OF THE
COURCIL IEN OF THE VILLAGE OF TEQUESTA, FLORIDA
At 9 :30 A.M., Tuesday, January 9, 1962, the regular monthly meeting of the
Councilmen of the Village of Tequesta was held at the Tequesta Country Club,
Tequesta, Florida.
Councilmen present were: Messrs. Cecil Cornelius, J. P. Kurtz, Walter F.
Lathrop and Thomas V. Turnbull. Also present were Robert Harp, Village Manager
and Village Attorney William A. Lord.
The meeting was opened by Mayor Cornelius. The Proposed Zoning Ordinance
and Map was' discussed and minutes of the Public Hearing held by the Council,
December 15, 1961 were read. Mr. William Schlusemever spoke to the Council to
get assurance that side line setbacks would be 7 feet to conform to his deed
restrictions on property in Jupiter in the Pines, Miss Tina Roscello, a salesman
for Thomas'H, Daly, Inc., advised the Council that she had sold Lot #1 in
Parcel "B", located on the corner of Teauesta Drive and Seabrook Road to a client
with the understanding that a Printing Shop was permitted under the zoning of
this area. County Zoning C -1 allows printing and publishing plants, but the
Proposed Zoning Ordinance for the Village has printing and publishing plants
zoned C -2 and this Shopping Center Area comes under C--1 zoning. Mr. George Offutt
protested the R -1 zoning of a tract of lard he owns abutting the west right of
way line of the Florida East Coast Railroad because this property had been
purchased with the understanding it was zoned C -1. Council also discussed antenna
heights and considerable discussion was given to the definition of living area of
houses. After due consideration of the above facts, the following changes in the
proposed zoning ordinance and zoning map were approved upon motion made by Mr.
Lathrop, seconded by Mr. Kurtz and passed.
1. R--lA District sideline setbacks to be 10 feet.
2. R -1 District sideline set backs to be 7 feet.
3. Residential radio and television antennaes shall not extend more than
40 feet above the ground,
4, Printing and publishing establishments, constructed with proper sound
proofing to eliminate nuisance noise, changed from C -2 Classification
to C -1 Classification.
.5. Minimum 1200 square feet liveable floor area computed as follows:

6. Property west of Florida East Coast Railway west right of way line for
depth of 375 measuring 2061.16 feet north from Tequesta Drive on west side and
1867.76 feet north of Tequesta Drive on east side to be changed to C--1 zoning
district.
Village Manager is to have changes incorporated in Ordinance and map for
reading and adoption by the Council.
Mr. Schlusemeyer was advised of a letter received from Palm Beach County
Commissioners advising that the Ridgewood Homes Subdivision had asked for County
monitoring of their work on Seabrook fZoad. The County Commissioners advised that
the quantity of water to be drained would be in excess of the carrying capacity
of Seabrook Road and the proposed inverted siphon at Tequesta Drive would be
inadequate and that there is no indication on the plans as to whether or not a
positive outlet is reached or whether the intervening drainage is over public or
private land. They further state that the plan for draining Ridgewood Homes
creates a neighborhood problem and request that disposal of the drainage from
tidgewood Homes Subdivision be handled in some manner more in keeping with the
well being of the surrounding area. (County Commissioners letter and letters to
Mr. DiVosta and Brockway, Weber and Brockway attached to minutes). Village
Manager was advised to contact Brockway, Weber and Brockway* to see what would be
necessary to correct county objections to drainage problem of Seabrook Road and
Teequesta Drive.

40 An anonymous letter suggesting that Village Ordinance #34 requiring inocula-
tions and licensing of dogs in the Village of Tequesta be amended to read that
all dogs be on a lead and curbed. The letter further states that this would ha,vc,
to be handled in conjunction with the Town of Jupiter. The matter was taken under
consideration and no definite action taken at this time.
Upon motion made by Mr. Lathrop --- seconded by Mr. Kurtz, and passed,
Police Commissioner Sutton was authorized to proceed with formation of Police
Reserve !providing proper insurance coverage protecting the obligation of the
Village to the public can be obtained.
Mr. Renninger spoke to the Council about the possible purchase of ocean
frontage for a municipal beach since the area is rapidly expanding and it would
be a great asset to the community. Mayor Cornelius advised that he would talk
to Mr. Field about Bessemer properties on the ocean that would be available for
possible purchase. .
Financial Report for December 1961 showing balance of $11,116.32 in the
General Fund, $3,309.14 in the Beautification Fund; and $375.00 in the Capital
Replacement Fund and disbursements made for December 1961 was approved.
December 1961 Report of Police Chief DahImeyer was read,
Mr. Renninger asked the Council what their feelings were corcerning small,
neat, clean industries coming into the Villa;;e since he was negotiating to
have a nice industry come in, but would want it to be well accepted. He was
assured that due consideration would be given any new industry anticipating coming
into the Village when facts concerning the business are known.
Village Attorney was advised to write the Florida Public Utilities and
Railroad Commission charges presently being made for water by the
Jupiter Utility Co., Inc.
A tentative plat of lands of Loxahatchee Corp, received from E. S. Painter
was shown to the Council together with a letter from Mr. Painter stating that they
do not intend to file a plat on their lands. The letter further states that
they are obligated to complete roads as shown by virtue of prior sales. Council
advised that the Village suggest to Mr. Painter that he dedicate at least 210 feet
of land r;orth from Tequesta Drive, 60 feet in width, and approximately 375 feet
west of U. S. #1 for a road and pave the road according to Vill,,ge specifications.
Upon motion by Mr. Kurtz, seconded by Mr. Lathrop and passed, in accordance
with Ordinance #23 Tuesday, March 20, 1962 was set as Election Day for the
election of Counciien in Groups 1, 3, 4 and 5; Robert Harp and Rose M. Pelo are
to act as Election Board.
There being no further business to come before the meeting, the meeting was
adjourned at 11:15 A. M,
