COUNCILMEN OF THE VILLAGE OF TEQUESTA, FLORIDA
A Public Hearing was held by the Councilmen of the Village of Tequesta
on Tuesday, September 10 1963, at 10:00 A.M. at the Tequesta Country Club,
Country Club Drive, Tequesta, Florida for the purpose of considering amending
the Village of Tequesta Zoning Ordinance No. 43. Councilmen present were:
Messrs. Bowden, Cornelius, Stewart and Turnbull. Also present were Attorney
William Lord and Robert Harp.
Vice -Mayor Bowden, acting in the absence of Mayor Valier, explained
that the hearing was being held to provide for the sale of all intoxicating
liquors, wines and beverages for on premises consumption to be permitted in
the 0-1 District only and to provide that any place selling such intoxicating
liquors, etc. shall be located a minimum distance of 1,000 feet from any
Church, School or Youth Center measured from lot line to lot line (copy of
notice attached). It was explained that notice had been properly posted and
advertised and all interested property owners notified by letter. He further
explained that the issuance of a license for a package store or cocktail
lounge was quite some distance away due to the State Beverage Department
requirement that the municipality must have a population of at least 1,251
persons, determined by a Federal or State Census, before the first such license
can be issued.
Mr. T. W. Franklin, owner of property between U.S. #1 and Intracoastal
Waterway in the Village, voiced a mild objection to the 1,000 feet minimum
distance requirement expecially on U.S. #1 since his and other parcels of
land might be good locations for future motels or hotels and this require-
ment could be a deterent to such businesses.
A discussion ensued on how the distance was to be measured and it was
the feeling of all the Council that it was to be "straight line" or "as the
crow flies ". It was further felt that perhaps a 1,000 foot limitation on
U.S. #1 was too great and could be reduced and leave the 1,000 foot limi-
tation in the C -1 area at Tequesta Drive and Seabrook Road.
There were no other persons appearing for or against the proposal.
Attorney Lord advised that since the notice had specifically stated
the 1,000 foot limitation from any Church, School or Youth Center, this
distance would be the only one that could be acted upon, therefore no action
was taken.
Cornelius moved, seconded by Turnbull that the Council hold another
Public Hearing on October 8, 1963, to determine the minimum distance and
method of measuring such distance from any Church, School or youth Center
that any place selling intoxicating liquors, wines and beverages for on
premises consumption can be located and to provide that the sale of such
intoxicating beverages for on premises consumption shall be permitted in
the C -1 district only. Motion passed unanimously.
There being no further business, the meeting was adjourned at 10:25 A.M.
