HomeMy WebLinkAboutMinutes_Special Meeting_06/16/1964 MINUTES OF A SPECIAL MEETING OF THE CC"=NCILMEN OF THE VII14GE OF TEQUESTA A special meeting of the Councilmen of the Village of Tequesta was held Tuesday, June 16, 1964 at 7:20 P.M. at the First United Presbyterian Church, Tequesta, Florida. Councilmen present were: Messrs, Valier, Turnbull and Cornelius. 1.1so present was Robert Harp, Village Clerk. Formal notice of the meeting had been given by letter to each councilman. Mayor Valier advised that the meeting had been called to consider a settle- ment of the suit brought by the Florida ast Coast Railway Company protesting the annexation of the railroad right of way bothe territorial limits of the Village. tae stated the railroad company had contacted the Village Attorney, 1yTilliam A. Lord and proposed a settlement on the following terms: 1. The Village to be allowed to annex the railroad right of way from the South line of Section 30, Township 40 South, Range 43 East to the North line of the SW1 /4 of the Nla /4 of said Section 30. 2. The Village will agree not to aruzer for ten (10) years the railroad right of way running from the North line of St,r /4 of the NI /4 of Section 30, Township 40 South, Range 43 East to the North line of Section 25. The Mayor stated the intention to annex had included the right of way from the South line of Section 30 to the "artin County line which included a portion on the North beyond the northern most limits of the Village. Councilman Cornelius stated he believed that the Maule Industries plant should be included in the right of way to be annexed. The Village Clerk stated he was not certain whether oer not Maule Industries was located on the Section of right of way which would be annexed underthe above terms. The Village Clerk stated Attorney Lord had said he believed this to be a very good settlement and should be accepted. The Mayor and Councilman Cornelius talked to Sttorney Lord by telephone on the proposal to get his comments and answers to several questions. Following the discussion, Cornelius moved, seconded by Turnbull and passed that the Village of T equesta settle the suit brought by the Florida East Coast Railway Company protesting the annexation of the railroad right of way on the following terms: 1. The Village will annex the Florida East Coast Railway Company right of way from the South Section Line of Section 30, Township 40 South, Range 43 East to the North line of the SV, of the N1; of said Section 30. 2. The Village will agree not to annex for ten (10) years the Florida Last Coast Railway Company right of way running from the North line of SW114 of the NW114 of Section 30, Township 40 South, Range 43 East to the North line of Section 25. Attorney Lord is to prepare proper documents to complete this settlement. Meeting adjourned at 8:00 P.M. Y ert ull submitted, arp Village Clerk
