MINUTES OF THE MEETING
OF THE
COUNCILMEN OF THE VILLAGE OF TEQUESTA, FLORIDA
At 9:30 A.M., Tuesday, November 21, 1961, the regular monthly meeting
of the Councilmen of the Village of Tequesta was held at the Tequesta
Country Club, Tequesta, Florida.
Councilmen present were: Cecil Cornelius, J. P. Kurtz and Robert
Valier. Others present were: Robert Harp, Village Manager; Lou Laliberte,
Village Building Inspector; George Schlusemeyer, Mr. Craig, Mr. Middleton
and Mr. Renninger.
A letter of resignation from Councilman Wilson C. Hicks was read to
the Council, Mr. Valier moved, seconded by Mr. Kurtz that the resignation
be accepted as of November 21, 1961 and that Council consider names of
eligible persons to be considered to be appointed to Council to fill this
vacancy. Motion passed. (Letter attached to Minutes)
Messrs. Middleton, Craig and Renninger, Officers of the Waterway
Village Property Owners Association advised Council that they had polled
the members of their Association and the majority had voted to become a
part of the Village of Tequesta. Council was advised that there are 87 lots
in the sub - division, 35 houses constructed and 37 members in the Property
Owners Association. The delegation was questioned concerning the
conditions of the roads and drainage and were advised that the County
Engineers Office had estimated cost of getting roads and drainage up to
County specifications at 02.50 per front foot; work to be done by County
and property owners assessed on County tax roll over a 10 year period. The
delegation stated that approval of 60% of the property owners was necessary
prior to the Countyts start of the work and they further stated that it is
almost impossible to obtain this percentage of approval at this time. Council
advised the delegation that prior to any consideration for acceptance of
Waterway Village into Tequesta that the roads and drainage would have to meet
County specifications and be installed and constructed at the expense of
the residents of Waterway Village. Council stated that they could not take
a problem area into the Village and use tax money to bring the area up to
Village standards. The Village Manager was instructed to contact the County
Engineers office to get figures on the cost of properly completing the
roads and drainage and to make survey to establish amount of additional
tax revenue that could be expected to accrue to the Village of Tequesta if
Waterway Village should be annexed. The delegation further advised that
Jupiter Inlet Beach Colony, Inc. now owns the streets, but the property deeds
state that the streets are to be maintained at the individual property
owners expense. They further inferred that a special assessment for proper
installation of the roads and drainage would not be acceptable to the
majority of the property owners at this time.
The Village Manager presented a tax bill in the amount of $60.78
representing 1961 County Real Estate taxes on the Village Hall Site with
a taxable value of $2840. Council was advised that since the transfer of
ownership was not made until May 1961, the property was in the name of
Vacation Homes, Inc. at January lst and therefore taxes would be assessed on
the property. Village Manager was instructed to get Attorney Lord advice
on this matter and'is authorized to make payment upon advice of Attorney.
Considerable discussion was held on the new sub - division of "Ridgewood
Homes" since the matter of construction, not in conformity with the Palm
Beach County Building Code, had been requested by Mr. DiVosta, the Developer,
The FHA "Minimum Property Standards for One and Two Living Units,"
Chapter IV, General Acceptability Criteria, paragraph 401 -2 under local
codes and regulations states:
"Compliance with locally adopted public codes or regulations affecting
construction, heating, plumbing, electrical, fire prevention, sanitation
and lot improvements will be required." Mr. DiVosta had been invited to

attend the meeting and discuss his development plans with the Council,
however, he did not attend the meeting. It was Council's firm belief that
there is no reason why our present Building Code and procedures should be
changed and that the Village does not require two Building Codes. It is the
sincere desire of Council to have all homes built in accordance with all
codes presently in effect in the Village in order to assure good homes for
the ultimate purchasers, in conformity to the high type residences already
constructed throughout the Village. Mr, Kurtz moved, seconded by Mr. Valier
that the Village Manager advise Mx. DiVosta that the present codes now in
effect in the Village of Tequesta will have to be adhered to and all plans
and specifications for proposed houses will have to be submitted to Council
for their approval prior to start of any construction within the sub - division
of Ridgewood Homes. Motion passed.
The Council also discussed the matter of minimum square footage of
residential construction, and in view of the very small minimum square
footage requirements of FHA, felt that the zoning ordinance for R -1 areas
should have minimum square footage requirements. Mr. Kurtz moved, seconded
by Mr. Valier that the Zoning Ordinance as presented to Council should be
amended to require minimum of 1200 square feet of living area exclusive of
carportes and garages for all residential construction in R -1 areas. Motion
passed. Letters from Brockway, Weber and Brockway, Federal Housing
Administration and Village of North Palm. Beach pertaining to the use of
monolithic slabs are attached to these Minutes.
Council is quite aware of their obligation to see that all residential
construction continue to be of the same high quality and design currently
being done to insure the continued progress and desireability of the
Village of Tequesta.
Mr. Valier moved, seconded by Mr. Kurtz that the Village Manager's
salary be increased from x ! 4,000., to $5,000. annually, retroactive to
October 1. 1961, the beginning of the .fiscal year, and to be included in
the 1961 -1962 fiscal year budget. Motion passed.
The Village Manager presented a proposed budget for the fiscal year
October 1, 1961 to September 30, 1962 in the amount of $41,200. After
discussion of the various parts of the proposed budget, Mr. Kurtz moved ---
seconded by Mr. Valier that the budget as presented by the Village Manager
be accepted. Motion passed. The budget is as follows and a copy is attached

Beautification Fund was read and approved upon motion by Mr. Valier,
seconded by Mr. Kurtz.
Village Manager was authorized some of ~2200. for Christmas Home
Decoration Contest Prizes (41,;100) and ";'100. for purchase of Christmas Tree
and Lights to be erected on Island at U.S. #1 and Tegiiesta Drive,
An Ordinance provided for clearing and cleaning of lots at owners
expense was given second reading and upon motion by Mr. Kurtz, seconded by
Mr. Valier, the second reading was passed and ordinance was adopted. The
Village Manager is to find out from Attorney Lord just how the ordinance
is to be handled so that the Village can clear and clean lots and charge to
property owners without liability to the Village.
It was suggested that Village Attorney present the Council with data
pertaining to filing of plats and developing of sub -- division in the Village.
The Village Manager is to get opinion from Village Attorney as to
liability of Village with respect to all phases of operation of the proposed
Police Reserve.
There being no further business, the meeting was adjourned at 11:30 A.M.

Dear Mr. Harp:
i Agreeable with our conversation this morning,
I am enclosing herewith a copy of the North
Palm Beach standard for monolithic footing
and slab. We call to your attention that there
is a note on the plan, requiring a maximum density
certified by an engineer and this should be in
the hands of the Building Official before permit
is issued for this type of building.
We allow this type of footing on operational jobs
where a developer is building on a production line
basis. However, with regard to our individual
builders and on our better -class homes, we still
adhere to the footing and floating slab type of
construction.
