HomeMy WebLinkAboutMinutes_Special Meeting_02/12/1963 MINUTE OF PUBLIC H { � ZiG HELD BY THL COMWIUM21 OF T0 VIIIXIE OF TZ ESTA The Councilmen of the Village of Tequesta held a Public Hearing at the Church of the Good Shepherd, Seabrook Road on Tuesday, February 12, 1963 at 7:00 P.M. for the purpose of con- sidering a request to amend the Zoning Ordinance and to provide for the Zoning Classification of parcels recently annexed to the territorial limits of the Village of Tequesta as shovm on the attached notice of the meeting. Councilmen present were: Messrs. Cornelius, Lathrop, Valier, Bowden and Turnbull. Also present were Robert Harp and Village Attorney T,Tilliam Lord. Mayor Cornelius explained the purpose of the meeting and asked the Council to take action on the Zoning Classifications. Upon motion be Bowden, Second by Turnbull and Passed, the Sinclair Service Station Property was zoned C-1 Classification. No protests made. Upon motion by Turnb*11, Second by Lathrop and Passed, the Texaco Service Station Property eras zoned C-1 Classification. No protests made. Upon motion by Lathrop, Second by Bovden and Passed, the ?dinker Materials Corp. property teas coned C-2 Classification. No protests made. / Upon motion by Bowden, Second by Turnbull and Passed, Country/ Club Point Subdivision uas zoned R -1 Classification. No protests made. Upon motion by Lathrop, Second by Bowden and Passed, St. Judes Catholic.Church property eras zoned R -1 Classification. No protests made. Upon motion by Valier, Second by Dowd.en and passed, Jupiter - Tequesta Junior Citizens, Inc. property was Zoned R -1 Classification. Mr. B. W. Renninger and Mr. Middleton representing the Jupiter - Tequesta Junior Citizens, Inc. protested this action prior to the final vote, claiming they had been granted C -1 zoning by Ordinance No. 46 as stated in the minutes of the Council meeting of August 1, 1962. Attorney Lord stated the Zoning eras not a part of the Ordinance and that the minutes were evidently in error, with the Ordinance taking precedent over the minutes. Mayor Cornelius explained that the Council had agreed to C-1 Zoning, which the Jupiter- Tequesta Junior Citizens, Inc.. needed as one of the conditions to qualify for a mort- gage from Community Federal Savings and Loan Association and when all conditions could not be met and office space to be provided for the Village offices was not available by October 1, the Village had to make other arrangements for office space. Therefore the Council considered the original conditions void. Upon motion by Bowden, Second by Lathrop and Passed, the T. TJ. Franklin property was Zoned C -1. Mr. Bernard Munsey, Zoning Director for Palm Beach County, violently protested this action stating that residents of the county were losing the protection of the high classi- fication County Zoning adjacent to their properties. He stated the County was against spot zoning and especially where areas cannot get lower class zoning classification and petition to be annexed to municipalties with rezoning to the classification desired. He also stated he believed that municipalities should advise the County of any re- zoning which is near to and would affect properties in the County protected by County zoning. Mrs. Ziegler, an abutting pro- perty owner, stated she had no protest against C-1 Zoning of this property. The next item for consideration was the request of Thomas H. Darr, Inc. on behalf of Mrs. Raynor S. Miller to amend the Zoning Ordinance to eliminate the four (4) dwelling unit restriction in Section 6, A 2 of the Ordinance. Mayor Cornelius asked Mr. Lathrop to review the history of the property involved. He stated that Mrs. Miller was asked to be annexed to the Village so that +dontiguity could be had to bring Mr. 11illi.am Schlusemeyer's Jupiter in the Pines Subdivision into the Village. Mr. Frederick Il -wild, owner of property North of the gland in- volved and not within the Village limits, protested the proposal as detrimental to property values in the area and was against two storg construction. Mrs. Miller stated that there eras no zoning when she originally purchased the land and that she had a sale nor the property for the site of a 16 unit apartment house (condominiura) as shown on brochures she presented. She stated failure to receive the proposed zoning amendment would more than li::ely* pr4vent sale of the property and work a hardship on her. Mr. Munsey protested that this was spot zoning practically surrounded by County R -lAA Zoning. Thomas H. Daly reiterated that Mrs. Miller had been promised mulitple family dwelling zoning without restrictions when the pro- perty was annexed. Attorney John Burno representing Mr. E. G. Fitzheiiry of Eay Harbor, an officer or Celestial Land Develornent, Inc., protested the proposed change since the area is already zoned for multiple dwellings and questioned attorney Lord as to what is trying to be done. Attorney Lord stated that the Village had annexed this land for contiguity and Mrs. Miller had re3uested zoning for apartment house purposes. He further stated he recommended the Council comply with Mrs. Miller's request for rezoning to satisfy the contractual basis on which she allowed her land to be annexed. Attorney Burnes stated even Village land around the area in question rras zoned -1G and Mr. Lathrop Stated he has alirays thought that all four corners in this area would be a good place for multiple units buildings because of the location on a heavily traveled street and nearness to the bridge. Mr. B. 17. Renninger representing Teruesta Development Corp. developer of Country Club Point stated they were in favor of the proposed change and felt the proposed building would be an asset to the Village and a help to their development. Mr. Gilroy, architect of the proposed building; gave a brief explanation of the type of apartments proposed - two (2) bedroom apartments. Mr. C. T. Paugh, a resident of Tequesta Country Club Community stated he would have no objection to the proposed change. Following the discussion I;r. Lathrop moved that Section 3 - Districts Description of District ?­2 be amended to read ".•lultiple :Meraily Dwelling District" and section 6 E2 be amended to read "I zltiple Family Duelling structur,�:s." Mayor Cornelius presented a framed citation from the Village to John R. Sutton, Jr. for his faithful and diligent services as Village Police and Fire Cormi_ssi oner.
