HomeMy WebLinkAboutMinutes_Regular_05/12/1964 MINUTES OF THE MEETING OF THE COUNCILIVT OF THE VILLAGE OF TEQUESTA The Regular Monthly Meeting of the Councilmen of the Village of Tequesta was held Tuesday, May 12, 1964 at 8:00 P.M. at the Church of the Good Shepherd. Councilmen present were: Messrs. Valier, Turnbull, Bowden, Stewart, and Cornelius. Also present were Robert Harp, Village Clerk and Attorney William A. Lord. Minutes of the previous meeting were read and approved. The Treasurer's Report and Disbursements for the month of April, 1964 was read and approved. Cash balances on Hand at April 30 were as follows: First Bank of Jupiter $ 9 Petty Cash 25.00; Community Federal Savings & Loan 30.353, 0 $39 ,879.79 Balances in the Various Accounts were as follows: Operating Account $29,061.19 Petty Cash 25.00 Building Fund 3,000.00 Streets, Roads and Drainage Fund 5,370.00 Capital Fund 2, 423 .60 $39,879.79 Police Chief Henry M. Dusenbery read his Report for the month of April, 1964 showing the Police Cars traveled a total of 4,428 miles. The Report also pointed out the fact that "No Parking Anytime'' signs had been erected on the South side of Bridge Road across from the First Bank of Jupiter; on the North and South side of Tequesta Drive at the Steele Shopping Center Building and Jones Tequesta Pharmacy and on Dover Road by Plantreat Company. A discussion ensued on the vacation of the alley around the Steele Building on Tequesta Drive. The Village Manger reported on a meeting with Mrs. Rose Birong, owner of Lot No. 16, Block 22, Jupiter in the Panes, Section B, directly west of the North -South Alley on the West Side of the Steele Building. He stated Mrs. Birong preferred to have the complete twenty (20) foot alley remain as a buffer zone between her property and the Steele Building and would like to have the Village post the alley for "No Parking Anytime ". She further stated she did not care whether or not the alley to the South of Lots 17, 18 19 and 20, Block 22, Jupiter in the Pines was vacated or not. Based upon prior discussion of this matter, Cornelius moved, seconded by Stewart and passed that the Village of Tequesta vacate the twenty (20) foot alley running west from the west right of way line of Seabrook Road along the rear of Lots 20, 19, 18 and 17, Block 22, Jupiter in the Pines, Section B, up to the east right of way line of the alley runpi.ng north and south between Lots 16 and 17, Block 22, Jupiter in the Pines, Section B. Attorney Lord was instructed to prepare proper ordinance or other documents to conclude this matter. Police Chief Dusenbe 's request for an additional lice officer i"Y q police was the next item discussed. It was explained that the current three officers are working twelve (12) hour shifts. An additional man would allow for eight (8) hour shifts and preclude a hardship upon the offi- cers in event of sickness and during vacation periods and would pro- vide for better police coverage during the early evening hours. The Police (thief stated he could hire an additional patrolman for $350.00 per month. The Village Manager stated it appeared that the Police Department Budget for the balance of the fiscal year could take care of the additional cost through September 30. Councilman Stewart questioned whether or not a part time officer could be employed but Chief Dusenbery believes much greater efficiency in the Department would be had through the use of a full time man. It was moved by Turnbull, seconded by Cornelius and passed that Police (thief Henry Dusenbery be authorised to hire an additional police officer at a salary of $350.00 per month starting May 15, 1964. The Village Manager apprised the Council of a letter from Mrs. Dorothy Rankin, one.of the owners of property located at the Corner of Seabrook and South Dover Roads requesting an extension of time in k F r MINUTES OF THE MEETING OF THE COUNCILMEN OF THE VILLAGE OF TEQUESTA MAY 12 1964 PAGE 2 which to obtain a building permit to make structural alterations and repair to the property. The Village.Manager recommended that the Council refuse the request and proceed with a Public Hearing to pro- vide for the zoning of the property, Turnbull moved, seconded by Bowden and passed that Mrs. Rank-ins request for an extension of time to purchase a building permit be refused and proper steps for zoning the parcel of ]and be taken. The Village Clerk read a letter from the Waterway Village Pro- perty Owners Association over the signature of Id1liam N. Shannan, President, proposing the following items in connection with Cove Road and Waterway Road, the North and South entrance roads to Village Square Shopping Center and also to Waterway Village: 1. Association to lease roads to Village on 20 or 25 year lease at $1.00 per year, with Property Owners Association retaining deed restrictions. 2. Village to complete topping of said roads. 3. Village to maintain said roads for period of lease. 4. Unpaved portion of South road to be maintained at present height. If the Village should fail to do so, the Association retains the right to repair. Village Attorney Lord was questioned on these matters and did not believe the Village could enter into such a long term lease. He also questioned whether the Association has legal title to the roads due to various factors. Condemnation of the roads was again discussed and it was the general feeling that this would be the most satisfactory manner in which to conclude this matter for all parties concerned. Thus, the roads would be for the public use and maintained by the Village. Mr, Shannon questioned if upon condemnation the Village would complete the topping to the East Right of Way Line of Seaview Road and was advised it probably could be done. Cornelius moved, seconded by Turnbull and passed that the Village of Tequesta pro- ceed with condemnation proceedings to acquire Cove Road South and Waterway Road on a friendly basis. Council was advised of a letter from the First Southern Baptist Church requesting the Village to officially abandon public utility easements which were located in the middle of property they recently purchased as a church site and upon which they are currently const- ructing the church. Cornelius moved, seconded by Bowden and passed that the Village of Tequesta abandon public utility easements des- cribed as follows: "The South 6 feet of Lots 1, 2, 3, 4, 5 and 6; the North 6 feet of Lots 11, 12, 13, 14, 15 and 16; and the South 6 feet of the West 74 feet of Lot 7 and the North 6 feet of the West 74 feet of Lot 10; in Block 20, Jupiter in the Pines, Section B as dedicated and shown on Plat recorded in Plat Book 26 on Page 18, records of Palm Beach County." A discussion was held concerning a garbage and trash franchise. Cornelius moved, seconded by Bowden and passed that the Mayor and Village Manager be a committee authorized to investigate the possi- bility of granting a garbage and trash franchise to some qualified firm. The Clerk read a letter from Cameron Guile, owner of a "parcel of lard part of SW t as in OR 348 P 299, being N. 210 Sly, 1420.49 of V. 100 of E. 408.09 lying W. of Center Line of SR No. 5" on Tequesta Drive, asking whether or not his property was considered by the Village to be a corner lot. It was the opinion of the Coun- cilmen and Village Attorney that since the proposed road running along the west side of this property has never been dedicated for use as a public street or road, his property would not be considered a corner !._ and he was to be so notified by the Clerk. A post card was read from Mrs. Connell protesting the "No Parking" restrictions recently put into effect on Tequesta Drive at Jones Tequesta Pharmacy stating the parking lot was usually full and she believed 5 or 10 minute parking should be permitted. ' MINUTES OF THE MEETING OF THE COUNCILMR+i OF THE VILLAGE OF TEQUESTA MAY 12, 1964 PAGE 3 A letter from the Florida Police Chiefs Association designating the week of May 24 through May 3V,, 1964 as Burglary Prevention Week was read. In conjunction with this announcement, Mayor Valier thereby declared the same period to be Burglary Prevention Week in the Village of Tequesta. The Mayor advised of a meeting of the Councilmen and Mr. Dillard Duff, Architect, concerning plans For the Village Hall. He stated Mr. Duff would undertake the project for a 5% fee based upon construc- tion cost, would make two (2) visits per week while construction was going on and would require a $300.00 deposit upon signing of an offi- cial agreement. Cornelius moved, second by Turnbull and passed that the Mayor be authorized to sign an agreement with Dillard Duff for his services as architect in erection of a Village Hall at a fee of 5% of cost of construction and that the Mayor, Village Manager and one other member of Council, to be appointed by the Mayor, be authorized to proceed with completion of final plans and specifications. A Beautification Committee Report was presented by Mrs. Helen G. Schull. She stated the Tequesta Country Club Community Association had authorised $400.00 to be spent on the beautification of North Place at Country Club Drive. The plan is to plant grass in the swale 15 feet wide for a distance of about 250 feet on each side of the road and plant mahogany trees in the swale. A sprinkler system would also be installed. It is estimated that no mal maintenance would amount to about $480.00 per year. Cornelius moved that the Village accept the maintenance of the North Place planting. There was no second and motion was withdrawn. Much discussion ensued on high cost of maintenance with Stewart moving that the Village pay $400.00 for planting, etc. at North Place with this to be total amount expended. There was no second and motion died. A discussion ensued on general beautification and various property owners spoke in favor.of beauti- fying North Place. Cornelius moved, seconded by Turnbull and passed, with Stewart dissenting, that the Village accept maintenance of North Place at a cost of $480.00 per year beginning with the completion of the beaufification installation with a review of the maintenance cost at end of 12 month period. Mayor Valier read a letter from the Jupiter Tequesta Chamber of Commerce requesting a contribution of at least $1,200.00 for the year. Councilmen indicated displeasure with the signs currently at the Chamber Office. Turnbull moved, second by Cornelius and passed that a contribution of $250.00 be made to the Jupiter Tequesta Chamber of Commerce for this year. Bowden moved, seconded by Cornelius and passed that all future Regular Council meetings beginning with June, 1964 be held at night. It was moved by Bowden, seconded by Stewart and passed that all property owners with fallen trees and other debris on their property be informed to take immediate action to have them removed so that they will not constitute a hazard during the hurricane season and will improve the looks of the community. The Clerk presented a request from the Ministerial Association for two signs on U.S. #1 to indicate that various churches are located west of U.S. #1. Clerk was advised that such signs would have to conform to Sign Ordinance and to take appropriate action. The Councilmen set Tuesday, June 16 as the date for a Public Hearing on the Bulkhead Ordinance and also for a Public Hearing to place a Zoning Classification on the Rankin - Floyd property. ``' A letter of agreement from the Jupiter Volunteer Fire Department was r�ad`and approved upon motion of Cornelius and second by Turnbull. Attorney Lord was asked to investigate drawing up an Ordinance re- '_r house numbers to be placed on houses. MINUTES OF THE H=ING OF THE COUNCILMEN OF THE VILLAGE OF TEQUESTA MAII 12, 144 PAGE 4 Attorney Lord gave First Reading to Ordinance Ho. 82 - "An Ordi- nance of the Village of Tequesta, Florida, Prescribing the Uses of lands Annexed by the Village Prior to Public Hearing." This Ordinance provides initial Zoning Classification of R -1A and provides that a Public Hearing be held within 120 days of annexation to provide a Zoning Classification. Cornelius moved, seconded by Bowden and passed that the First Reading of Ordinance No. 82 be approved. All Councilmen being present and approving the First Reading, Ordinance No. 82 was thereby passed and adopted on First Reading. There being no further business, the Meeting was adjourned at 10:10 P.M. DUSENBERY TELEPHONE 746.7474 CHIEF OF POLICE VILLAGE OF TEQUESTA P. O. BOX 638 ' JUPITER, FLORIDA - 33458 May 12, 1964 The Police Department during the month of April instituted or investigated forty three complaints. Fifteen doors were found unsecured in business establishments and eleven persons were assisted in situations ranging from automobile breakdowns to snake intrusions. Police vehicles traveled a total of 4,428 miles using 420 gallons of gas and 7 quarts of oil. Three minor traffic accidents were investigated, no persons injured. Twenty five dollars in fines were collected by Traffic Court for minor violations. On April 14, the Chief and Village Manager, Mr. Harp, met with Admiral Clexton, President of the Board of Governors of Tequesta Country Club, and discussed and made recommendations for better security of Country Club facilities. On April 30, the Police Department received a letter from Mr. John Chesney, Manager of the Country Club, stating that recommendations made at this meeting were being instituted and will be completed in the near future. On April 18, 1964 there was a B & E of a private residence in the Country Club Community. Furs and jewelry amounting to a sizeable sum were taken. Palm Beach Sheriffs Office and this Department are making a thorough investigation. Steps are being taken by the Police Department to minimize this dinner or early evening hour type of problem. During this month the Police Department has installed "No Parking Anytime" signs on Bridge Road in the vicinity of the Jupiter Bank, also on Tequesta Drive in the vicinity of the Steele Building and Doctors Medical Building. Dover Road by Plantreat Company was also posted. Further posting of restricted areas will be done as signs and labor are available. Traffic control buttons and control signs have been repaired and repainted in the Village as needed. Attached to this report is a complete breakdown of Police Department activities for the month of April, 1964. Respectfully submitted, Henry M.
