Call to Order and Roll Call The Village of Tequesta Planning and Zoning Advisory Board held a regularly scheduled meeting at the Tequesta Recreation Center, 399 Seabrook Road, Tequesta, Florida on Thursda.y, December 1, 2005. Ghair Schauer called the meeting to order at 6:31 P.M. A roll call was taken by Gwen Carlisle, Village Clerk. Board Members present were: Chair Elizabeth Schauer, Vice Chair Steve Okun, Board Member Lesli� Cook, and Board Member William Wilder. Alternate Board Members Russell von Frank and Carl Blas� were present in the audience. Also present were Assistant Village Manager Bob Garlo, Community Development Director and Clerk of the Board Catherine Harding, and Village Clerk Gwen Cazlisle. Board Member Charles Reinwald was absent from the meeting. Assistant Village Manager Garlo introduced Ms. Catherine Harding to the Board, indicating she had formerly been Building Director for.Islamorada, Florida, and was very qualified for the position of Community Development Director. II. Approvai of the Agenda Vice Chair Okun and Boazd Member Wilder indicated they each had matters to be discussed under "Any Other Matters". MOTION Vice Chair Okun moved to approve the agenda as amended to include items from Vice Chair Qkun, Board Member Wilder, and Alternate Board Member von Frank under Arry Other Matters; seconc�ed by Board Member Wilder; motion passed 4-0. III. Approval of Minutes a) October 6, 2005 Meeting Minutes Board Member Cook requested correction of two minor typos: on page 3, paragraph 3, delete the word "fine" and insert "fill"; and on page 9 clarify the ser�tence "Mr. Ulrich asked how does the group get involved in the dialog with Council". Vice Chair Okun requested that his comment on page 11, paragraph 2, first sentence be softened. Village Clerk Carlisle responded that she would clarify and soften the statement. Board Member Cook pointed out that Zuccarelli's name had been misspelled throughout the document. Minutes — Planning and Zoning Advisory Board Meeting 12l1/2005 Page 2 MOTION: Board Member Wilder moved to approve the October 6, 2005 meeting minutes; seconded by Board Member Cook; motion passed 4-0. IV. New Business a) Proposed Ordinance Providing Vegetation Standards for Prozimity to Electric Facilities Boazd Member Cook referred to a memo provided in the packets which stated _ draft language had been designed to address previous concerns, and asked if this board had expressed previous concerns. Chair Schauer responded that memo was addressed to the Mayor and Council, and referred to their previous concerns; no concerns had been expressed by this board. Village Clerk Carlisle explained the Village Council ha.d requested that at the time the Planning and Zoning Board received this package that it also be provided to Council for review; therefore, it had also been pXOVided to them as an FYI. Assistant Village Manager Garlo shared the history of the ordinance, advising that at some point the Village Council had requested a presentation from FPL � regarding power lines and how to keep from losing power during storms. Mr. Gazlo explained that one of the things discussed at that time had been the possibility of adopting an ordinance that would govern the proximity of trees to power lines, and FPL had indicated they were in the process of formulating a model policy. Mr. Garlo explained that what FPL had done was to provide language to municipalities from their program "Plant the Right Trees in the Right Place", which the municipalities had attempted to place into their ordinances, and that langua.ge was what had been used in the ordinance presented tonight. Chair Schauer stated that she was President of the Tequesta. Pines Homeowners Association, and advised that when they had done their landscaping plan they had installed curbs and gutters so that their trees could be closer to the street and farther from the power lines. Chair Schauer asked how residents would be notified that their vegetation was a problem so that they could be provided witth sufficient time to trim before a storm, noting that information could be placed in the Village newsletter or they could be notified by Code Enforcement. Community Development Director Harding, whose department included Code Enforcement, explained that this ordinance would not be difficult to regulate because it did not deal with any existing trees, but basically covered only new planting, which in the planning stages would be supervised in plan review. Also, a reasonable time could be time to call a landscaper to move the tree at the Village's discretion. Ms. Harding advised that what was reasonable depended on the circumstances for what was currently going into the ground, and those were the conditions that � would be picked up on by Code Enforcement. �� bl c could be asked to there were many trees that needed tnmmmg, and p trim as good neighbors. Vice Chair Okun suggested that the Village put together a flyer with information on replacing downed trees, which could be provided to a11 landscaping companies, nurseries, Home Depot, and other similar businesses. This flyer could also be used when residents were notified th�t there were problems with their vegetation. Chair Schauer noted there were more trees blown down in Hurricane Wilma than in Frances or Jeanne, and although some did not fall neaz power lines it was unknown what might happen in the future. Ms. Harding stated she believed the power company did do some pruning and the Village probably could arrange something with them concurrently with adoption of this ordinance, such as them going around with the Village and providing help with pruning, and the Village could continue to advise the public what kind of pruning they needed to do. Ms. Harding agreed . that the Village newsletter would be a good way to inform the public. Vice Chair Okun noted that the newsletter was an efFective tool and suggested an insert with a big headine stating: If your property has power lines adjacent to it, read this. Boazd Member Coole suggested that FPL run the notices because they were expensive. Chair Schauer requested 220 notices to use as inserts in her homeowner association's newsletter. Board Member Wilder commented he had been at the Village 1 o�u a� ao tan ed� at o pragram in presentation, and recalled that FPL had p the whole area they served, whether or not the Village adopted an ordinance. Mr. Garlo advised that he was not aware whether they were presently conducting such a program. Board Member Cook indicated many of the power pales that snapped had been old. Chair Schauer expressed amazement that concrete poles had fallen, resulting in a whole section of Military Trail being closed. Boa.rd Member Cook commented people needed to talk to their congressmen. Minutes — Planning and Zoning Advisory Board Meeting 12/1/2005 Page 4 MOTION: Board Member Cook moved to recommend to Village Council approval of the proposed ordinance providing vegetation standards for proximity to electric facilities; seconded by Board Member Wilder; motion passed 4-0. V. Communications from Citizens Russell von Frank, 485 Dover Road, noted that trees were mentioned in code sections 30-32, 33, 30-62, and 30-91, but power lines were not, �vhich he felt should also be addressed. Mr. von Frank questioned why certa.in trees that were not accepted in the State of Florida were not inctuded in zoning districts R-1 and RIA, but were mentioned in other zoning districts. Chair Schauer responded that the new Community Development Director would look into that and report to the boazd. Mr. Von Frank commented that the ordinance that covered golf carts did not address go-karts, mopeds, scooters, tricycles, bikes, other mechanized vehicles, etc. Mr. Garlo responded that this was dictated by State sta.tute, which stated that golf carts were illegal but provided a provision to make them legal, although that had never been done in Tequesta. However, the practice had been to a11ow golf carts, with discretion as to enforcement. The issue had come up because some children in the Country Club had operated golf carts recklessly, which was a public safety issue. The current understanding was that residents would be educated as to the reality that golf carts were not legal to operate at all, with enforcement action using discretion as needed. Mr. Garlo indicated that the Village would probably continue to pursue whether they would like to legalize golf carts. Mr. Von Frank indicated there was also a problem with scooters on the road, and he had brought this up because of concern with any type of motorized vehicle. Chair Schauer reported that a neighbor's 4-ye�r-old child rode his mini- hummer in the street in her cul-de-sac, and that the Tequesta Pines newsletters had been used to ask parents to take responsibility for the welfare and safety of their child. Board Member Wilder stated he believed an ordinance should be added to the code book so that it could be enforced. Chair Schauer noted another neighbor's child was always on the �idewalk in a motorized velucle, and that was a parental responsibility. Board Member Wilder asked if the Police Chief could include scooters in an ordinance; Mr. Gazlo advised he was not awaze that the Chief was working on such an ordinance but that the Chief had discussed the Staiute and indicated it would be the Village Coun.cil's decision whether ta legalize golf carts. Vice Chair Okun expressed concem that tbe Police Department could be in a precarious position because they were responsible not only to the Village but also to the State to enforce ordinances, and if someone had a serious injury there would be very innovative attorneys who would pull things out, and police officers could be handcuffed to a very damaging policy. Mr• Garlo responded the Statutes governed, agreed with Mr. Okun's comments, and advised it was very difficult for a police officer who had been told not to allow Minutes – Planning and Zoning Advisory Board Meeting 12/1/2005 Page 5 . 14-year-olds to operate golf carts to look the other way if a person with golf clubs passed by. Boazd Member Cook commented the kids would not have a license but adults would. Chair Schauer asked if other communities had this problem; Ms. Hazding responded she had not worked in a community that had golf carts, but they were rarely allowed on roads and usually were restricted to the golf course and trails leading to the golf course. Vice Chair Okun commented that by selling homes with space intended for golf carts in the 2-1/2 car garages, the Village was acknowledging they knew there would be golf carts going between the home and the golf course. Mr. Garlo agreed, and expressed his opinion the Village needed to decide on control—age requirements, no operation after dusk, etc., or not, and if they did not do so then they had to expect that the police would see these as violations. Alternate Board member Blas� asked if he would be liable if he hit a motorized scooter driving in the middle of Beach Road, to which Mr. Garlo responded the sta.tute only included gas-operated scooters and mopeds, but did not cover electric ones. Board member von Frank pointed out there were motorized vehicles for handicapped persons; Chair Schauer commented that was a wheel chair. Chair Schauer commented she knew plenty of people who had motorized wheelchairs, and recalled that years ago a woman in a motarized wheelchair was hit by a car on U.S. One. She had tried to sue, but she had been in the wrong. Vice Chair Okun suggested the board make a recommendation to bring this forward. Chair Schauer recommended looking at wha.t other golf cart communities within the State of Florida were doing. Board member Cook commented that was the Council's decision. Chair Schauer noted when the Council read the minutes she was sure she would get a comment. from somebody. Boazd member von Frank stated that it was part of the Planning and Zoning Board's obligation to present this matter to the Village Council. MOTION: Yice Chair Okun moved to make a recommendation to Village Council to request that they look into scooters, motorized vehicles, golf carts, etc; seconded by Board member Wilder; motion carried by unanimous S-0 vote. VI. ANY OTHER MATTERS Board member Wilder reported he had attended the Village Council meeting last month, and they had suggested holding a joint meeting with the Planning and Zoning Boazd so both would be on the same page. They had seemed concerned that the Planning and Zoning Board was not on the same page as they were. An example was the Planning and Zoning Board had approved the Atlantis project because it complied with a11 the zoning. The Village Council had tabled it because they were unsure if the zoning allowed a 5-story or 70-foot building. Chair Schauer advised she had received a phone call from a Council member after the last Council meeting in regard to that, and she had responded that if the Council had read the minutes of the Planning and Zoning meeting to see how the t;9 � Minutes - Planning and Zoning Advisory Board Meeting 12/1/2005 Page 6 Director of Planning and Zoning and the Board had gone over the approval of the Atlantis project, they would have seen that P&Z's number one concern had been the underground pazking versus the elevation, which was lacking in the code, but Atlantis was presently in compliance with the code. Vice Chair Okun noted the board had reviewed that project as a model, which Chair Schauer confirmed. Chair Schauer had indicated she had no objection to meeting with the Council to go over that, but had been advised by the Village Clerk that Council had a fu11 plate during January, and requested the Community Development Dire Board rk with the Village Manager to schedule a joint workshop for February. member Wilder advised that Council had ta.bled the Atlantis matter and referred it to the attorney to check the language of the building code to make sure the language of 5 stories and 70 feet were allowed. Mr. Wilder commented he thought this boazd had gone over that thoroughly. Chair Schauer agreed, stating this was a prime example of her previous statements regarding having one attorney for an advisory board and another attorney for the Village Council, and if there were one attorney there would be one direction. Since the Village Council. did not wish to have a single attomey, this problem would probably continue in different areas. Chair Schauer commented she had promised the Council member that she would bring up the Atlantis matter. Mr. Wilder commented this boazd had recommended approval of a private club on the third story, and reported the Village Council had tabled that also, because they wanted to check the pazking. Chair Schauer sta.ted Planning and Zoning had addressed the pazking. Mr. Wilder agreed, commenting there had been mutual parking with the bank. Board member Wilder reported that a couple of ineetings ago, Village Council h a d a p p r o v e d t h e Baldinds ex pansion, and one of the Council members had objected to a parking space that wasn't quite as accessible as he thought it should be. Mr. Wilder noted that Plannin� and Zoning had addressed that 1 S spaces were required, and this was the 19 . At the Council meeting, Mr. Baldino had offered to replace the parking space with a planter, but Council had approved it. Mr. Wilder noted from these examples it appeared Council and Planning and Zoning were not on the same page. Chair Schauer commented when she had been on the Village Council, Board member Cook had been on the Community Appearance Board. Chair Schauer reported she had always looked at what the CAB had done, which gave her a different perspective when sitting on the Council, and Council had sometimes added more trees or moved some azound. Chair Schauer commented that Planning and Zoning was an advisory boazd to the Village Council and the Council rMade the final decision, and there would be situations where the board would not agree with Council members on their decisions. One of the Council members had been upset over Baldino's landscaping and parking, and the owner had con o��e Counc 1 member tha f they : Chair Schauer advised that she had commented Minutes – Planning and Zoning Advisory Board Meeting 12/1/2005 Page 7 had read the Planning and Zoning minutes, they would have known that Mrs. Cook had requested additional trees to make.it look nicer, and the applicant had agreed, and had been very accommodating. Board member Cook commented Council might have reasons that Pla.nning and Zoning did not know about. Boazd member Wilder commented not the reasons they said at the meeting-the parking situation for the club—which P&Z had fully addressed, and that they were not sure whether a 5-story building was allowed under the code. Vice Chair Okun commented that the point was Planning and Zoning had been compromised after they had judiciously reviewed it, and it was if P&Z had not acted responsibly. Chair Schauer commented it was not.the first time—they had changed the landscaping on Old Dixie Highway and Tequesta. Drive after Planning and Zoning had reviewed it, a.nd Mr. Wilder had been very upset over that, but that was their prerogative and why they were elected officials and Planning and Zoning was just an advisory board. Chair Schauer asked Board member Wilder not to take it � personally. Betty Nagy, Shay Place, commented she believed one of the reasons the private club had been tabled was it was going to be open during the day. Chair Schauer indicated P&Z had not been told that. Board member Cook commented that was a good reason to table it. Board member Wilder advised Council had asked the applicant if he would be open during the day and he had responded there was a good possibility there could be a circuxnstance where they could be open during the day. Chair Schauer commented this board had thought it would just be open for dinner, etc., so this changed the whole sense, and it had been misrepresented to Planning and Zoning, and that would be Council's problem. Boazd member von Frank asked when Planning & Zoning reviewed Atlantis if they had mentioned a flat roof or parapet. Chair Schauer stated she did not remember. Mr. Von Frank advised that_ they now claimed that a flat roof was no problem; however, they wanted to put in four parapets that were not considered roof. Betty Nagy commented the parapets looked like umbrellas. Chair Schauer commented sometimes people changed things after it left. Planning and Zoning, which was a problem. Mr. Wilder advised the 5-story building ended at the flat roof but they had added two domes to dress it up, and the code said the 70' height was the center line of any pitched roo� and this center line of what they had was lower than 70 feet. Chair Schauer advised you did not count the underground pazking. T'his was a good model but there were other shopping areas in the future that might be sold to someone who wanted to develop residential, and they might do exactly what Atlantis was doing, so this was something that this project had brought forward, and as noted in the minutes, underground parking and height was something that needed to be addressed in the future. An applicant could raise the elevation #o have underground pat�king, and it would still meet the code. Ms. Harding indicated it might become state law, and she did not feel it would be appropriate to contact gasoline stations at this time. She felt the public understood that people had to have generators, and their use would be regulated under the building code as to how faz from windows they must be and the storage of gasoline, etc. Vice Chair 4kun commented the previous Community Development Director had said that in an � ernergency situation all of that was ignored because it was an emergency situation, but there was no footprint to recognize an emergency situation. Ms. Harding advised it would be up to the Village Council to consider if they wanted to do anything beyond whaf the State was considering now; if they wanted to consider an ordinance. Chair Schauer suggested this might be addressed with the Village Council during the joint meeting. Vice Chair Okun commented the State was just looking at gasoline facilities—not food mazkets. Boazd member Wilder commented the county was looking at requiring generators for gas stations, anc� the Village could piggyback their ordinance. Chair Schauer asked the Village Clerk to make a note of those two issues to be discussed at the joint meeting. Betty Nagy commented for someone was on dialysis and was diabetic there had been a problem getting ice, and there were three people on her street who went out and bought a generator, but they shut it off at 10 p.m. Chair Schauer commented she was very considerate, and others were not so considerate. Vice Chair Okun commented as the population aged there would be more and more instances where such things became high priority and it should be addressed now so that one did not have to be running around laoking for such thiugs as ice, etc. Mrs. Nagy commented they shut off their refrigerator for an hour, and it was not necessary to light up the whole house. Chair Schauer asked Mr. Garlo and Community Development Director Harding the status of the boat ordinance, and reported a gentleman had been there before the meeting who wanted to discuss that and pickup trucks. Mr. Gazlo reported there was a draft ordinance that had been prepared by the previous Community Development Director to address concerns regarding parking of boats, and it was to be expanded to make it a more comprehensive parking ordinance of boats before presentation to Council. Vice Chair Okun advised that it had been his understanding that the boat ordinance had been tabled waiting for snowbirds to arrive in order to receive more significant public input. Mr. Garlo indicated he was unsure of the present status, but he knew there had been talk of forming a comrnittee to bring it to the residents. Vice Chair Okun noted that at the last meeting there had been a very proactive ordinance. Ms. Harding advised she had read that ordinance, and there had been a lot of input through e-mails and letters, but the ordinance at this point was unacceptable and needed to be rewritten. Vice Chair Okun indicated he did not think it could be rewritten before the hearing. Chair Schauer indicated at the meeting last September people had been present and tonight a gentleman had come in and she had taken his name and phone .I i Minutes — Planning and Zoning Advisory Board Meeting 12/1/2005 � � Page 10 number, and the board had told those people they would work with them on a draft amenable fo everyone and that would be the only ane mee n f in an effort o to be held at a different time than the Plannmg and Zoni g g work together and not to have a lot of angry people. Chair Schauer noted those people needed to be contacted because they�e an and a police officer�be o address their concerns, and she recommen present at that meeting. Mr. Garlo recommended dialog with the public to discuss these issues. Vice Chair Okun clarified that the board had pushed their , hearing off and had promised the people in attendance that evening there would R be another hearing to solicit public input. Chair Schauer commented the boazd had told them this would be the only agenda item and they would be willing to sit for several hours if necessary, and if they could not come to a happy compromise in one evening, the boa�'d v�'as w�.11u�g t she would� on� evenings. Chair 5chauer noted she had promised these people them, and suggested a meeting after the halidays to follow through on the promise made to the residents, so they would know they harl a voice and the board was willing to work with them. Garlo commented that staff knew there had to be a �ne of he main ssues what the right boat ordinance was for the Village, that o driving this was the height of the boat, and once an ordinance was passed the residents had to comply. Vice Chair Okun indicated the major concern of non- boat owners were they would have to live within the confines created for the boaters. Chair Schauer commented if the board could get a lot of this done before it went to Council it would make it easier for Council by PlanninS and 7�o�ung acting as a buffer zone. Beriy Nagy commented she did not remember if it was at the planning meeting or the Council meeting where a man spoke representing a homeowner association, and she had spoken to him outside to ask where he lived and to explain that Minutes - Planning and Zoning Ad�isory Board Meeting 12/1/2005 . Page 11 having attended meetings, it was her opinion thatt rather than having a hundred people show up at a meeting it would be better to hold a meeting here or somewhere else of the people who did not belong to homeowners associations, and have ten people get up and give their opinion—instead of 100 people getting up and repeating the same thing. Chair Schauer commented before there was any dialog there would be rules and regulations, and she did not want something repetitive. Vice Chair Okun cautioned the board must be extra careful beca.use someone who felt very passionate about the issue would like to speak to give their own little twist and should not be denied the opportunity to be heard, and he would be glad to accommodate those who wanted to invest their time. Chair Schauer commented they had promised they were willing to listen for several hours, but she did not vvant to go past 11 p.m., but to have another meeting. Vice Chair Okun commented it was important that Council realize Planning and Zoning was going to take the heat and if they had certain things on their agenda that they needed to shaze with Planning and Zoning, then sooner was better than later. Chair Schauer requested that Village Clerk Cazlisle explain to Board member Reinwatd that according to the ordinance, boazd members were allowed to miss only three (3) meetings in one year, and this was the second meeting he had missed. � Communiry Development Director Harding noted that she would look into holding an extra hearing.
