COUNCILMEN OF THE VILLAGE OF TEQUESTA, FLORIDA
A Public Hearing was held by the Councilmen of the Village of
Tequesta on Tuesday, December 10, 1963 at 10:00 A.M. at the Church of
the Good Shepherd, Seabrook Road, Tequesta, Florida. Councilmen present
were Messrs: Valier, Bowden, Stewart, Turnbull and Cornelius. Also
present were Attorney Paul Potter and Village Clerk Robert Harp.
Mayor Valier stated there were three items to come before the Hearing,
as published and posted. He stated the first item for consideration was
to adopt a zoning classification for the Rankin -Floyd property located
at the Corner of Seabrook Road and Dover Road. This property was recently
annexed to the Village. Mayor Valier stated all Councilmen had been sent
a copy of Mrs. Rankin's letter and waived reading of the letter. The
Village Manager showed the location of the property on the plat, showing
it completely surrounded by single family residential properties. He
further stated it had been used for a considerable time as a multiple
family dwelling, was zoned R -1 AA by Palm Beach County, and was presently
in a very bad condition. It has been a non - conforming use as to County
Zoning. He displayed a mock -up of the proposed architectural changes
Mrs. Rankin wants to make to the property at a cost of approximately
$15,000.00. The problem is that if the property is zoned R -1, the owner
could not get a permit for the proposed changes in construction according
to the terms of the Village Zoning Ordinance. If zoned R -2, it would
appear to be spot zoning in an R -1 District. All Councilmen were in agree-
ment that the owner's proposed renovation was quite good and would add
much to the area and would like to see it done if legally possible.
Attorney Potter suggested that perhaps the Council could grant a building
permit prior to developing a zoning classification for the property and
table the action at this meeting. Attorney Charles Houston attended the
meeting in behalf of his client, Mrs. Dorothy Rankin. There were no
other property owners present to discuss this matter. Cornelius moved,
seconded by Turnbull, that the Council table action on zoning of the
Rankin -Floyd property and hold a Public Hearing on Tuesday, January 14,
1964 for the purpose of approving the issuance of a building permit for
the proposed improvements to the property and that all property owners
within 500 feet of the property be asked to look at the model of the
proposed new construction for the building. Motion passed unanimously.
Vote as follows: Valier -For; Bowden - For; Turnbull - For; Stewart - For;
Cornelius - For.
Mayor Valier stated the next item to be considered was the application
of DiVosta Construction Corp. to have Parcel "A ", Ridgewood Homes, Section
II, rezoned from R -1 classification to R -2 classification. Mr. Otto DiVosta
and Robert Sylvester attended the meeting for DiVosta Construction Corp.
Mr. DiVosta was asked if he had any plans for the structures he proposed
to build on Parcel "A" and he stated they would conform to Blair House
Apartments recently constructed on Parcel "B ", Ridgewood Homes, Section II.
There were no objections from the floor and none by letter. Turnbull
moved, seconded by Cornelius, that the application of DiVosta Construction
Corp. for a change in zoning of Parcel "A ", Ridgewood Homes, Section 1I,
from R -1 classification to R -2 multiple family dwelling classification
be approved. Motion was unanimously passed. Vote was as follows:
Valier - For; Stewart - For; Cornelius - For; Bowden - For; Turnbull - For.
Mayor Valier stated the next item on the agenda was the zoning classi-
fication for the U. S. Government property located South of Village Square
Shopping Center between U. S. Highway No. 1 and the Intracoastal Waterway.
It was explained the current County zoning is R -1 AA, their highest classi-
fication, Cornelius moved, second by Stewart, that a parcel of land in
Section 31, Township 40 South, Range 43 East, bounded on the North by the
North Line of said Section 31; on the. East by the Westerly Right of Way
Line of the Intracoastal Waterway; on the South by tke,�orth Right of Way
Line of State Road ?fl9 I- Alk}r; and on tf 3t' �e lei "terly Kigftt of Way
Tine of State Road No. $ (U.S. Highway I} be zoned `IA. Motion
unanimously passed. Vote was as follows:'

There being no further business, the meeting was adjourned at
10:20 A.M.
