January 17, 1989 CONTROLS RELATING TO COMMERCIAL PROPERTIES AND PARKING LOTS Village of Tequesta, Florida LIGHTING. In Effect: Proposed: Community Appearance Board ordinance, Section 7- 6(a)(6). (Ex. 1) Do we want to impose requirements regarding lighting in parking lots? No requirements regarding having lighting. If there is lighting, Do we want to make said requirements, if any, retroactive? it has to be done in an aesthetic manner. Lighting is not to and therefore have an amortization clause? be used as a form of advertising, or in a manner that is not compatible to the neighborhood, or in a manner that it draws considerably more attention to the building grounds at night than in the day. Lighting following the form of the building or part of the building will not be allowed. All fixtures used in exterior lighting are to be selected not only for functional value, for aesthetic value. Sign Code, page 110, Zoning Ordinance (0)(1)(3). (Ex. 2) No blinking, flashing, intermittent or reflective type signs shall be permitted. Each light must be constant in intensity of illumination. No neon tubing or other lineal use of lighting in outlining either the sign or the building or the structure shall be permitted. These provisions are retroactive and the amortization schedule of five years applies. PARKING WT PAVING In Effect: Proposed: Community Appearance Board ordinance, page 423. (Ex. 3) These restrictions appear to cover the conditions of the parking lot. They do not specifically cover potholes, Parking lots are to be designed as an aesthetic asset to a etc., but it does require maintenance, in that it not be a neighborhood, and to the the building, group of buildings or nuisance, etc. Enforcement appears to be the main facility it serves. (Ex. 4) Provides provisions for off street parking and loading regulations; provides for arrangement of parking spaces, setbacks, prohibition of furniture, or other property within parking area; provides for required parking to be on the same site or contiguous to the use for which the parking is provided; provides for required number of parking spaces, provides for screening; provides for drainage and maintenance. Off_ street Parking areas shall be maintained in a manner as to not create a traffic or pedestrian hazard or nuisance, as well as in a clean, orderly, and dust -free condition, at the expense of the owner or lessee Provides for marking of parking spaces, parking and loading design standards, etc. LANDSCAPING AND IRRIGATION In Effect: Proposed: Community Appearance Board ordinance, page 421 -423. (Ex. 3) We are presently giving consideration to amortizing these requirements for a period of time.
