(a) The board of adjustment and the village

VILLAGE OF TEQUESTA APPLICATION VARIANCE ADDENDUM
A)SPECIAL CONDITIONS
The property is a pie shaped lot with unusually high angles making set back
planning very difficult.
B)The non conforming chunney was part of the original house design which must
have come to the attention of the original examiners , as the setback dimension is
clearly noted on the original site plan.
C} The applicant is not requesting any variance for the new construction, other than
to document the original variance to clear the record.
D)The variance has been present for over 40 years without any notice or complaint.
E)Agree with this stipulation
F) Allowing for remodel changes to keep the structure in design and appearance
accord with the rest of the community.
ARTICLE IV. NONCONFORMING USES
Sec. 78-91. Continuation generally.
The lawful use of any building, structur•e or land existing at the time of the adoption of the
ordinance fi�om which this chapter is derived may be continued although such use does not
conform to the provisions thereof; provided, however, the conditions in this article are met.

Sec. 78-92. Restoration of unsafe structures or buildings.
Any structure or building or portion thereof declared unsafe may be restored to a safe condition.
(Code 1977, app. A, § XIV(A)(1))
Sec. 78-93. Previously approved construction.
Nothing in this chapter shall require any change in plans, construction or designated use of a
building or structure for which a building peimit has been issued and the construction of which
shall have been diligently canied on within six months of the date of such permit.
(Code 1977, app. A, § XIV(A)(2))
Sec. 78-94. Maintenance or alteration of nonconforming building.
A nonconforming building may be maintained and repairs and alterations may be made, except
that in a building which is nonconforming as to use regulations, no stiuctural alterations shall be
made except those required by law including eminent domain pi•oceedings. Repairs such as
plumbing or changing of partitions or other interior alterations are permitted.

Sec. 78-95. Extension of nonconfoiming building or use.
Buildings or structures or uses of land which are nonconforrning shall not be extended or
enlarged.
(Code 1977, app. A, § XIV(A)(4))
Sec. 78-96. Discontinuance of nonconfor use of land.
When a nonconforming use of land has been discontinued for a period of 90 days, its future uses
shall revert to the uses peimitted in the district in which the land is located.
