Allegiance
Mayor Watkins led the pledge of allegiance to the flag.
III. Approval of the Agenda
MOTION:
Councilmember Humpage made a motion to approve the agenda as amended.
Vice Mayor Genco seconded the motion, which carried by unanimous 5-0 vote.
IV. RESOLUTION 54-03/04 - A RESOLUTION OF THE VILLAGE COUNCIL
OF THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA,
SETTING THE PROPOSED AD VALOREM MILEAGE RATE FOR THE
VILLAGE OF TEQUESTA FOR FISCAL YEAR 2004/2005 AT A RATE OF
6.4980 MIL5 PER $1,000.00 OF ASSESSED VALUE, AND THE COMPUTED
ROLLED-BACK RATE OF 6.0308 MILS PER $1,000.00 OF ASSESSED
VALUE.
Attorney Hawkins read Resolution 54-03/04 by title only. Mayor Watkins
announced that the millage rate was exactly the same as last year.
MOTION:
. Councilmember von Frank moved approval of Resolution 54-03/04. Vice Mayor
Genco seconded the motion. Councilmember von Frank asked what the projected

income was compared to the projected expenses, in light of the 18.7% increase in
property values. Village Manager Couzzo reported staff had been working on the
budget every day for the past two months and were now setting the tentative rate.
The process would continue through workshops where allocations would be
explained. The tentative rate would allow latitude as the process continued. Vice
Mayor Genco commented it had been her understanding you could not go higher
than the published rate, only lower. Village Manager Couzzo explained it could be
higher but individual notices must be sent to every property owner. After having
worked on the figures for two months, he was confident the rate would not need to
be higher. Motion carried by unanimous 5-0 vote.
V. RESOLUTION 55-03/04 - A RESOLUTION OF THE VILLAGE COUNCIL
OF THE VILLAGE OF TEQUESTA, PALM BEACH COU TY, FLORIDA,
APPROVING AN AGREEMENT BETWEEN THE VILLAGE OF
TEQUESTA, FLORIDA AND JUPITER HILLS COUNTRY CLUB, INC.,
FOR PROVISION OF THE BULK RAW WATER SERVICE, AND
AUTHORIZING THE MAYOR TO EXECUTE THE APPLICABLE
AGREEMENT ON BEHALF OF THE VILLAGE.
• Attorney Hawkins read Resolution 55-03/04 by title only. Mayor Watkins
recognized those parties who had worked on this agreement.
MOTION:
Vice Mayor Genco moved approval of Resolution 55-03/04. Councilmember
Resnik seconded the motion. During discussion of the motion, the Village
Manager confirmed that recapture of infrastructure, etc. was not every five
years. Village Manager Couzzo commented the Village really had no capital
expenses for extension of the system other than a new meter, a backflow
preventer, and a valve. The Village was basically providing more water at the
source and giving it to them to distribute as they saw fit. It was all bulk raw
water. Mr. Couzzo explained this had been brought to ENCON and South
Florida Water Management District. Councilmember Humpage commented in
the 1970's when Jupiter Hills golf club was started, he had been working as an
electrician and had done much of their electrical work, and since going into his
own electrical business he still did work there, and be was bringing this to
attention so there would be no perception of his being biased on his vote.
Councilmember Humpage commented the Village had a well field at the end of
Tequesta Park at the Jupiter Hills access road which extended to the Jupiter
Hills guardhouse, and a pipe extended to the water plant, so the Village had
nothing to do. Attorney Hawkins asked if Councilmember Humpage would
benefit financially as a result of any vote he cast here tonight, to which

Councilmember Humpage's knowledge Jupiter Hills would not benefit
financially, other than to get water, as a result of his vote here tonight.
Councilmember Humpage verified that was correct. Mayor Watkins advised
the first question asked was whether this would in any way jeopardize the
Village's water, and the Council had been assured that there was plenty of
water for this, and Attorney Hawkins had made sure the language in the
contract protected the Village if at any future time the Village needed that
water, which Attorney Hawkins confirmed. It was confirmed this was
untreated, raw, and not potable water. Motion carried by unanimous 5-0 vote.
VI. RESOLUTION 56-03/04 - A RESOLUTION OF THE VII.LAGE COUNCIL
OF THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA,
APPROVING AN ENGINEERING PROPOSAL BY DYER, RIDDLE, MILLS
AND PRECOURT, INC. (DRMP) FOR WESTERN CORRIDOR REVIEW,
DATA COLLECTION AND REPORT REVIEW IN THE LUMP SUM FEE
OF $8,000.00, AND AUTHORIZING THE VILLAGE MANAGER TO
EXECUTE THE APPLICABLE CONTRACT ON BEHALF OF THE
VILLAGE.

MOTION:
Councilmember von Frank moved approval of Resolution 56-03/04. Vice
Mayor Genco seconded the motion. During discussion of the motion,
Councilmember von Frank asked for Councilmember Resnik's thoughts on
this. Councilmember Resnik commented in the mid-1990's the Village had
been very concerned about traffic imposition on Country Club Drive, Tequesta
Drive, and adjacent streets, because of potential growth in Martin County
Section 28. That growth had not occurred, but service traffic-trucks-had
increased. This was not presently a great imposition, but with the advent of the
Western Corridor, which was now under construction, there would be an
additional 650 new homes and therefore the potential for increased traffic
through Tequesta's residential streets. When he brought this up in April,
consensus had been to look at it to see if action should be taken to try to get
Martin County to connect the end of Country Club Drive with County Line
Road, which had been attempted in the past but had failed. This connection
would take the traffic load off of Country Club Drive and Tequesta Drive.
Increased construction traffic while the homes were being built, and increased
service trucks after construction was completed was anticipated. Vice Mayor
Genco advised that the application to build those homes had been withdrawn
and was in abeyance, and the last community in Jupiter which had been
• approved had conducted a traffic study which showed there would be 7,000
trips per day annually. Since there was no big change in the near future, Vice

Mayor Genco indicated she would support doing a traffic study in peak season
to see how much it had changed since the study in the mid-90's and if there
proved to be a significant change it could be monitored; however, nothing really
could be done unless the traffic level reached a certain amount. If Martin
County did something to impact Tequesta's traffic, the Village would then have
legal authority to tell them they were opposed. The Village's code already said
the level of service was restricted and that could not be changed, and if Martin
County wanted to make a change that could possibly impact trips per day in
Tequesta, there was a process to appeal that and basically force them to put
through the County Line extension. Vice Mayor Genco suggested taking a
"wait and see" attitude and do a traffic study in peak season; and also, when a
development was proposed in Jupiter that might impact Tequesta to get a copy
of their traffic study, to see what the impact would be. This would save the
Village at least $7,000. Councilmember Resnik stated based on comments by
the Jupiter Town Council, and the Commission in Martin County, there would
be no increase in traffic resulting from building the homes; and they had no
sympathy, they felt all the traffic would go to Indiantown Road.
Councilmember Resnik commented that the traffic study referenced by the
• Vice Mayor focused on Jupiter, included the Western Corridor, and indicated
7,000 trips per day. Vice Mayor Genco stated that was 7,000 trips per year.
Councilmember Resnik commented Mr. Shickledance had not cancelled his 480
homes. Vice Mayor Genco advised that had been incorporated in the study,
and the study was Jupiter Isles to Island Way. Mayor Watkins indicated she
was curious because if this was in Jupiter, she could not imagine why the trucks
would want to go 25 mph down Country Club Drive, and if they came from
Martin County she thought they would go to Indiantown Road and up. Mayor
Watkins indicated this was $8,000 for something she was not convinced would
have immediate impact on the Village. Vice Mayor Genco commented the
study showed everyone was going to Indiantown Road or Center Street, to the
turnpike or I-95, simply because the Village did not have the type of services
that would bring people here. Mayor Watkins expressed her opinion that
eventually the road was a good idea and she felt bad for the people in Little
Club because people cut through their residential area too much, but that was
not a Tequesta road. Mayor Watkins indicated she was having a problem
spending the money on this. Vice Mayor Genco commented a traffic count
during peak season would make sense to show how much new development had
impacted the roads and would save $7,000. Councilmember Resnik commented
having gone through this since 1994 with various studies, Tequesta had never
received any consideration in any studies, and you could tell from comments
made by Martin County and Jupiter Council there would not be any increase,
• but he would like to have an independent survey, not one done for Jupiter.
Councilmember Resnik was concerned that development would creep up and

then the Village would be in a fight to get that road connected. Vice Mayor
Genco commented the Village had taken a very defensive posture by amending
the comprehensive plan so that the State had adopted the class of road, and now
Country Club Drive could never be more than two lanes-one lane in each
direction-which was done while she was Mayor. Councilmember Resnik
commented that was done in the late 1990's, either by the previous manager or
by Jack Horniman. Vice Mayor Genco responded it was proposed and Jack
Horniman wrote the actual rule which was passed by the State, and she was
trying to give Councilmember Resnik a comfort level that the Village was in a
really good defensive posture on this. The Vice Mayor commented if something
changed the traffic pattern that was noticeable, which could be found out by
doing a traffic count, there was a mechanism in place to push for the County
Line extension; and the best way to address Councilmember Resnik's concern
was to do a traffic count during peak season. Councilmember Resnik stated a
lot of people were concerned. Vice Mayor Genco recommended having Mr.
Horniman do a 1-1/2 page study of where the Village stood and that they were
in a defensive posture, and protecting themselves. Village Manager Couzzo
stated that was exactly what Mr. Horniman would say, that the Village was in a
• very defensible position, that it was done years ago, that the Village was
protected, and if traffic exceeded the designation on Country Club Drive the
Village had recourse. The Village Manager advised the only reason this matter
was presented was to see if the Village Council had any interest in having an
independent analysis by a separate traffic engineer as to what the impact would
be, but the Village could do its own traffic count. Vice Mayor Genco stated she
agreed with Mayor Watkins that the information would show the same as the
Jupiter report until another development was approved. Councilmember von
Frank agreed with Mayor Watkins. Councilmember Humpage expressed his
opinion this was premature and he would like that money used for streetlights
and sidewalks. Mayor Watkins commented this could be brought up again.
Vice Mayor Genco proposed an addendum to the motion to have a traffic count
done during season. Village Manager Couzzo commented the Village did
traffic counts regularly and that would 6e done. Councilmember Resnik asked
why a traffic count was going to be done before the homes were even built;
what was needed was to know the impact those homes would bring.
Councilmember Resnik commented that after listening to people in Little Club
it was apparent that it was not going to be cut and dried to make Martin
County connect the road. Joe Hall commented the Village needed to keep open
to what would need to be done to connect the road, but he did not expect to see
it connected in our lifetimes. The motion to approve was withdrawn by
Councilmember von Frank, the second was withdrawn by Councilmember
. Resnik. Councilmember Resnik made a motion to table this item pending
receipt of more information and determine the construction plan, since the

Vice Mayor had said some construction had been cancelled, so that the Council
would get a picture of what ezactly was going to happen and bring this back
when the construction picture was known. Councilmember von Frank
seconded the motion. Motion carried by unanimous 5-0 vote.
Councilmember Genco requested the letter from the Kiwanis dated June 18, 2004
regarding renaming Tequesta Park be placed on the agenda for the next regular
Council meeting for discussion and possible action.
V. ADJOURNMENT
There being no further business, upon motion by Council Member Humpage,
seconded by Vice Mayor Genco, the meeting was adjourned at 5:40 p.m.

The administration and representatives from Jupiter Hills Country Club, Inc. have developed
the attached agreement for your review and consideration.
The goal of the agreement is to enable the Village to continue the expansion of our
customer base, and provide bulk raw water to meet addirional needs of the Jupiter Hills
Country Club. The development of this agreement has taken place over the past couple of
months. I believe the agreement provides a unique opportunity for both parries. In
developing this agreement the parties attempted to consider and plan for all outcomes as a
result of this transaction.
• The agreement was developed with the assistance and involvement of the Village of
Tequesta (administration, legal department, consulting utility engineers and rate analyst),
Jupiter Hills Country Club representatives, South Florida Water Management representatives
and Rick Dent of ENCON. Language has been carefully drafted to insure the Village's
rights and needs are protected in order to provide potable water to its residents and
customers.
This agreement is one of a number of transacrions recently undertaken by the Village of
Tequesta to expand the water utility and customer base. The administrarion will continue to
pursue and evaluate the opportunities for your future consideration.
These efforts are undertaken to insure the long-term viability of our independent utility, for
Village residents and all of our customers.
