HomeMy WebLinkAboutMinutes_Regular_07/09/1963 MINUTES OF THE MEETING OF THE COUNCILMEN OF THE VILLAGE OF TEQUESTA The regular monthly meeting of the Councilmen of the Village of Tequesta was held Tuesday, July 9, 1963, at 9:55 A.M. at Tequesta Country Club. Councilmen present were: Messrs. Valier, Cornelius and Turnbull. Also present were Robert Harp and Attorney William Lord. Minutes of the June 11, 1963, regular meeting and of a special meeting held June 28, 1963 called to adopt Ordinance No. 68 increasing the tax on cigarettes by three (3) cents per package, were read and approved. The Treasurer's report and disbursements for month of June, 1963 was approved. Cash Tiolances on Hand at 6- 30--63 were as follows: First Bank of Jupiter $14 Community ederal Savings and Loan 8 Petty Cash 25.00 $23,802.21 Balances in the various accounts at 6 -30-63 were as, follows: Operating Account $15,666.89 Petty Cash 25.00 Special Tree Account 506.45 Building Fund 3,249.94 Street, Roads and Drainage Fund 2 Capital Replacement Fund 1,902.14 $23.802.92 A letter of application for a Village of Tequesta License to operate a kindergarten, to be known as Tot Town Kindergarten, in the Jupiter - Tequesta Junior Citizens Building starting September, 1963, from Helen S. Flagg and Ann Ellis Adair was read. Cornelius moved, seconded by Turnbull that the License be granted for a fee of $10.00. Motion passed. Mr. B. W. Renninger discussed repainting of the Jupiter in the Pines Sign just Vest of the Florida East Coast Railroad Tracks. He said they would like to change it to read Tequesta in the Pines with other addi- tional legand. It was explained that this was a non- comformi.ng sign under the Sign Ordinance and that any repair, alteration, maintenance, etc. would require a permit, which could not be granted under the terms of the Ordinance. Mr. Renninger stated he believed that it should be considered a temporary sign until such time as a large part of Jupiter in the Pines has been developed. He also called attention to the non- conforming bank sign. Upon motion by Cornelius, second by Turnbull and passed, the request for repainting and repairing the sign was denied. Mayor Valier advised that a substantial area around the Jupiter- Tequesta Junior Citizens Building had been cleared and graded for a play area for Village children by Spitzer Trucking at a cost of $200.00. Cornelius moved, seconded by Turnbull that the Sptizer Trucking bill for $200.00 be approved and paid. Motion passed. Mr. Renninger requested that the Police Department send the children to the play area so they will not be playing in the streets causing not only possible injury to themselves but causing much frustration for motorists in the area. A discussion was had on the location of future service stations 'in the Village and three possible zoning changings were given to Council by the Manager. They were as follows: 1.) Change the C-1 Zoning West of the F.E.C. Railroad to C-1A. with C-lA uses to eliminate service stations. 2.) Prohibit construction of service stations on Tequesta Drive West of U. S. Highway No. 1. 3.) Prohibit construction of service stations within a specified number of feet from each other, distance to be measured from lot line to lot line. Cornelius moved, seconded by Turnbull that the Councilmen of the Village of Tequesta hold a Public Zoning Hearing on the night of August 13, 1963, to amend the Village Zoning Ordinance to prohibit the const- ruction of service stations on Tequesta Drive Z,Test of U. S. Highway No. 1 and to provide a specified number of feet, measured from lot line.to line, between all future service stations. Motion passed. It was announced that the Councilmen will sit as a Board of Equali- zation of Real Estate Taxes on Tuesday, August 13, 1963, at 7:30 P.M. at the Church of the Good Shepherd. Attorney Lord reported that the State Legislature had approved the Village's request to change the Charter provisions for the election of Councilmen but he has not as yet been able to get a copy of the act. Attorney Lord stated there was a possihility that there might be some property owner's protests to annexation of the so- called Stradley Property in the Jupiter in the Pines section which is completely surr- ounded by the Village. He also reported that a letter had been received from Sales and Houston, West Palm Beach Attorneys, concerning our inten- tion to annex property owned by Dorothy Rankin and inquiring as to what zoning uses the Village would allow. The Council said it would be zoned R -1 Residential which allows single family dwellings. Attorney Lord advised that Ordinance No. 64, declaring the intent of the Village of Tequesta to annex the right of way of the Florida Fast Coast Railroad from the South Line of the Village to the Martin County Line had an error in the description of the property to be annexed and that a new Ordinance would have to be adopted and posted on the property again. He also advised that the Railroad intended to protest the annexa- tion and in fact has withheld payment of taxes to other Municipalities this year. Attorney Lord then gave First Reading to Ordinance No. 69, rescinding Ordinance No. 64. Cornelius Moved, Seconded by Turnbull and passed that the first reading of Ordinance No. 69 be approved. Attorney Lord then read Ordinance No. 70, declaring the intent of the Village of Tequesta to annex the Florida East Coast Railroad right of way from the South Line of the Village to the Martin County Line. Turnbull moved, seconded by Cornelius that the First Reading of Ordinance No. 70 be approved. Motion passed. Police Chief Dahlmeyer submitted his report for the month of June, 1963. Police Chief Dahlmeyer rakdhis letter of resignation as Police Chief of the Village of Tequesta, to be effective August 1, 1963. Upon motion by Cornelius, Second by Turnbull and passed, Police Chief Dahlmeyer's resignation was accepted. Upon motion by Turnbull, second by Cornelius and passed, Henry M. Dusenbery was appointed Police Chief of the Village of Tequesta with the appointment to be effective August 1, 1963. Mayor Valier thanked Chief W. P. "Freddie" Dahlmeyer for his services to the Village and Community during the past 5 years and stated that he would serve on the police force as a patrolman starting August 1, 1963. ^ ,-T!w Village Manager submitted a report concerning a request to permit the construction of monolithic slabs and the use of plastic drainage pipe (PVC Schedule 40) under the Building Code for the Village. The Manager stated that discussions of monolithic slabs had been held to November, 1961, and that recent inquiries had been made to Palm Beach County, West Palm Beach, North Palm Beach, Brockway, Weber & Brockway engineers. All discussions showed that various loads within the building and soil conditions within the building area were most important to the design of such a slab and most places that allow its construction have very rigid specifications. Discussions with Palm Beach County, West Palm Beach, North Palm Beach and Brockway, Weber & Brockway engineers showed that none of these approved of t.e use of plastic drainage pipe in house M � MINUTES OF THE MEETING OF THE COUNCIIMEN OF THE VILLAGE OF TEQUESTA JULY 9, 1963 PAGE 3 construction and was not permitted under the Building Codes of the aforementioned places. No action was taken on the request. It was reported that sortie construction is being performed without proper com- paction of the soil under the slab and the building inspector is to be notified of this fact and see that proper compaction is used. The school, to be known as Tot Town Kindergarten, would be held in the Jupiter- Tequesta Junior Citizens build- ing. The building has been inspected by the County Health and delfare Hoard and approved for this type activity. Both the Junior Board and Senior Advisors have met and approved our lease agredment. It is our intention to apply for a County license as well.
