MINUTES OF THE MELTING OF THE COUNCILMEN OF THE VILLAGE OF tEVESTA The regular monthly meeting of the Councilmen of the Village of Tequesta was held Tuesday, December 11, 1962, at 7:36 p.m. at the Church of the Good Shepherd. Councilmen present were: Messrs. Cornelius, Valier, Bowden, and Lathrop. Also present were Robert Harp, Village Manager and Village Attorney William Lord.. Approximately 40 Village residents were also present. The minutes of the meeting of November 20, 1962 were read and approved. The Financial Report for month of November was read and approved. Cash Balances at 11 -30 -62 were as follows: Bank of Palm Beach and Trust Co. $20,966.37 Community Federal Savings and Loan 3,310.43 Petty Cash 25.00 $24,301.80 Mayor Cornelius asked Mr. Hyotlaine to discuss the request of T. W. Franklin to have the North 200 feet of the South 540 feet of Government Lot 3, Section 30, Township 40 South, Range 43 East, Palm Beach County, Lying East of R /1�' Line of State Road No. 5 (U.S. No.l) taken into the Village of Tequesta and to be zoned to present Palm Beach County C -1 zoning standards so a sales and service marina may be constructed with small boat storage in a fenced storage area. Mr. Hyotlaine stated the present county zoning C -1 for a distance of 250 East of U.S. No. 1 and that Mr. Franklin now has a boat sales business in operation. His plans are to construct a marina on the Inland 's,Jaterway where he can perform minor repairs, service and storage. teen questioned why Mr. Franklin had not requested his entire property (540 feet) be taken into the Village, Mr. Hyotlaine stated Mr. Franklin expects the South 340 feet to be used for Multiple Dwelling Units. The Councilmen expressed their feelings that they believed the entire piece of property should be put into the Village at one time because partial annexations in the past have left various sections surrounded by Village Limits and additional action has been necessary to try to annex those sections to the Village. It was suggested that the entire piece could be annexed under Palm Beach County C -1 zoning on the basis that Council would consider re- zoning the South 340 feet for Multiple Dwelling Units. Mr. Hyotlaine conferred with Mr. Franklin who agreed to put the entire piece into the Village. Therefore, Mr. Lathrop moved that the South 540 feet of Government Lot 3, Section 30, Township 40 South, Range 43 Fast, Palm Beach County, Lying East of R/W Line of State Road No. 5 (U.S. No. 1) to the Inland Waterway, owned by T. W. Franklin, be annexed to the territorial limits of the Village of Tequesta with present Palm Beach County C -1 Zoning Standards so a sales and service marina may be cons- tructed with small boat storage in a fenced storage area on the North 200 feet, and consideration be given to rezoning the additional property for Multiple Dwelling Units at a later date, Annexation to be subject to,receipt of proper petition from Mr. Franklin and Final Adoption of an Ordinance covering the proposed Annexation. Motion was seconded by Mr. Bowden and Passed. Mr. Hyotlaine then discussed the request of Paul Maddock: to have Parcel 2 and Lot 16, Block D, Jupiter Manors Subdivision, Government Lot 6, Section 25, Township 40 South, Range 42. East, Palm Beach County, annexed to the Village and to be zoned for Multiple Units of not more than two (2) stories in height. He explained there would not be any &,euplexes but Garden type apartments consisting of from 12 -16 Units. The area would consist of only 160 feet South of the bridge on Sevilla Road and Mr. Hyotlaine stated that since the location is on a main road, across the street from R -2 zoning allowing Multiple Units and not oppo- site any single family residences, that the Multiple Units would not be offensive to any adjoining houses. He stated Mr. Maddock had not as yet had definite plans prepared as to the exact appearances of the struc- tures or location on the site. He also stated that neither he nor Mr. Maddock- would want to take any definite action on the request if there were any great objections from residents and property holders. The Mayor then asked for comments from any interested residents and objec- tions were made by the Suttons, Brodies, Klimes, Crowleys, McCombs, T.H. Daly and quite a few others. In view of the numerous objections, MINUTES OF THE MEETING OF THE COUNCILMEN OF THE VILLAGE OF TEQUESTA DECEMBER 11, 1962 Page 2 Valier moved, seconded by Bowden that the request of Paul Maddock to have Parcel 2 and Lot 16, Vlock D, Jupiter Manors Subdivision annexed to the Village of Tequesta be denied. Motion Passed. The Village Clerk ira.s instructed to give second reading by title only to an Ordinance entitled, "An Ordinance of the Village of Tequesta, Florida, relating to the erection, construction, repair, alteration, location or maintenance of signs, billboards, marquees, canopees, and awnings, within the Corporate Limits of the Village; providing for the posting of bonds or insurance policies, the issuance of permits or fees therefor, revocation of permits, inspection and fees therefor; providing penalties for the Violation thereof.' Upon completion of the reading and motion by Valier, Second by Bowden and Passed, the Second Reading was approved and Ordinance No. 55 was therefore Passed and Adopted on Second Reading. The Village Clerk was instructed to give Second Reading by title only to an Ordinance entitled "An Ordinance for the Village of Tequesta, Florida regulating the Subdivision of land in or about to be Annexed to the Village of Tequesta, Florida." Upon completion of the reading and motion by Iathrop, Second by Valier and Passed, the Second Reading eras approved and Ordinance No. 56 was therefore Passed and Adopted on Second Reading. A report of the Beautification Committee was read. No definite action was taken on any of the items. The problem of providing water for the royal Palm Trees on Tequesta Drive was discussed and the Village Manager is to invite Mr. George Offutt,lll to the next Council meeting to discuss ways in which water could be provided. A report was also given on the night lighting of Tequesta Drive at U.S. No. 1. Mr. Valier reported that Trial Flood Lights had been placed on the First Royal Palm Trees on Tequesta Drive to see how well they would light up and identify the entrance. It appears that three lights shining up into the folidge and three lights shining down to the street might be adequate for easier location of Tequesta Drive at night. The Village Manager reported on a discussion with the Florida Power and Light Company who suggested placing three (3) double bracket 11,000 Lumer Mercury Vapor Lights with concrete poles in the island at a total expense of approximately $360.00 per year. It was explained that some present night lighting could be eliminated with a savings of approximately $50.00 to $75.00 annually. No definite action was taken and Mr. Valier was asked to pursue the matter further in conjunction with the Village Manager. Police Chief Dahlmeyer's Report for month of November was sub - mi-ted. Mr. Valier reported that he and the Mayor had met with Chief Barnes of the West Palm Beach Police Department, who agreed to make a survey of the Village Police situation. However, this has not been accomplished to date but the survey is expected soon. Mr. Valier also advised that other sources of information and assistance in this matter are available. Mr. Bryant McQuillen stated he believed the police matter to be quite important and hoped that the necessary survey of the situa- tion *mould be completed in the very near future so that any necessary action could be taken by Council. The Village Manager reported that the Jupiter Utility Co. had offered to rent to.the Village the West side of their office building on Bridge Road to house a fire truck of the Jupiter Volunteer "sire Department for a monthly rental of $100.00. Fire Chief Baird was contacted and said that the build lzg would be suitable for this pur- pose. Provision would also have to be rad.e ty the Village for electric service, water, and telephone service, Chief Baird stated that at one ` time Martin County Commissioners expressed a desire to ass: the Departz�aent for the fire protection given them.. No definite action was taken on the matter since the Council felt that this would be a service for the Etntire area north of the River and the town of Jupiter, Jupiter Inlet Beach Colony, Martin County, Tequesta and others should share the financ'al burden of housing for the fire truck. The Village Manager was asked to work with the Fire Department and see what assistance they could give in securiiig the necessary funds from the other areas. P. Martyn and Mr. Edward Nelson, President of the Uaterway Village Property Owners Association, follow- ing a meeting idth this Association to discuss ques�;ions that had arisen in connection with the rights -of -tray at the North and South end of the `Iaten -ray Village Shopping Center. (A copy of the memorandum is attached to these minutes). Mr. Nelson stated the feelings of his Lssociation about the entrance roads remaining private property and not subject to 'tillage of Tequesta Jurisdiction and their protests of the Village of Tequesta's intent to annex the Standard Oil Co. Property. The Mayor advised Mr. Nelson that these were both legal matters and matters of policy and could not see any action for the Council to take. He also advised him that we do not have any argument with the people of Watenmy Village. Mr. McQuillen asked the Mayor for the floor and made an appeal for the Council to provide for the remuneration of its members on a per meeting basis, with the provision that the Councilmen must be in attendance for the entire meeting, except in a case of dire emergency when he might have to leave a meeting. This was voiced due to the fact that the Councilmen are businessmen who must leave their busi- ness to attend Council meetings. The Council took no action on this request but promised definite action for next meeting. There being no further business, the meeting was adjourned at 8:55 P.M. i pectf ly s bmitted, obert harp Village Clerk R EPORT TO THE C OF VILLAGE OF TEQUESTA �he Beautification Committee met on Monday evening, December 3rd, at p.m. with the following members present Mrs. VM Johnson, Mrs. E.A. White, Mrs. H.W.Schull, Jr., Mr. David Stewart, Mr. Harry Gifford, Capt. Charles Bates, and Mr. Hobert Harp, and wishes to make the following recommendations to the Council: 1. That the new sign ordnance be publicized and put into effect as soon as possible. r . -- That the Council consider the possibility of installation of two wells, to be owned by the Village, to water the palms along Drive. 3. That the Mayor and the Council appoint a Planning Committee for the Village to consider problems that will be arising in the nixt five to ten years, such as how much the Village may be expected to expand, the building of a Village Hall, with • place to house equipment such as a jeep,a light tractor, • mower, etc. equipment needed to maintain the area as it grows larger. �.. That the Mayor rminind the County of its promise to widen Tequesta Drive between the new bridge and the entrance to the Tequesta Country Club Community Gates. Mr. Harry Gifford was appointed to install a trial street light, at the corner of River Drive and Golf. View Drive, encircled by a small landscaped area. Should this meet the approval of the Village, more lights can gradually be installed as the budget permits or by contributions from interested property owners.
