At such time, we discussed the recent communicatian by the State o# Fforida Department af Transportation wherein the Viliage was advised that it shou(d discontinue allowing trave! aver the subject bridge in v'sew of apparent problems vi+i#h the structure. �in such conversation, you advised of the recen# inspections that had been conducted, of the DOT's suggestion that the bridge be clased, and that you were calling an emergency . meeting of the Village Caunci( to discuss how to proGeed. As we discussed, it was my judgment at the time, based on the facts presented, that the Village should exercise its po(ice power to �lose the bridge consistent with its obligations to pratect pubfic safety . and we(fare. In our conversation of early this morning, you confirmed that the Viflage Council mei on Friday afternoon at the expressly called emergency meeting. You further confirmed that the Village Council vated to have the bridge closed and that such closing has indeed occurred. Fu�ther, as t undecstar�d it, staff and mem�ers of Village Councif have undertaken steps #a disseminate informatian an the bridge closing and that you are in the process af ineeting with staff to formulate a plan af ac#ion for addressing this . problem. ln additian, it is my understanding from aur conversatian that baat #raffic is not permitted under the bridge which is afsa a significant concern given the number of boaters who live narth of the bridge. wu�ur.jones foster.cam � � Mike Cauzzo . January 30, 2006 Page 2 Mike, regarcling these' various issues and baseci on our discussians, I want to emphasize these points: 1, Based on what you have told me and from the comments that were also related during our canference catl on Friday, I believe the Village o# Tequesta Gouncil has acted prudently in closing the bridge. I�see that the Village has no choice in this regard given the infarmation that has been pravided ta date. 2. l am extremely troubled that the Department of Transpartatian did not provide waming of the structural problsms that have apparently precipitatad this immediste closing. As I understand it, the Department of Transportation has an ongoing obligation ta inspect the bridge and to inform the Village of Tequest� of its opinion on the integrity of the structure and the serviceabili#y o# the bridge. White I have nat yet reviewed any dacument5 in this regard, if is my understanding that you are in the process of coqecting documentation which discuss�s the DOT's ongair�g maintenanGe obliga#ion, its obligation to repart to the Village of Tequesta, any information and communications regarding recent inspections which resulted in the determina#ion that the bridge nesded to be closed. 3. As discussed, i will review fhe documentation iden#ifed above and will prepare a letter to #he Department of Transportation setting forth my concerns, as counseE for the Viflage of Tequesta, that the Department of Transportation �has put the Village of Tequesta in an extremely un#enable pasition. The tetter wil! be crafted in order ta go on recprd explaining the great incanvenience that has been fhrust upon the Vilfage and the exposure af human health hazard that has resulted from the lack of the DOT's praper warning. f will submit the fetter to you fpr review in advance af it being finalized and I assume you may want to confer with the Mayor in this regard. There may be additiana( comments that need ta be made depending upon the documentatian #hat you send to me far review. 4, With respect to the DOT, i will look at whether a(iability claim can be stated against the DOT for the tremendous burden that has been placed on the Village of T�questa and its citizens as a result o# the D�T's (ack of diligence and waming. Please be sure tha# your staff keeps a recard of alI activities that are undertaken in connection with the bridge c{osure effort. In addition, the record should demonstra#e alI hours devoted #o such task. This record should include infarmation an the following: a) Any inspection related activity; � b) Any road cfosure activity; c) Any activities associated with regulating traffic; Mike Couzzo January 30, 20�6 Page 3 d) Any faw enforcemenUfraffic regulatian activities; e) Activities associated with communicating with the public/press regarding the raad clasure detail; and, fi� Activities assaciatetl with formulation of a pfan of action for addressing bridge repair/replacement. � Mike, as alluded to above, it is critical that the Village af Tequesta develop an � immediate ptan of action for addressing this bridge closura problem. !t occurs to me = that this pl�n of action should include, among other things, development of a plan far either repairing/repfacing the bridge, including a timetable of such physical activity. The plan of action should also develop an infarmatian plan for communicating with citizens on th� project, timetable, etc. In additian, law enforcement personne! need ta develop pians far alternative routing of traffic. A similar review needs ta be conducted with regard to boat traffic. It occurs to me that the Village of Tequesta needs to be in a position to demonstrate that i# is doing euerything physically possible to minimize the inGOnvenience to its cifizens and to address this public safety concern an an exped(ted manner. The strand reduction for this slab, based on our recent 1/28/06 field inspection, shows that of the bottom mat of 22 prestressed strands, the deterioration at mid-span is as follows: 2 strands had 100� section loss, 11 strands @ 50� section loss, and the remaining 9 strands @ 25$ section loss. Reduction in material strengths was also accounted in analysis. '�he analysis results indicate that the bridge should be posted for the and STS type vehicles, based on the Operatinq ratings, at or below 11 tons, 15 tons and 17 tons, respectively. Our recommendations include a blanket posting of 11 tons, if the bridge is to lae returned to service (one h osted speed lane - two way traffic), a continuation of the 15 mp p limit, and strict enforcement of said restrictions..As you are aware, photographs depict he�vy loaded trucks crossing this bridge, in lieu of the past load and speed restrictions. Prior to the contractor commencing with this work, the'Village advised us that another independent structural engineer de�mcd the bridge to be structuratly deficient and that it should be reptaced. CALL TO ORDER AND ROLL CALL The Tequesta Village Council held a Emergency Special Village Council Meeting at the Emergency Operations Cer�ter, 357 Tequesta Drive, Tequesta, Florida, on Friday, January 27, 2006. The meeting was called to order at 3:00 p.m. A roll call was taken by Executive Assistant to the Village Manager, Anne Koch. Council Members present were: Mayor Jim Humpage, Vice Mayor Pat Watkins, Council Member Geraldine A. Genco, and Council Member Tom Paterno. Also in attendance were: Village Manager Michael R. Couzzo, Jr., and Department Heads. Palm Beach County Battalion Chief James St. Pierre was also present. II. AP'PROVAL OF AGENDA MOTION: Vice Mayor Watkdns moved to approve the agenda, as submitted; seconded by Council Member Paterno; motzon passed 4-0. III. Discussion and possible action regarding recommendation by the Department of Transportation for the Tequesta Drive Bridge Village Manager Couzzo started the discussion by stating that for the past six weeks the Village I has been looking at the condition of the Tequesta Bridge. He commented they have reduced the speed and tonnage signs because the Village had concems about the bridge. Initially, the State indicated that the bridge was in good condition, but obsolete. Council Member Paterno noted there might be other issues with the bridge. Village Manager Couzzo indicated they sought out an independent engineer, who did an analysis, so the Village asked the State to come back and do a thorough investigation. He noted this investigation has taken place two times, with the latest one happening January 26, 2006, and a copy of the report that the Village received from the Sta.te has been submitted to Village Council, in which it shows serious problems. The Departrnent of Transportation recommended the bridge be closed immediately until further investigation can take place. He stated the engineers may be able to come out tomorrow morning to mobilize and do an in-depth anaiysis to determine what steps and what alternatives the Village can bring to the Council for consideration for repairing the bridge or replacing it. He stated what really needs to be discussed is the recommendation of the Department of Transportation and what the Council's preference is at this time. Village Manager Couzzo explained the Staff met early this morning to discuss what needed to be done, and the coordination that needs to take place between all of the departments. He felt the Village was prepared to detour traffic and shut down the bridge should that be the decision of Council. Vice Mayor Watkins asked about detouring the westbound traffic. Village Manager Couzzo sta.ted that at this time the Department of Transportation as recommending the bridge be closed. He also stated that he spoke with Village Attorney Hawkins and that it is his recommenda.tion that / the Village close the bridge. He stated the bridge inspection is usually done in March, but was done in January, He noted they are going to come back as early as tomorrow to work with the Village.
