COUNCILMEN OF THE VILLAGE OF TEIIUESTA
The Regular Monthly meeting of the Councilmen of the Village of
Tequesta was held Tuesday, May 14, 1963, at 7:30 P.M. at the Church
of the Good Shepherd. Councilmen present were: Messrs. Valier,
Bowden, Turnbull, Cornelius and Stewart. Also present were Robert
Harp and Attorney William Lord.
A letter from Franklin J. Holcomb submitting his resignation from
the Zoning Board of Adjustment was read. On motion by Cornelius, second
by Stewart and passed, the resignation was accepted and Mr. Holcomb is
to be thanked by letter for his services to the Village.
Upon motion by Bowden, second by Stewart and passed, Raymond D.
Shiplett was appointed to the Zoning Board of Adjustment to fill the
unexpired term of the late Henry W. Ramsdell. Term will expire in
January, 1966.
Mayor Valier explained that the Village had been looking for a
Florida Attorneq,to. fill the position of Village Judge and that Henry If.
Jewett had made application for the position and that his qualifications
were satisfactory for the position. Upon motion by Stewart, second by
Turnbull and passed, Henry W. Jewett was appointed Village Judge.
Attorney Lord gave the Oath of Office to Mr. Jewett. Mr. Valier advised
the meeting that the Judge's salary would be $ 75.00 a month and Court
would be held on the 2nd and 4th Thursday of each month at 7:30 P.M.
in the Village Office.
Mayor Valier advised the meeting that the next order of business
is a discussion of pollution of the Loxahatcee River. Mr. Edward Pearson
was present with a large delegation opposing pollution of the River and
especially the Jupiter in the Pines Sewerage Disposal Plant effluent
being put into the River. Mayor Valier explained that the Council
realized the detergent problem was world wide with a solution expected
in the next few years. He explained that the Council was against River
pollution. The Mayor asked the Clerk to read all correspondence re-
ceived to date concerning this matter. The following letters were
read and are attached to these minutes.
1) Letter and list of signatures dated March 28, 1963, from Edward S.
Pearson to Palm Beach County Commissioners.
2) Letter dated April 5, 1963, from Village to Palm Beach County
Commissioners.
3) Letter dated April 6, 1963, from Edward S. Pearson to Robert
Harp, Village Manager.
4) Letter dated April 13, 1963, from David B. Lee, Florida State
Board of Health to Edward S. Pearson approving the sewerage treatment
plant and laundromat's use of it.
5) Letter and list of 117 signatures dated April 25, 1963, from
Edward S. Pearson to Village of Tequesta.
6) Letter dated May 14, 1963, from Jack W. Robson, Mayor of Jupiter,
to Councilmen of the Village of Tequesta requesting the Village to
consider an ordinance against pollution.
Mayor Va3ier stated the Council did not feel it could take any
definite action on the problem at this time and asked Dr. V. D. Stone,
who has been working on the problem if he had any comments to make con -
cerning the mutter. Dr. Stone stated he believed the County and State
Health Department officials to be quite competent in the matter of
water pollution and that they were giving this matter a very close
examination and taking tests of all kinds to find out what effect the
Sewage Treatment Plant is having on the River. He stated that all the
tests had not been completed as yet and therefore definite results
were not available. He said the representatives of the State and County
Health Departments would be glad to meet with all interested parties
_. after the tests have been completed to further discuss the matter.
Mr. Edward Pearson, Mr. Robert Butt and Mr. Lefkowitz all spoke against
the pollution of the River by the Sewage Treatment Plant.
County Commissioner Van Kessel explained the County's position
in this matter stating that they have no direct control over such
mutters since it is a function of the State Health Department. He
assured all present that the matter was being looked into thoroughly

and that he believed both the County and state Health Department
personell were well qualified and were working in the best interests
of all the people. He stated he believed the proper approach to the
problem would be a public meeting for all interested parties to discuss
the results of tests presently being conducted by the Health Department.
It was the feeling of Council that no definite action could be
taken until such time as the results of the tests were made known and
were in favor of a Public Meeting to present all :acts. The Council
felt a pollution ordinance could not be considered until more facts
on the condition are made available.
Mr. DiVosta, together with his engineers David Brady and James D.
Payne, presented a plat of a portion of Ridgewood Homes, Section 2
together with road, drainage and other construction detail for app-
roval of Council. Brockway, T:leber and Brockway had approved the sub-
division with the exception of positive drainage. A letter from Mr.
Brady states the subdivision, when constructed according to the plans,
would not flood. Village Manager advised that DiVosta Land Co. had
given the Village a check in the amount of $7,700.00 which was placed
in the Escrow Account at the Atlantic National Bank to assure proper
installation of roads and drainage according to the plans and speci-
fications as approved. Estimated cost of improvements for first
section is $6,857.18. Cornelius moved, seconded by Dowden and passed
that the plat as presented.be approved and that the Mayor and Clerk
are authorized to sign the plat since DiVosta Land Co. has put up a
cash deposit of more than the cost of improvements plus 10%. Attorney
Lord is to draw up an Escrow Agreement among the Village, nubin Const-
ruction Co. and DiVosta Land Co. for release of funds only upon certi-
fication of DiVosta Land Co. engineer that the work has been completed
according to plans and specifications as approved.
Minutes of the previous meeting were read and approved with
Mrs. Tom Jones requesting that the number of names on petition against
rezoning of DiVosta property be re- checked for correct number. The
correct number of names on the petition and letter is 47.
Attorney Lord read an Ordinance showing the intent of the Village
of Tequesta to annex the Florida East Coast Railroad Right of Way
from the South Village Limit to the Martin County Line. Upon completion
of the reading, Turnbull moved, seconded by Lowden that the reading of
the Ordinance be approved. Motion passed and all Councilmen being
present, Ordinance No. 64 was passed and adopted on First Reading.
Attorney Lord read a resolution authorizing and directing the
Chief of Police to erect "No Parking" signs to prohibit parking within
300 feet of the East end of the Hooley Point Bridge and 200 feet from
the West end of said bridge along the Right of Zlay of Tequesta Drive.
Bowden moved, second by Stewart and passed that the resolution be
adopted.
A letter was read from Mr. William Schlusemeyer requesting
permission to place a temporary 12 ft. by 30 ft.. real estate office
on Lot 10 Resubdivision of a portion of Jupiter in the Pines, Section
B. (Northeast Corner of Tequesta Drive and Seabrook Road) on a year
to year basis. Council and attorney Lord said this would have to be
taken before the Zoning Board of Adjustment for the granting of a
variance at a Public Hearing and Mr.,Schlusemeyer was so advised.
A letter from Jupiter -T questa Junior Citizens was read requesting
that the Village appropriate funds in the next budget for support of
their program,
Treasurers Report and Disbursements for month of April, 1963,
was approved. Cash Balances at 4 -30 -63 were as follows.

Mayor Valier reported on a meeting of representatives from County
Municipalties which he attended at which the County Commissioners
explained about a display they intended to have at the 1964 -1965
I'lorld's .Fair in New York City. It was decided that a per capita cost
of about 15 cents for each Municipality would be an equitable contri-
bution to the project and help in putting Palm Seach County before the
eyes of thousands. It was the general feeling of the Councilmen that
the Village should participate and Cornelius roved, second by Dowden
and passed that the Village of Tequesta contribute $100.00 to this
project.
Mr. & Mrs. Tom Jones asked if the plans for DiVosta Construction
Co. apartment building had been approved and were advised that they
had been.
B. 11. Renninger stated he believed that - the Village should approve
the use of monolithic slabs and Manager uas asked to look into this
matter once again.
Attorney Lord stated the Palm Beach County= Delegation in Talla-
hassee could not assist in getting the Legislature to male Charter changes
this year and he was asked to look into changing the Charter through
a Charter Board. The basic change a- the moment is to change the
method of election of Councilmen from at large to a Burrough System
frith the Mayor to be elected at large.
A plat of a proposed subdivision, "The Village" at Tequesta to be
located North of the Jupiter- Tequesta Junior Citizens on the [ Side
of Seabrook Road was shosm to the Council. The land is not presently
in the Village and the Council :-rus inforried by the Manager that
Mr. enninger would life to have an P -2 Buffer Zone on the North and
Jest Side of the Juniors Citizen's property. The Council said they
did not have control over the zoning of this land since it was not in
the Village and that it would first have to be in the Village before
this matter could be considered.
There being no further business, the meeting, was adjourned at
9:30 P.M.
