PUBLIC ZONING HEARING
VILLAGE OF TEQUESTA
DECEMBER 15, 1961
The councilmen of the Village of Tegmesta held a public hearing on
the Proposed Zoning Map and Ordinance, Friday, December 15, 1961 at the
Church of the Good Shepherd at 8;00 P.M.
Present were Councilmen Cornelius, Valier, Kurtz, and Turnbull;
Village Manager Harp and Mr. Dake representing Mr. George Simons' office.
Approximately 35 interested persons were present.
Mr. Cornelius opened the meeting with a few general remarks about
what had been done so far on zoning and why it was being done. He then
opened the meeting for discussion of the map and ordinance.
Mr. William Schlusemeyer addressed the meeting requesting adoption
of minimum side yard set backs of 7 -1/2 feet since these distances are
in his deeds and were accepted by the Village when his plats were
accepted. He was assured that this met with the approval of council. He
also asked about commercial set backs on streets and was advised that the
proposed ordinance calls for 15 feet set backs.
Mr. Robert F. McRoberts, Jr, representing DiVosta Land Co, and
Mr, Otto B. DiVosta protested the language of the ordinance calling for
10 foot side yard set backs since the development "Ridlgewood Homes" had
lots of 75 feet front width and 10 foot side set backs would restrict the
size of houses that could be built on these lots. They also protested the
proposed living floor area minimum of 1200 square feet since they were
going to construct 4 models with 2 over 1200 square feet and 2 under
1200 square feet. They would like a minimum living floor area of less than
1200 square feet.
Thomas h. Daly, representing Jupiter in the Pines spoke for a
minimum living floor area of 1200 square feet, which is the minimum placed
on construction in the Jupiter in the Pines area by the deed restrictions.
Mrs. Charles Bates protested the construction of a shopping center
across from her house on Tequesta Drive in view of the fact that they had
not been advised of this when they purchased their property.
Mr. Thomas H. Dal y, speaking for Celestial Land Development Co,,
developers of Bay Harbor, stated that they have a minimum of 2000 square
feet living floor area requirement.
Mr. Walter Gumbrow�ki stated that he had recently purchased a
house in Jupiter in the ines of between 1200 -1300 square feet of living
area and felt it was too small and suggested that he would like to see
a minimum of 1200 square feet so that he value of his and other property
would not decline.
Mr. Eddie Slovak of Eddiets TV spoke concerning antenna heights and
towers. He siad he thought a 40 foot height would give better reception than
the proposed 30 foot height.
Mrs. Virginia Daly stat ed that she had been instrumental in the fib
growt# of the entire area over the past few years and hopes that the
community will be able to maintain the high standards it now enjoys,
Mrs. Otto DiVosta invited all to see Southgate Street off County
Line Road to see the nice type of Community her husband builds,
Mayor Cornelius repeatedly stated that all the comments would be
given due consideration by Council prior to adoptiondof the ordinance.

After the meeting the Village - Manager talked with Mr. Dake who ad-
vised that there are three distinct - problems which the Council has to
consider prior to adoption of the ordinance. They are: _
1,) 1200 square feet living area.
2.) 7 -1/2 foot side yard set backs.
3.) 75 foot front lots.
Mr. Dake noted -that the ordinance calls for 10 foot side set backs
and if this were approved, all plans calling for set backs of less than
to feet in Jupiter in the Pines would have to come before the Board of
Adjustment, which would be most remaining lots. He further stated that
he did not think the Beard could allow less than 10 feet since he did
not believe "Unnecessary Hardship" could be shown by holding 10 foot
set backs on 85 foot lots. He and _ the manager suggest having a minmmum
side set back of 10 feet in the R -lA District and 7 -1/2 feet in the
R -1 District.
Mr. Dake also pointed out that under Section S D the minimum width
of lots in the R -1 District is 80 feet and in the R -1A District is
100 feet. These widths cannot affect already platted and accepted areas
however, setbacks as adopted by this ordinance will prevail. With this
in mind we must remember th* we accepted the plat of Ridgewood Homes
with 75 foot front lots.
The 1200 square feet living area is, we believe, a major problem
facing the Council. We must remember that this is a part of the restrict-
ive covenants set out by the developers of Jupiter in the Pines and it
cannot be x1mlamt violated by lot owners. It would appear that this
is beginning to be a battle between and for developers of the various
sections, one side wanting to keep tide minimum square footage high to
protect against loss of sales in their area to smaller and less expensive
houses in anothe area; and the smalUm other side wanting to build
somewhat smaller and less expensive houses to get in to the local mar-
ket. It appears that on the one hand we are asking for nicer and larger
houses in any new area but by increasing side yard requirements are
giving the developer less area in which to build a larger house. A great
part of the problem is the 75 foot width lots which were accepted.
Perhaps a 1200 minimum sgaure footage requirement would be acceptable with
7 -1/2 foot side set backs. Mr. Dake suggested that 1/2 area of enclosed
garages could be in living area as this has been done in several
instances. We could further include 1/4 of screened porches etc. , in
other words, devise a formula for finding living area square footage. In
most instances, the impression of size of a house is given by the
width of the front, which can readily be seen from the street and not
from the depth which is not as easily seem.
Perhaps a look at Southgate would be in order to get some idea of
the type houses which are intended to be built.
