HomeMy WebLinkAboutMinutes_Regular_08/13/1963 MINUTES OF THE MEETING OF THE COUNCILMM OF THE VILLAGE, OF TF.QUESTA, FLORIDA ,,) The Regular Monthly Meeting of theXouncilmen of the Village of Tequesta , was held Tuesday, August 13, 1963, at 2:-30 P.M. at the Church of the Good Shepherd. Councilmen present were: Messrs. Valier, Cornelius, Turnbull and Stewart. Also present were Robert Harp and Attorney Paul Potter, Attorney Charles Houston, representing Dorothy M. Rankin et al, owners of property at Corner of Seabrook and Dover Road appeared before the Council to discuss the Village's intent to annex this property as shown by Ordinance No. 67 passed June 11, 1963. Mr. Houston questioned the description as stated in the Ordinance because of the use of the phrase "Lying west of the County Road ". He further stated Mrs. Rankin wanted to use the house as a multiple dwelling,, a use which it has had for many years, even though zoned R -lAA by Palm Beach County. He stated it was a non - conforming use when the County zoned the area. He stated that he and his client had heard rumors that the Village intended to con- demn the property after it was annexed. Council explained that the pro- perty was completely surrounded by R -1 Residential areas permitting only single family dwellings. He stated his client does not desire to be annexed to the Village unless assurrance is given that it can be used for miltiple family dwelling purposes. Mayor Valier stated perhaps it could be annexed with a stipulation that as long as it is owned by the present owners it would be zoned for multiple dwelling purposes but revert to single family residence (R -1) zoning if and when itshould change owner- ship. Attorney Houston said he would have to confer with his client. Attorney Houston was told that an Ordinance providing for the annexation of this property would be given first reading at the Council meeting of Zeptember 10, 1963. Minutes of the meetings of July 9 and July 16, 1963, were read and approved. The Treasurer's Report and Disbursements for month of July, 1963 was approved upon motion by Turnbull, second by Stewart and passed. Cash Balances on hand at 9 -31 -63 are as follows.: First Bank of Jupiter $14,402.3 Community Federal Savings and Loan 8,834.18 Petty Cash 25.00 $23,261.53 Balances in the various accounts were as follows: Operating Account $14,236.34 Petty Cash 25.00 Tree Account 506.45 Building Fund 3,666.60 Streets, Roads, and Drainage Fund 2,725.00 Capital Replacement Fund 2,102.14 $23,261.53 Police Chief Dahlmeyer's Report for month of July, 1963 was read by the Clerk. Mayor Valier explained that he and Chief Dusenbery had talked to Palm Beach County Sheriff Martin Kellenberger about incarcerating-of Village prisoners in the County Jail. He stated an agreement had to be signed lay the Village and County so that this service would be available. The Clerk read the agreement and several Council members felt that con- siderable liability was placed upon the Village and questioned whether or not there is a need at present for.holding prisoners. Chief Dusenbery stated that this is a normal agreement and pkecedure between Sheriff's Departments and Municipalities as a protection for the Sheriff and that he believed we should have such facilities available to provide proper police services. Attorney Paul Potter was asked his opinion of such an agreement and specking as Mayor of Palm Beach Shores he said he had made such an agreement shortly after assuming office as Mayor. Stewart moved, seconded by Cornelius that the agreement for incarcerating Village pri- soners in the Palm Beach County Sheriff's facilities be approved and the Mayor and Clerk authorized to make such agreement. Motion passed. Mayor Valier introduced Police Chief Henry Dusenbery to the audience. Mayor Valier presented an engraved Gavel and a framed Citation to Mr. Cornelius in appreciation for his service to the Village as its Mayor from April, 1961 to April, 1963. Dahlmeyer in appreciation for his services as Police Chief of the Village from 1958 to August, 1963. Mayor Valier stated another Citation was for Mr. Water Lathrop, former Councilman and Mayor, who was out of town and the presentation would be made at a later date. Mayor Valier stated that bids had b een secured for an additional police car because two cars would be needed with the 24 hour police ser- vice for the Village. The Clerk explained the bids which were as follows, all on 1964 models with delivery 30 -- 45 days after the 1964 models come out in September: Florida Dodge Chrysler (Dodge) police Special $2,344.36 Bev Smith Ford (Ford) " " 2,321. Blank and Smith, Inc. (Plymouth) if 2,256.69 Fodor Dean (Chevrolet) " It 2,248.79 The Village Manager and Police Chief stated they recommended the purchase of the Ford after considering all aspects of the quotations. Turnbull moved, seconded by Cornelius that a 1964 Ford Police Special be purchased from Bev Smith Ford, Inc, at the price of $2,321.17. Motion unanimously passed and Village Manager authorized to make purchase. ,Notations on Police Car Radio were discussed by the Village Manager and Police thief stating bids were for tube type and transistor type sets. It was explained that the transistor type set would be more apt to require less maintenance and would cause a lot less battery drain on the police car battery .lien left on. Bids were as follows: 25 1 Output Tube Transistor Spencer Communications (G.E.) 533.25 $678.68 Motorola 537.00 677.00 Gulf Stream Electronics (Aerotron) 430.00 -0- The Village Manager and Police Chief recommended purchase of the General Electric Transistor Type Radio from Spencer Communications. Turnbull moved, seconded by Stewart that an ?X J3 JA6 General Electric Police Car Radio be purchased from Spencer Communications, notion unanimously passed. A discussion ensued 'on the locations for o'n' premises consumption of all intoxicating liquors, wines 'and beverages. It was the feeling ok Council that the Zoning Ordinance should be amended to restrict on pre- mises consumption close to Churches, Schools and Youth Centers. After a thorough discussion of the matter, Cornelius trioved, seconded by 'Turnbull that a Public Hearirig,be held to make an addendum to the Village Zoning Ordinance to provide that places desirous of serving intoxicating liquors; wines and beverage§ f on premises. consumption be located in the C-1 Commercial Zone only and that any place servi.'ng intoxicating liquors, wines and beverages be located a minimum of 1,000 feet from any Church; School or Youth Center, said distance to be measured from Lot Line to lot Line. Motion unanimously passed. Mayor Valier stated that Chief Dusea6ei~ had requested an Ordinance providing for fingerprinting, photographl_Wk i'nd issuing identification cards to all pers "ohs „who are serving the public including but not limited to domestics, lawn workers, store and shop clerks, club employees, solici�-, tors, etc. Chief Dusenbery explained that „F.B.I. results were confidenti4i and that he could not make kno.wa these facts to employers. Since there are considerable transient pe 'rsonell in our Village, the Council thought the I D Card Ordiria!nce to be good. Attorney Potter gave first reading;, to Ordinance No. 72,p`roviding for the fingerprinting, photographing and issuance of I D Card's to all persons serving the public in the Village of Tequesta. Upon completion of the "reading, Cornelius moved, seconded by Turnbull that the.First Reading of Ordinance No. 72 be approved. Motion unanimously passed'. Chief Dusenttiery advised the. Council that starting tomorrow, the Police Department wouid.cbm�e1 compliance with Village Ordinance No. 6 (Florida Model Traffic Code) wherein all commercial vehicles are to have MINUTES OF THE MEETING OF THE COUNCIUMT OF THE VILLAGE OF TEQUESTA, FLORIDA AUGUST 13, 1963 PAGE 3 the name of the person, firm or corporation lettered on either side of the vehicle in letters of 3 1, minimum size. He produced foams to show method of notifying offenders and giving one weeks time to correct. A notice pertaining to the Florida League of Municipalities Annual Convention was read and a letter from the Florida League of Munipalities advising that advertising in the Municipal Record Convention Issue was available was read. The Church of the Good Shepherd made a request to place their Conventional Church Sign at the corner of Seabrook Road and Tequesta Drive so that transients and visitors can locate the Church. Itrith the construction of the new shopping center just south of the Church, it is becoming more difficult to locate. The Church believes the red, white and blue sign would identify an Episcopal Church more easily just as other Churches have uniform signs to denote their locations. The present sign oridnance does not provide for this type directional sign. Mr. Harp said he had talked with Mrs. Schull, Chainan of the Beautification Committee, and she had suggested an additional sign attached below the present Directional Sign at this intersection and to have a cross on it to designate a Church. It was suggested that the Church ask the Zoning Board for a variance or to see if the Church vmuld like the additional sign on the Present Directional Sign as ecpla.ined above. Mr. B. 11. enni.nger was granted permission by Council to install entrance lights at Dover Road and Tequesta Drive, said lights to be maintained by Mr. Renninger. Police Chief Dusenbery was requested to survey the traffic pattern of the new shopping center on Tequesta Drive where the Minit Market and Laundry are located. Since the entire area is paved to Tequesta Drive, cars enter and exit at any spot and create a definite traffic hazard. There being no further business, the meeting was adjourned at 10:15 P.M.
