MINUTES OF THE MEETING OF THE VILLAGE OF TEQUESTA COMMUNITY APPEARANCE BOARD AUGUST 14, 1985 A meeting of the Village of Tequesta Community Appearance Board was held at 9:00 A.M., Wednesday, August 14, 1985 in the Village Hall, 357 Tequesta Drive, Tequesta, Florida. Board members present were: Cleveland, Nagle, Ricci, Sundermann and - Alternate Member, R. Butterfield. Also present was: Robert Harp, Clerk of the Board and Scott D. Ladd, Building Official. Chairman Cleveland read the notice of the meeting and also the application of Palm Beach Sleep, Disc., Inc. for a sign for 267 U.S. Highway No. 1, Village Square Shopping Center which was to be included with the items for consideration at this meeting. The first item for consideration was the application of City Signs. James Whittle, Acting for the Realty Source, Inc, for a development sign for property at Shay Place. Ladd explained that the property was an unrecorded plat consisting of nine lots generally lying west of the County Fire Station on Seabrook Road, The sign is 4' x 8 1 , light cream color background, with emerald green and dark green lettering. James Whittle was in attendance at the meeting. There was a question as to where the sign was to be located and Ladd said it would have to be on the property to which it applies. Whittle said this sign would not be much good if it was placed way back from Seabrook Road, Ladd noted that approval for the sign had to also be obtained from the Village Council and that the sign had to be located pursuant to the requirements of the Code. Nagle suggested postponing action on the application but Ladd said the Board's consideration was on the sign only and not the location. Nagle moved, second by Ricci that "the plan for the development sign for the Realty Source be approved as submitted subject to the sign conforming to all Village's regulations. The vote on the motion was: Nagle for Ricci - for Sundermann - for Cleveland - for Butterfield - for and the motion therefore passed and the Board signed the plans. Whittle asked about raising the sign and Ladd said he would have to further review such a request. The next item for consideration was the application of Gene & Bob Foster Builders, Inc., acting for Roebling of New York, Inc, for remodeling of the east building of Lighthouse Plaza (Satellite Building), Bob Foster was in attendance representing the owners of the Plaza, Plans for the proposed Minutes of the Community Appearance Board August 14, 1985 Page 2 - ------------------------------------------------- work were shown as well as color cards, cedar wood samples and color photograps of the area including the Fireside Inn Restaurant. Foster said the facade would be cedar as well as the ceiling of the overhang and that the existing metal posts would be boxed in with cedar. He also stated signs would be required to have a uniform format except for the theater. Ladd noted the signs were not being considered at this meeting. Foster said the wood would be stained the light stain color as submitted and the valance for the lighting would be stained the dark brown stain color. These colors would be the same as those of the Fireside Inn Restaurant. Nagle asked why there was not a colored rendering of the entire area and Ladd said he didn't know but that the wood and colors were here. The improvement would be a continuation of the Fireside Inn motif. Nagle said he would like to see an artist's color rendition of the proposal. Cleveland said he thought it would be better to see the actual stain on the wood samples. Nagle said it is hard for him to visualize with the colors would look like. Cleveland said he is basically against wood that is varnished and doesn't last. Foster said the proposed stain would stay in good condition a lot longer than varnished wood. Cleveland suggested the applicant have the wood samples stained and brought back to the Board. Ladd said the applicant might as well bring in a copy of the plan in color. Foster said he would have the wood samples stained and have a plan provided in color. Butterfield moved, second by Ricci to table action on the application of Gene & Bob Foster Builders, Inc. until a meeting of the Board at 9:00 A.M., Wednesday, August 21, 1985. The vote on the motion was: Butterfield - for Ricci - for Cleveland - for Sundermann - for Nagle - for and the motion therefore passed. The next item for consideration was the application of Dottie Campbell for Signs for Tequesta Gallery, 361 Tequesta Drive; Library 365 Tequesta Drive, Travel - Gallery 367 Tequesta Drive; change in store front window for the library 365 Tequesta Drive and Landscaping for 365 and 367 Tequesta Drive. Dottie Campbell was in attendance and asked the Board to also consider "Tivoli" exterior lighting of the buildings she owns. Campbell showed pictures of and explained what Tivoli lighting is and a plan of the proposed exterior lighting was shown. Ladd distributed a copy of Section 7 -6 -(6) of the -- Village Code whicb.pertains to exterior lighting and indicated the proposed lighting plan could be in con- flict with same because the section states: "lighting is not to be used as a form of advertising in a manner that is not compatible to the neighborhood or in a manner that draws considerably rnore attention to the building grounds at night than in the day. Lighting following the form of the building or part of the building will not be allowed ". The plan showed the lights to be along the upper Minutes of the Community Appearance Board August 14, 1985 Page 3 - ----------------------------------------------- and lower edge of the facade of Gallery Five, Library and Travel Gallery. .Cleveland asked what would be considered as following the form of the building. Campbell asked -.f the lighting plan could be revised to provide for outlining sign areas of the units. Ladd said it was his and the Village Manager's deter- mination that the proposed lighting plan would be in conflict with Section 7 -6 (6) of the Village Code and should be submitted to the Village Council for clarification. Campbell agreed to this as did the Board. Cleveland noted "Tivoli" lighting is very subtle. Ladd noted Crystal Tree Plaza on U.S. No. 1 in North Palm Beach used such lighting. Nagle said he thought the lighting would be more discreet if in a single line. Ricci moved, second by Butterfield "that the plan for the "Tivoli" lighting for the facade of the Gallery Five, Library and Gallery Travel in Gallery Square North be approved ". The vote on the motion was: Ricci - for Butterfield - for Sundermann - for Nagel - for Cleveland - for and the motion therefore passed. :The Board members then signed the plans for the lighting. The next item for consideration was the Signage for the Campbell Buildings. Plans for the proposed signs for each building were shown and Campbell noted the letter for the "Travel Gallery" would be slanted and for the other signs would be upright. Cleveland questioned why this was necessary and Campbell said so that it would fit into the available space. The letters for all the signs are all 1/4" dark blue acrylic cut -out custom letters which will be the same color as presently on "Gallery Five ". Campbell noted the Library had agreed to use only the word "Library ". The signage includes signs for (1) Tequesta Galleries (Z) Library and (3) Travel Gallery. Ricci moved, second by Butterfield that "the plans for Signs for Tequesta Galleries, Library and Travel Gallery be approved as submitted with the proviso -that the Travel Gallery lettering be vertical instead of slanted. The vote on the motion was: Ricci - for Butterfield for Nagle - for Cleveland - for Sundermann - for and the motion therefore passed and the Board members signed the plans for the Signs. the next item for consideration was the change in windows and addition of brick to match that on front of the "Travel Gallery" for the Library area. The plans were shown to the Board. Butterfield moved, second by Sundermann "that the plans for revision in windows and addition of brick to the front of the "Library" area be approved as submitted. L. Harrell. The next item for consideration was additional landscaping for the buildings in Gallery Square North owned by Dottie Campbell. Campbell explained that there are two existing planters at the Tequesta Gallery Courtyard and entrance and a planter /bench is proposed between Gallery Five and the Library and a planter at the west end of Travel Gallery. Both planters to be brick to match the existing planters. The planting for the west end of the Travel Gallery would consist of yellow lantana No. 2 full, evergreen giant Liriope No. 1 full, Ligustrum Sinensis No. 3 full and Podocarpus Makii. The planting for the planter between Gallery Five and the Library would consist of Selloum Philodendrom No. 3 full, Chalcus or Viburnum Oporatissimum Multistem and Liriope Evergreen Giant No. 1 full. Campbell said the planters would be maintained by her tenants.. She said most of the proposed plants do not need much water. Campbell noted small "Tivoli" twilight plant lights are proposed for the planters. Ricci moved, second by Sundermann that "the plans for the planter/ bench, planter, plants and plant lighting be approved as submitted ". The vote on the motion was: Ricci - for Sundermann - for Cleveland - for Nagle - for Butterfield - for and the motion therefore passed and the Board signed the plans for this work by Conme Roy- Fisher, Landscape Architect Landscape Design and Land Planning. The next item for consideration was the application of Palm Beach Sleep Disc., Inc. for Signage for 267 U.S. Highway No.l, Village Square Shopping Center. Gabriel Isasi, owner, was in attendance. Ladd showed photographs of the area of Village Square Shopping Center where the store is to be located and stated that most of the center are cabinet signs. Plans for the proposed sign were shown to the Board. Ladd advised the Board the store front area had two west exposures and a south exposure. Ricci was excused from the meeting at 10:00 A.M. Ladd also advised he had received an approval letter for the sign from the owners of the Shopping Center. The actual green, red and gold colors, to be used for the individual box letters were shown. The signage will not be lighted. Cleveland said he believed the sign tells everything about the store and is too much. Nagle said he would like to see an artist s colored rendition of the proposed sign. Cleveland said he is more concerned about the amount of wording. Nagle said he would like to see colors that are Minutes of the Community Appearance Board August 14, 1985 Page 5 --------------------------------------------- not in conflict with other colors in the area, Isasi agreed to delete the word "Discount" and "Bedding and Furniture Sleepers Electric Beds" from the signage leaving only the wording "Palm Beach Sleep" and "Furniture" on the west face of the two store fronts. It was noted the letters are to be 18" high, individual, plexiglas with gold trim around. Butterfield moved, second by Nagle that "the sign consisting of 18" green letters with gold trim reading "Palm Beach Sleep Furniture" be approved. The action taken by the board shall be reduced to writing, signed by the chair - man and a copy thereof made available to the applicant upon request. (Ord.. No. 208, § 3, 4- 24 -73) Sec. '7 -4. Meetings; records; approval of plans; appeals from board, decision. (a) The community appearance board shall meet at.the call of the, chairman in , order to consider applications pending without unnecessary delay. All meetings shall be open to the public. and the order of business and procedure: to be followed shall be as prescribed within the rules and regulations to be adopted by the board. A majority of the board shall constitute a quorum and the affirmative vote of a majority of the board present shall be r necessary for any action thereof. The manager is authorized and empowered to appoint a sec- retary for the board. A record of the proceedings of the board shall be kept, showing its action on each question considered. Such record shall be filed in the office of the secretary of the community appearance board of the village, and shall be open for public inspection. (b) Failure of the board to take final action within twenty (20) days of sufficient plans and specifications being filed with the board shall constitute approval of such plans and specifications by the board. (c) Any person aggrieved by a decision of the community appearance board may file a notice of appeal with the council by filing same with the clerk. Such notice of appeal shall specify the action taken by the board and in what respect to his application. The council shall sit, in open session as an appeal board from the community appearance board within twenty (20) days of the notice of appeal being filed and shall render an order within seven (7) days after so sitting, which order shall either affirm the action of the community appear- 418 r^ 7 -4 COMMUNITY APPEARANCE BOARD § 7-6 ance board, affirm it with modifications or reverse it. (Ord. No. 208, § 4,4-24-73) Sec. 7 -5. Effect of article and board approval of plans. The requirements of this article are in addition to any other requirement of this Code such as the zoning code and the building code. Approval by the community appearance board of a given set of plans and specifications does not necessarily constitute evidence of applicant's compliance with other re- quirements of this Code. (Ord. No. 208, § 5, 4- 24 -73) Sec. 7 -6. Supplemental criteria and procedural rules of board. (a) General requirements. The general requirements are j minimum esthetic standards for all site development, buildings, structures, or alterations within the village except in Districts R1A and R1. It is required that site development, buildings or alterations with the sole exception of Districts R1A and R1 show proper design concept, express honest design construction and be appropriate to the surroundings. (1) Buildings or structures which are a part of a present or future group or complex shall have a unity of charac- ter and design, a relationship. of forms and the use, texture and color of materials shall be such as to create an harmonious whole. When the area involved forms an integral part of, is immediately adjacent to or otherwise clearly affects the future of any established section of the village, the design, scale, and location on the site , shall enhance rather than detract from the character, value, and attractiveness of the surroundings. (2) Buildings or structures located along strips of land or on single sites and not a part of a unified multi - building complex shall strive to achieve visual harmony with the surroundings. If they are built in undeveloped areas, the , three (3) primary requirements shall be met — express honest design construction, show proper design con- cepts, and be appropriate to the village. Mr. Burns told Council his clients do not receive'money for maintenance, billing or service. They do not get to keep the monies charged for Fire Protect - ion. Mr. Burns explained -to Council his clients would like to see a reduction to Tequesta. for minimum service charge per month, a reduction in the gallonage charge,,per.month or they would like to see the Village take over the entire system.of their water company. .. Ms. .Burns told'Council that the loop in their system under the river to Jupiter Island would help the Village. Council instructed the Village Manager, Village Attorney and the Village's.engineers to meet on this matter, and then meet with the representatives. of Jupiter- Martin Water Associates, Inc. and then meet with Council with their findings and /or recommendations. 3a The next item on the agenda was the discussion of language for the Beautification Committee. The Village Attorney handed out to Council, for discussion purposes, ideas for what he called the "Long Range Planning Commission ". Council agreed that this Commission should be established for a period of one year. The Commission shall elect a Chairman, a Vice - Chairman and a Secretary which shall keep records of its resolutions. - The powers and duties of the Commission shall be advisory to the Village Council. The Commission shall review and make recommendations to the Village Council regarding any items pertaining to Long Range Planning within the Village. (Copy of this subject is hereby attached and have become part of these Minutes). Howell moved, "to create the Long Range Planning Commission as.written (see attached) with amendments as discussed for a period of one (1) year." Gemino seconded and vote on the motion was: Gemino - for Howell - for Murphy - for Stoddard - for and therefore the motion was passed and adopted. Council discussed briefly the Community Appearance Board and the (duties of the Board. Gemino recommended that the four (4) vacancies on the Minutes of the Village Council Meeting August 13, 1985 Page 4 - ----------------------------------------- - - - - -- Community Appearance be replaced with the four (4) new people who have handedin their resumes for the Community Appearance Board. Gemino reminded Council that there were two (2) signs coming before the Community Appearance Board tomorrow and that Council should have some input into them. Council set Thursday, August 22, 1985 at 5:00 P.M., or Wednesday, August 21, 1985 at 5 :00 P.M. for two possible dates for a Workshop Meeting for Review of Coastal Zone Protection /Conservation Element of the Comprehensive Plan. The Village Manager is to check with the Village Planner to see which date is best. The Village Manager's Report for July 21, 1985-through August 10, 1985, the Water Department and Village Financial Statement for June, 1985 were received. Gemino asked if the Village Building Department had the right to rescind the Building Permit for Step Saver. The Village Attorney advised Council that the Building Official needs to make a decision if there are violation, what those violations are and then we can take it from there.
